An Ordinance amending Chapter 60 of
the Saint Paul Legislative Code pertaining
to zoning for the City of. Saint Paul and
the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes � 462 .357 and � 64 .210
of the Legislative Code, Joseph and P�arie Chenoweth duly petitioned
to rezone Lot 1, Block 5, Brunson' s Addition, located at 563 Payne
Avenue on the west side of Payne between Hapkins and Petit, from
RM-2 to B-1 for the purpose of making vacant commercial building
conforming, the petition having been certified by the Department of
Finance and Management Services on March 4, 1982 as having been
consented to by at least 67� of the owners of the area of the
property to be rezoned, and further having been consented to by at
least two-thirds of the owners of the property situated within 100
feet of the .total contiguous descriptions of real estate held by
the same owner or any party purchasing any such contiguous property
within one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on March 18, 1982
conducted a public hearing for the purpose of considering the
rezoning petiticsn, and pursuant to Section 107.03 of the Admini-
' strative Code, submitted its recommendation to the Planning Com-
. mission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on r2arch 26, 1982 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

rezoned; and
WHEREAS, A public hearing before the City Council, having been
conducted on April 15, 1982 where all interested persons were heard,
and the Council having considered all the facts and recbmmendations
concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 13,
as incor�orated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located at 563 Payne on the west
side of Pa�ne between Hopkins and Petit, being
more particularly described as Lot 1, Block 5,
Brunson's Addition, be and is hereby rezoned
from RM-2 to B-1.
Section 2.
This ordinance shall take effect and be in force thirty (30) ,
days from and after its passage, approval and publication.

Dear Sir:
On March 18, 1982, the Zoning Committee of the Planning Commission held a
public hearing on this rezoning petition. The petitioner was present.
There was no testimony. After closing the public hearing, the Committee
voted 7 to 0 to recommend approval of the rezoning.
On htarch 26, 1982, the Planning Commission considered the Zoning Committee's
recommendation and approved the rezoning on a vote of 15 to 0.
The rezoning is scheduled to be heard by the City Council on April 15, 1982.
Please notify me by April 14 if any member of the City Council wishes to
have slides of the site presented at the public hearing.

PRESENT: Mnes. Karns and Summers; Messrs. Armstead, Bryan, Lanegran, Levy,
and Pangal of the Zoning Committee; Mr. Segal , Assistant City
Attorney; Ms. Lane of the Division of Housing & Building Code
Enforcement; P•1s. Beseman, Ms. James, and Mr. Soderholm of the
Planning Division Staff.
ABSENT• None
The meeting was chaired by James Bryan, Chairman.
JOSEPH & MARIE CHENOWETH (#9120) : Rezone to B-1 to make vacant commercial
structure conforming so it can e used in its entirety for corr�nercial purposes
for property located at 563 Payne.
The applicant was present. There was no opposition present at the hearing.
Ms. James showed slides of the site and reviewed the staff report with a
recommendation for approval . District 5 submitted a letter in support.
The applicant had nothing further to add.
Hearing no further testimony, Mr. Bryan closed the public hearing portion
of the meeting.
Mr. Pangal made a motion to recommend approval of the rezoning based on
findings 2 through 6 of the staff report. Ms. Karns seconded the motion.
The motion passed on a roll call vote of 7 to 0.

permit use of the building far a commercial cleaning business .
In �anuary, 1982, the Planning Commission approved a change in nonconforming use permit
to use the building for a general sales office.

We have been requested by Mrs. Woida, on behalf of the
Chenoweth Floral Shop, to write concerning a rezoning petition
to rezone 563 Payne Avenue from RM-2 to B-1.
Independent School District #625 recently sold property
located at 515 Kenney Road to Fox Investment Company. The
actual deed to Fox has not been delivered pending resolution
of a cloud on the title. However, Fox is entitled to a deed
from the School District and have purchased the property.
