An Ordinance amending Chapter 60 of the
5aint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes � 462. 357 and � 64. 210
of the Legislative Code, James S. Theros duly petitioned to rezone
the W. 4 feet of Lot 18, and all of Lots 19 and 20 , Block 1,
Macalester Villas, located on the southwest corner of Snelling and
St. Clair, from R-4 to P-1 for the purpose of providing parking,
the petition having been certified by the Department of Finance
and Management Services on September 23, 1982 as having been con-
sented to by at least 67% of the owners of the area of the property
to be rezoned, and further having been consented to by at least
two-thirds of the owners of the property situated within 100 feet
of the total contiguous descriptions of real estate held by the
same owner or any party purchasing any such contiguous property
within one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on October 7, 1982
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107. 03 of the Admini-
strative Code, submitted its recommendation to the Planning Com-
mission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting hald on October 8, 1982 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

rezoned; and
WHEREAS, A public hearing before the City Council, having been
conducted on November 4, 1982 where all interested persons were
heard, and the Council having considered all the facts and
recommendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 26,
as incorporated by reference in Section 60. 301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows :
That property located on the southwest corner
of Snelling and St. Clair, being more particu-
larly described as the W. 4 feet of Lot 18, and
all of Lots 19 and 20, Block l, Macalester
Villas, be and is hereby rezoned from R-4 to
P-1.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
The Zoning Committee of the Planning Commission held a public hearing on
this rezoning on October 7, 1982. For that hearing, one letter was
received in support of the rezoning and one in opposition. A request to
lay the matter over to allow time for district council consideration was
also received. No testimony was presented at the hearing except by the
applicant.
At the close of the hearing the Committee voted 5 to 1 with one abstention
to recommend approval of the rezonina to the Planning Commission.
On October 8 the Planning Commission considered the Zoning Committee's
recommendation and approved the rezoning by a vote of 15 to 2 with
1 abstention.
This matter is scheduled to be heard by the City Council on November 4, 1982.
Please notify me by November 3 if any member of the City Council wishes to
have slides of the site presented at the public hearing.

G. FINDINGS:
1 . The parcels may be rezoned to P-1 , Vehicular Parking District, provided the site
meets the intent and the 8 required conditions of the district.
2. The intent of the district is to serve areas that have developea without adequate
parking by permitting off-street parking lots. These parking lots are to be used
solely for parking of private passenger vehicles. Petitioner is proposin� an off-
street parking lot for private passenger vehicles in an area _ that has very
little off-street parking, meeting the intent of the district.
3. The proposed P-1 district is accessory to a business, the St. Clair Brailer and
other businesses , meeting the first condition.
4. The principal business, the St. Clair Broiler, is open from 7:00 a.m. to midnight
Sunday through Thursday and 7:00 a.m. to 2:00 a.m. on Friday and Saturday. The
lots will be used for parking only during these hours (and extertding up to one
hour beyond closing times) meeting the second condition.
5. The parking lot will be used by customer.s and will not be used for off-street
loading, meeting the third condition.
6. There will be no repair work or sales on the .lot, meeting condition four. �
7. The petitioner does not plan to erect any signs or buildings on the lot, meeting
condition five and six.
8. A dimensional layout of the proposed parking 7ot has been su►amitted, meeting the�
requirements of condition seven, and all requirements of condition eight will be
enforced in the site plan review wliich is underway.
9. The petitioner plans to provide for parking on the easterly parcel plus the easterly
three feet of the westerly parcel with a single-family residence to remain on the
westerly parcel .
10. Land Use Plan policy 4.2-7 recommends that the City encourage businesses to reduce
traffic and parking problems.

PRESENT: Mmes. Karns and Summers; Messrs. Armstead, Bryan, Lanegran, (_evy,
and Pangal of the Zoning Committee; Mr. Segal , Assistant City
Attorney; Ms. Lane of the Division �f Housing & Building Code
Enforcement; Ms. Beseman, P�r. Ford, Ms. James, and Ms. McNeally
of the Planning Division Staff.

The meeting was chaired by J_ames Bryan, Chairman.
JAMES S. THcROS (#9258) : Rezone from R-4 to P-1 to provide parking for
St. Clair Broiler and other businesses (1594 St. Clair).
The applicant was present. There was no opposition present at the hearing.
Mr. Ford showed slides of the site and reviewed the stafi�f report noting a correction
on the size of the parcEl (84' on St. Clair x 126.01 ' = 10,584 sq. ft. ).
Staff recommended approval of the rezoning. One letter was received in
support, one in opposition, and District 14 requested the matter be laid over
to allow time for review.
�1r. Levy moved to lay the matter over to November 4, 1982. Mr. Pangal seconded
the motion.
There was discussion regarding the district's review of the proposal .
Jim Theros, 694 Kent, stated that he plans to construct the parking lot
as soon as possible. The lot will provide parking for the St. Clair Broiler
an� other husinesses in the arPa and t�vill be a real benefit to thP neiahborhood.
Hearing no further testimony, Mr. Bryan closed the public hearing portion of
the meeting.
A voice vote was then taken on the motion to lay the matter over. The motion
failed.
htr. Armstead moved approval based on findings 1 through 8, 10 and 11 of the
staff report. h1s. Karns seconded the motion, which passed on a roll call vote
of 5 to 1 with Mr. Pangal voting against the motion and Mr. Lanegran abstainiri�.
