Subdivision 5 (5)� That Section 62.102� of the Legislative Code be amended to read as follows: "(S) When a non-conforming use of a structure, or structure and land in combination, is discontin.ued or ceases to exist for 365 days, the structure, or structure and land in combination, shall thereafter be used in conformance with the regulations of the district in which it is located, unless the planning commission, pursuant to a public hearing, finds that the structure, or structure and land in combination, cannot reasonably or economically be used for a conforming purpose, that the proposed use is equally appropriate or more appropriate to the district than the previous non-conforming use, and that the proposed use is consistent with the health, safety, morals, and general welfare of the community and is consistent with the reasonable use and enjoyment of adjacent property. That Section 62.102, � of the Legislative Code be amended to read as follows: "(7) In any OS-1, B-1, B-2, B-3 and I-1 District existing residential uses shall not be non-conforming as to use of structure and land and ma.y be structurally enlarged, extended, reconstructed, or altered provided no additional dwelling units are added on the lot, and provided that the minimum requirements of the R-4 District are met." Section 3. That Section 62. 113 of the Legislative Code be amended to read as follows: "62. 113. Similar uses. When a s ecific use is not listed in a district the p anning commission s all etermine i a use is similar to other uses permitted in each district. The lannin commission shall make the followin findings in etermining one use is simi ar to anot er: (1) That the use is similar in character to one or more o� t'�ie principa uses permitted. (2) That the traffic generated on such use is similar to one or more o t'-i�incipal uses permitted.
