been certifi�d by the Department of Finance anc� T_Zanag�ment Services
on January 4, 1982 as having been consented to by at least 67% of
the owners of the area of the property to be rezoned, ancl further
h.aving been consented to by at least tv�o-thirds of the owners of
the property situated within 100 feet of the total contiguous

conducted a public hearing for the purpose of considering the
rezoning petition, and nursuant to Section 107 .03 of the Ar_1�nini-
strative Code, subrtlitted its recomraendation to the Planning Co�-

�IfIEREAS, The Planning Coz�mission considered the rezoning
petition at its meeting held on February 12, 1982 and recomr�ended

OPPOSITION: District 11 Coalition submitted a letter in opposition to the
rezoning.
Dear Sir:
On February 4, 1982 the Zoning Committee of the Planning Commission held a
public hearing on this rezoning. The applicant was present. No one appeared
either in support or in opposition. The District 11 Coalition had sent a
letter stating that they did not object to the seventh unit but did not want
the property rezoned. At the hearing it was explained that the seventh unit
could not be considered a nonconforming use because it was neither in existence
in 1955 nor constructed prior to 1975 in accordance with approved building
permits. The Zoning Committee recommended approval of the rezoning on a vote
of 5 to 0.
On February 12, 1982, the Planning Commission considered the Zoning Committee's
recommendation and approved the rezoning by a vote of 16 to 0.
This rezoning request is scheduled to be heard by the City Council on March 4,
1982. Please notify me by March 3, 1982 if any member of the City Council
wishes to have slides of the site presented at the City Council public hearing.

D. EXISTING LAND USE: The site is occupied by a large old house and a newer two-car
garage. � �
E. SURROUNDING LAND USES: The site as surrounded by residential uses of varying density:
single family, duplex; and multi-family. The area Ts zoned RT-1 , with an RM-3 zone
immediately to the southeast.
F. ZONING HISTORY: The site was zoned "B" Residence prior to 1975.
G. FINDINGS: � .
1 . According to Building Department records, the structure was built in 1887. It
was assessed in 1944� as a�duplex, and in 1946 as a 6-unit building. It therefore
has legal nonconforming status as a 6-plex under the 1975 Code.
2. In June of 1981 the Building Department inspected the building and discovered an
� . . illegal seventh unit.
3. The building is presently divided into five 1-bedroom and two efficiency units.
Under the current Zoning Code, the density allowed in an RM-1 zone is determine�
by dividing the area of the parcel 'by 900. Using this formula, applicant has
sufficient space for the 7 one-bedroom or efficiency units.
4. The Comprehensive Plan's Housinq Policy Plan states the need for rental housing (p.9) .
5. The Comprehensive Plan's Land Use Plan (Policy 4.1-5) states: "The City will
establish criteria to allow sensitive reuse and conversion of existing housing
structures. The criteria will address density, lot characteristics, structural
characteristics, parking, open space, and neighborhood impact. "
6. The existing structure will not be enlarged, so the size of the building in
� relation to the size of the lot will not be altered.
7. There are 3 off-street parking spaces. There are approximately 3 on-street
spaces along Hewitt and 7 along Albert. The Code requires lZ off-street parking
. ' spaces per unit (11) for new construction.
8. There is open space nearby on the grounds of Hamline University, the high rise,
and Horton Park.
• � 9. Since there are other multi-family structures r�earby, this rezcning would not
appear to have a negative impact on the neiqhborhood.
N. STAFF RECOMMENDATION: Based on findings 3, 6, 8 and 9, staff recommen�s
approval of the rezoning to RM-1 to allow seven units in this structure.

Ms. James showed slides of the site and revievred the staff report with a
recommendation for approval . The District 11 Coalition submitted a letter �

David Glall , 517 Lake Avenue, t•dhite Bear Lake, presented a floor plan and
pictures of the 7th unit. He stated that the unit first came into existence
20 years ago when he purchased the building in 1962�.� No building permits
had ever been applied for. .
Hearing no further testimony, Mr. Pangal closed the public hearing portion �f . �
the meeting. .
_ . . Mr. Lanegran made a motion to recommend approval of the rezoning based on
findings 3, 6, 8 and 9 of the staff report. b1s. Summers seconded the motion.
The motion passed on a roll call vote of 5 to 0.
