An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
Legislative Code, William J. Smith duly petitioned to rezone Lot 12, Block 28,
Saint Anthony Park North located at 1356 Eustis Street from R-3 to RT-1 for the
purpose of constructing a duplex, the petition having been certified by the
Planning Division on October 3, 1984, as having been consented to by at least 67%
of the owners of the area of the property to be rezoned, and further having been
consented to by at least two-thirds of the owners of the property situated within
100 feet of the total contiguous property within one year preceding the date of `
the petition; and
WHEREAS, The Zoning Committee on October 18, 1984, conducted a public hearing
for the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the Planning
Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on October 26, 1984, and recommended that the City Council approve
the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
November 3, 1984, and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the property sought to
be rezoned; and
WHEREAS, A public hearing before the City Council , having been conducted on
November 15, 1984 where all interested persons were heard, and the Council having
considered all the facts and recommendations concerning the petition; now,
therefore,

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 1, as incorporated by
reference in Section 60.301 of the Saint Paul Legislative Code, as amended, is
hereby further amended as follows :
That property located on the east side of Eustis
Street between Chilcombe and Doswell Avenues being
more particularly described as Lot 12, Block 28,
Saint Anthony Park North, be and is hereby rezoned
from R-3 to RT-1.
Section 2.
This ordinance shall take effect and be in force thirty (30) days from and
after its passage, approval and publication.

OPPOSITION: 1 letter was received, a petition with 8 signatures and 2
people testified. The District Council recorr�nended approval of the
rezoning of the vacant lot, and denial of the rezoning of the single
f amily lot.
Dear Sir:
On October 18, 1984, the Zoning Committee of the Planning Comnission
held a public hearing on this rezoning. A staff report was received
recomnending approval of rezoning Lot 12, the vacant lot, to RT-1 and
denial of the rezoning for Lot 11, which contains a single family house.
The petitioner appeared and stated that the staff recomnendation was
acceptable to him. The District 12 Community Council testified in favor
of the rezoning of the vacant lot and questioned the ownership of the
property. The petitioner stated that he had sold the property on a
contract for deed but that the contract had been in def ault and he is
now sole owner of the property. At the close of the public hearing, the
Committee voted 4 to 0 to approve the rezoning to RT-1 of Lot 12 and to
deny the rezoning of Lot 11.

On October 26, 1984, the Planning Comnission upheld the Zoning Comnittee's
recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on November

hearing.

of lot 11. She said that 1 letter in opposition and a petition with 8

Qill Smith, 1632 E. Shakopee Avenue, Shakopee , stated that he wanted to
put an efficiency apartment in the front of the house and 3 bedrooms and
a ruok area in the back. Ile will accept what the staff has recommended,
how;�ver.
��is. Zieman asked him if it was okay a�ith him if they were to approve the
rezoning of lot 12 and deny rezoning of lot 11.
t�r. Sr�ith stated that it v;as , since the house doesn' t comply ��rith zoning
requirements.
Mr. �angal asked him if he 4JdS the fee owner, or if anyone else had an
interest in the property.
Mr. Smith stated he was fee owner, and no one else has interest in the
property.
Ann Copeland, District 12 Community Organizer, read a letter to the
Zonirig Committee stating that Lhe district council had met with the
ap�licant and neighbo�s of the area. She said that the final decision
of the district council was to ayree with immediately surrounding
neighbors of the property and support rezoning of lot 12 and oppose
rezoning of lot 11, conversion of the existing house. She also asked if
Specialty P9anagerient Company held the deed to the property, since they
are on record in the Taxation Department as the owners.
Mr. Smith stated that they did hold the deed on the property for t��ro
years, but as of September of this year he now owns the property.

Robert Shoffner, 1339 Eustis , spoke in opposition, he stated the
�opography of the site is very hi�h , and that it �vtould take a lot of
�nyineering to build a usable garage. Ne said that Eustis cannot handle
a lot of parkinc� since there are apartments located across the street
and the tenants park on the street and it is also a snow emergency
�route. He also said he felt the ti�ahole area should be left as an �-3
use.
Joan Taylor, 1353 arompton , spoke in opposition. She stated that in tf�e
winter the alley in back of the property is nearly impassable. She also
��as concerned about who the dev�+oper of the land will be. She said
that Specialty iianagem�nt is still on record in the Taxation Department
as being t{�e owner of 1:he property. She said she felt the matter sf�ould
be deferred until further investiyation is done.

F. ZONING HTSTORY: The site was zoned "A" Residence prior to 1975, and R-3
thereafter.
G. FINDINGS.
� lo Petitioner proposes converting the existing building to a duplex and
constructing a new duplex on the lot to the north.
2. Land Use Plan policy 4.1-5 states:
The city will establish criteria to allow sensitive reuse and conversion of
existing housing structures. The criteria will address density, lot
characteristics, structural characteristics, parking, open space and
neighborhood impact.
3. Housing Plan policy 1-5 recorr�nends duplexes on scattered vacant infill sites in
lower density areas.
4. The Planning Commission has developed guidelines to implement these
Comprzhensive Plan policies.
5. Each lot has a frontage of 50' and an area of 7,5Q0 sq. ft. meeting the first
guideline.
6. The lots are in a mixed density neighborhood with apartment buildings across
Eustis, meeting the second guideline.
7. The existing house is 958 sq. ft. at ground level according to Tax Department
records, and is 1 3/4 stories, for an estimated total floor area of 1,676.5 sq.
ft. This is smaller than the 1,800 sq. ft. required.
8. There is a tv�o-car garage in the rear of lot 11, meeting the guideline for
converstion of existing struci:ures.

H. STAFF ANALYSIS: Both lots meet the conditions set forth in the Planning
Co��nission's inl:erim duplex conversion guidelines. Ho��ever, the existing structure
on Lot 11 is smaller than that required for conversion.
I. STAFF RECOMPIENDATION: Based on findings 1-9 and the staff analysis , staff
recommends approval of the rezoning of lot 12 to RT-1, and denial of the rezon�ng

on October 18, 1984 , evidence was presented to suggest that the building _

deconvert ed to a single family dwelling .

An Ordinance amending Chapter 60 of the Saint Paul �
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
�WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
Legislative Code, William J. Smith duly petitioned to rezone Lot 12, Block 28,
Saint Anthony Park North located at 1356 Eustis Street from R-3 to RT-1 for the
purpose of constructing a duplex, the petition having been certified by the
Planning Division on October 3, 1984, as having been consented to by at least 67%
of the owners of the area of the property to be rezoned, and further having been
consented to by at least two-thirds of the owners of the property situated within
100 feet of the total contiguous property within one year preceding the date of �
the petition; and
41HEREAS, The Zoning Committee on October 18, 1984, conducted a public hearing
for the purpose of considering the rezoning petition, and pursuant to Section
� 107.03 of the Administrative Code, submitted its recommendation to the Planning
� Commission that the petition be granted; and
� WHEREAS, The Planning Commission considered the rezoning petition at its
� meeting held on October 26, 1984, and recommended that the City Council approve
�j � the petitio-�; and
� WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City an
November 3, 1984, and notices were duly mailed to each owner of affected prop�rty

WHEREAS, A public hearing before the City Council , having been conducted on
