the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
April 21 , 1984 and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the property sought
to be rezoned; and
WHEREAS, A public hearing before the City Council , having been conducted on
May 3, 1984 where all interested persons were heard, and the Council having con-
sidered all the facts and recommendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1 .
That the zoning map of the City of Saint Paul , Sheet No. 20, as incorporated
by reference in Section 60.301 of the Saint Paul Legislative Code, as amended, is
hereby further amended as follows:
That property located on the southeast corner of Mackubin and Concordia,
being more particularly described as All of Lots sixteen (16) through
twenty-two (22), inclusive, except therefrom the South one hundred
sixteen (116.0) feet thereof; and All those parts of Lots nine (9)
through fifteen (15) , inclusive, lying Southerly of the following de-
scribed line: Beginning at a point on the West line of Lot 15, 10.0
feet Southerly of the Northwest corner thereof; thence Easterly, parallel
to and 10 feet Southerly of the North line of Block 17, to a point 10.0
feet South of and 10.0 feet East of the Northwest corner of Lot 11 ;
thence run Southeasterly to a point on the East line of Lot 9, distant
24.0 feet South of the Northeast corner thereof; all in Block 17,
Mackubin and Marshall 's addition to Saint Paul , according to the plat
thereof on file and of record in the office of the County Recorder, in and for
the County of Ramsey and State of Minnesota; be and is hereby rezoned

An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes §462.357 and §64.210 of the Legis-
lative Code, the Housing and Redevelopment Authority of the City of Saint Paul
duly petitioned to rezone Al1 of Lots sixteen (16) through twenty-two (22) ,
inclusive, except therefrom the South one hundred sixteen (116.0) feet thereof;
and All those parts of Lots nine (9) through fifteen (15) , inclusive, lying
Southerly of the following described line: Beginning at a point on the West
line of Lot 15, 10.0 feet Southerly of the Northwest corner thereof; thence
Easterly, parallel to and 10 feet Southerly of the North line of Block 17, to
a point 10.0 feet South of and 10.0 feet East of the Northwest corner of Lot 11 ;
thence run Southeasterly to a point on the East line of Lot 9, distant 24.0 feet
South of the Northeast corner thereof; all in Block 17, Mackubin and Marshall 's
addition to Saint Paul , according to the plat thereof on file and of record in

Minnesota, located on the southeast corner of Mackubin and Concordia, from RM-3
to OS-1 , to permit construction and operation of a pathology laboratory, the
petition having beerr certified by the Planning Division on March 9, 1984 as
having been consented to by at least 67% of the owners of the area of the
property to be rezoned, and further having been consented to by at least two-
thirds of the owners of the property situated within 100 feet of the total
contiguous descriptions of real estate held by the same owner or any party
purchasing any such contiguous property within one year preceding the date of
the petition; and
WHEREAS, The current Zoning Committee on April 5, 1984 conducted a public
hearing for the purpose of considering the rezoning petition, and pursuant to
Section 107.03 of the Administrative Code, submitted its recommendation to the
Planning Corrrannission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on April 13, 1984 and recommended that the City Council approve

An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes §462.357 and §64.210 of the Legis- �
lative Code; the Housing and Redevelopment Authority of the City of Saint Paul
duly petitioned to rezone All of Lots sixteen (16) through twenty-two (22),
inclusive, except therefrom the South one hundred sixteen (116.0) feet thereof;
and All those parts of Lots nine (9) through fifteen (15), inclusive, ly.ing -
Southerly of the fol7owing described line: Beginning at a point on the West
line of Lot 15, 10.0 feet Southerly of the Northwest corner thereof; thence.
Easterly, parallel to and 10 feet Southerly of the North line of Block 17, to
a point 10.0 feet South of and 10.0 feet East of the Northwest corner of Lot 11 ;
thence run Southeasterly to a point on the East line of Lot 9, distant 24.0 feet
South of the Northeast corner thereof; all in Block 17, Mackubin and Marshall 's
addition to Saint Paul, according to the plat thereof on file and of record i.n
the office of the County Recorder, in and for the County of Ramsey, State of
Minnesota, located on .the southeast corner of Mackubin `and Concordia, from RM-3
to OS-1 , to permit construction and operation of a pathology laboratory, the
petition having beer� certified by the Planning Division on March 9, 1984 as
having been consented to by at least 67% of the owners of the area of the
property to be rezoned, and further having been consented to by at� least two-
thirds of the owners of the property situated.within 100 feet of the total �
contiguous descriptions of real estate held by the same owner or any party
purchasing any such contiguous property within one year preceding the date of
the petition; and
- WHEREAS, The current Zoning Comnittee on April 5, 1984 conducted a public
hearing for ,the purpose of considering the rezoning petition, and pursuant to
Section 107.03 of the Administrative Code, submitted its recorr�nendation to the
Planning Comnission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on April 13, 1984 �and reconxnended that the City Council approve

Dear Sir:
On April 5, 1984 the Zoning Committee of the Planning Comnission held a
public hearing on this rezoning. Petitioner testified and explained the
proposal . There was no opposition at the hearing. At the close of the
public hearing, the Corrrrnnittee voted 5 to 0 to recommend approval of the
reioning.
On April 13, 1984 the Planning Corrmission upheld the Zoning Comnittee's
recorronendation on a vote of 16 to 0.
This rezoning is scheduled to be heard by the City Council on May 3, 1984.
Please notify me by May 2 if any member of the City Council wishes to have
slides of the site presented at the public hearing.

Hearing no further testimony, Mr. Pangal closed the public hearing portion
of the meeting.
Ms. Summers moved approval based on findings 1 through 3, 5 througf� 7 and
the staff analysis. Ms. Zieman seconded the motion, which passed on a ro11

F. ZONING HISTORY: The site was zoned "C" Residence prior to 1975, when it was
c—�assifie� d RM-1. In 1979 the parcel was rezoned to RM-3 as part of the

G. FINDINGS•
1 . Petitioner proposes rezoning this parcel so that it can be sold and used as a
pathology laboratory. The proposed laboratory will permit expansion of an
existing business currently located near the State Capitol .
2. The Economic Development Strategy, part of St. Paul 's Comprehensive Plan,
states: "St. Paul shall continue to give priority to assisting the retention
and expansion of existing small commercial firms within the City."
3. The Land Use component of the Comprehensive Plan recommends that the City
". . .adjust land use policies to remain abreast of changes affecting the
character of commercial areas and adjacent neighborhoods."
4. The Summit-University Redevelopment Plan and District 8 General District Plan
recommend medium- to high-density residential uses at thas location.
5. The District 8 Planning Council has reviewed this proposal and supports it.
6. The District 8 Plan supports providing job opportunities for district
residents. The developer has stated that he intends to hire residents from
the area. . '
7. The intent of the OS-1 district is "...to serve as a transitional use between
the more intensive uses of land such as major thoroughfares. .. and the less
intensive uses of land such as one-family residential ." The proposed
rezoning would serve as a transition between the townhouses and the freeway.

N. STAFF ANALYSIS: While the City's Land Use Plan and existing district plans do
not spec�f�ca ly support commercial use a� this location, proposals must be
examined on a case-by-�ase basis. Given the uses on three sides of the site
(business, freeway, and industrial } this rezoning would appear to enhance the area
and buffer residential uses from the surrounding uses.
