PLANNING COMMISSION DECISION: Approve (16-0) ZONING COMMITTEE DECISION: Approve (6-0) STAFF RECOMMENDATION: Approve SUPPORT: One letter OPPOSITION: Five people testified in opposition; two letters received. Dear Sir: On April 19, 1984 the Zoning Committee of the Planning Commission held a public hearing on this rezoning. Petitioner's attorney was present and explained the project. Five people appeared and testified in opposition. Their main concerns were an increased amount of traffic on Bensan, increased assessments because of street improvements, and the access to the site from Homer Street. These concerns are reflected in the enclosed minutes. At the close of the public hearing, the Zoning Comnittee voted 6 to 0 to approve the rezoning based on the findings in the staff report. On April 27, 1984 the Planning Corrmission upheld the Zoning Committee's recommendation on a vote of 16 to 0. This rezoning is scheduled to be heard by the City Council on May 17, 1984. Mr. Dave Selle�°gren, Attorney for Michael J. Roach, presented the prelim�inary eoncept plan. He stated there have been two meetings held with nei�hbori�ood yroups, which have endorsed the rezoning proposal . Mr. Sellergr�n stated thr�i. Michael Roach had a traffic analysis done and they concur with the site plan review starf recommen�ation proh ���iting left turns. Mr. Se11�}rgren a�so stated that �Lhere are many trees in the area, and they plan on preser•ving as many trees as possible. Mr. Cas Prokap, President of Ballard Trucking, was present to state his: c�bjection to the proposal for two main reasons: 1) the apartments would generate too much traffic; and 2) vandalism to their property would increase. Mr. John Ritter, owner of the property at the corner of Homer and W. 7tf� and own�r of the �e�;, Sid;� Bc�y Sho�, t�as present to state his ����sition. tie st�te� that traffic is a problem, especially in the winter months. Ne was alsa concerned about residents from the development complaining about the paint fumes from his business. He rents out property across Benson from the proposal , and he is con- cerned that rental costs could rise because of ihe asses�merts if Benson is im- proved. Mr. Earle Stewart, former President of Ballard Trucking, was present to state his opposition to the proposal . Ne stated the area has easy access for truc4cs, and that it is a quiet industrial area with few people. The slight uphill grade from Homer to W. 7th, which is the only access to get in and c,ut, is hard to use, especially in winter. The Ballard property is only partially fencec� with chain link and barbed wire. He stated that vandalism was a growing problem. Mr. Dan Countryman was present to state his opposition. His company o��ns two small lots which he p�archased 15 years ago. Sewer and water is not avai7able there. He stated that he would not be against the rezaning if his paree'1 �aere not included, He also stated that his two lots were too small for his inter�ded use, and that he had ho{�ed to purchase additional land from the petitioner. . - .. . . ��y-ky� Page Two Mr. Bill Harper w�r also present to state his opposition to the propasal . Fle owns the 100-year-old farm house adjacent to the property and does no� su�p�ort the location of project. He stated winter traf-fic on Homer and �enson is a major problem. He stated that there is no plan for water/sewer. Fie is cor€cerned that the property will be rezoned and tP�en the project will fold. He only found out about the proposal the day before the ;hearing and had not had a chance to talk with the Distric�t Council . � Mr. Sellergren, during his rebuttal , stated he felt that the exist��ng grad� does not create a problem since �here ;s alternate access onto Shepard Road; th�t in- dustrial use would be worse; that snow in M7nnesota doesn't occur every day; and that they have preliminary bids in for wa�er and sewer. Ms. Summers asked Mr. Segal about the problem of trucks spraying snow onto the streets. Mr. Segal stated he doPsn't know how the snow gets onto the streets , but property owt�ers canriot plow their snow onto public right-of-way. Ms. Zieman asked about the setback for indus�rial develo�ment on the sit�, and P1s. James stated that no setback from the property line vrould be required. Hearing no further testimony, Mr. Pangal closecl the public hearing portion �f the meeting. � Mr. Levy moved approval based c°; findings 1 through 12. It is our belief tha`: the land choosen is inappropriate for an apartn�ent complex, most of the boarder7n, neighbors to this property are industt°ial and it is our belief that the marriagP of apartment buil�ing verses industrial will not benefit either party.. Similar apartment cordominium complexes in the immediate area mainta�n i�igh vacancy rates and I think this is due in part to tf�e fact that this area seems to be maintained by middle and lower middle c7ass residences. In our particu1ar case we lease our building to a tenant that makes heavy use of tractor/-crailers (semis) we do n�t feel that this ki��d of usag� would benefit the residential situation nor do we feel that a residential situation with its additional traffic and high�r vistbility wouTd benefit the tenant tf�at currently leases our property. It is also our contention that a marriage of this sort arould only tend to lotyer th� property values of both the industrial faciiit�es an� the apart- m�nt complex as neither one is in place with the other.
