WHEREAS, the Legislature of the State of Minnesota (the "State") passed certain local laws that specifically affect the City of Saint Paul, Minnesota (the "City") and the property tax exemption for the regional ballpark and the City's half cent sales tax (the "Sales Tax"); and WHEREAS, 2013 Minnesota Laws, Chapter 143, Article 4, Section 41 relates to the property tax exemption for the regional ballpark; and WHEREAS, 2013 Minnesota Laws, Chapter 143, Article 8, Sections 44 and 45 relate to the City's Sales Tax; and WHEREAS, 2013 Minnesota Laws, Chapter 143, Article 12, Section 18 relates to the City's Capital Improvement Budget process and the ability of the City to issue general obligation bonds under Laws 1971, chapter 773, section 1, subdivision 2, as amended; and WHEREAS, 2013 Minnesota Laws, Chapter 143, (i) Article 4, Section 41, (ii) Article 8, Sections 44 and 45, and (iii) Article 12, Section 18 are collectively, referred to herein as the "Special Laws"; and WHEREAS, the Special Laws are only effective the date after compliance by the City Council of the City will Minnesota Statutes, Section 645.021, Subdivisions 2 and 3; and BE IT RESOLVED By the City Council of the City of Saint Paul, Minnesota as follows: 1. It is hereby determined that: (a) the Special Laws (i) provide for a property tax exemption for the regional ballpark, (ii) amend the permitted uses of the revenues received by the City from the Sales Tax, (iii) provide for an extension of the time for the City to impose the Sales Tax, and (iv) provide for an extension of the time for the City to annually issue up to $20,000,000 of general obligation bonds approved during the Capital Improvement Budget process; (b) the Special Laws are effective upon approval by a majority vote of the City Council of the City and filing a certificate with the Secretary of State, all in accordance with Minnesota Statutes, Section 645.021, subd. 3; and (c) the City Council has determined that is in the best interest of the City and its residents to approve the Special Laws. 2. The Special Laws are hereby approved in all respects and the City Clerk is authorized and directed to file with the Secretary of State a certified copy of this resolution along with the appropriate certificate in the form prescribed by the State Attorney General and furnished by the Secretary of State. 3. City staff are authorized and directed to take all actions necessary to implement the Special Laws. At a meeting of the City Council on 3/12/2014, this Resolution was Passed.
