An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to rlinnesota Statutes §462. 357 and §64.210
of the Legislative Code, Ambrose Gonshorowski duly petitioned to
rezone �xcept W. 15' Lot 22 and W. 28 . 32 ' of Lot 23, Block 7,
Hankees Cleveland View, located at 2033 Randolph, from R-4 to
RM-2 to permit continuance of three units , the petition having
been certified by the Planning Division on February 13, 1984 as
having been consented to by at least 67Q/o of the owners of the area
of the property to be rezoned, and further having been consented to
by at least two-thirds of the owners of the property situated with-
in 100 feet of the total contiguous descriptions of real estate
held by the same owner or any party purchasing any such contiguous
property within one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on March 1, 1984 con-
ducted a public hearing for the purpose of considering the rezoning
petition, and pursuant to Section 107 . 03 of the Administrative Code,
submitted its recommendation to the Planning Commission that the
petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on March 9, 1984 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition u�as duly published in the official
newspaper of the City on March 17, 1984 and notices were duly
ma.iled to each owner of affected property and property situated
wholly or partly within 350 feet of the property sought to be
rezoned; and

Dear Sir:
On March 1 , 1984 the Zoning Corrnnittee of the Planning Corr�nission held a
public hearing on this rezoning. The petitioner testified. A
representative from the District 14 Council also appeared and testified in
support. At the close of the public hearing, the Committee voted 4 to 0 to
recommend approval of the rezoning to RM-2 with the understanding that the
applicant will apply for a lot area variance from the Board of Zoning
Appeals.
On March 9, 1984 the Planning Commission considered the Zoning Committee's
recommendation and upheld it on a vote of 9 to 7.
This rezoning is scheduled to be heard by the City Council on March 29,
1984. Please notify me by March 28 if any member of the City Council
wishes to have slides of the site presented at the public hearing.

�. ZUNING HISTORY: On December 16, 1960 Lots 17-30 of Block 7 were rezoned from
comrri Ter iac 'f—to "B" Residence. On March 4, 1970 a building permit was issued to
construct a duplex on this site. In 1975 the area was rezoned to R-4.
G. FINDINGS:
l . According to records in the Division of Housing and Building Code
Enforcement, the building permit issued in 1970 was for a duplex, but the
assessor's records show three units in November of 1970.
2. In 1970 duplexes were permitted in the "B" Residence district on lots 50'
wide and 6,000 sq. ft. in area. Threeplexes were first permitted in the
"C-1" Residence district.
3. Land Use Plan policy 4.1-5 states: "The city will establish criteria to �
allow sensitive reuse and conversion of existing housing structures. The
criteria will address density, lot characteristics, structural
characteristics, parking, open space and neighborhoad impact."
4. Petitioner proposes rezoning to retain three units. There is a 3-bedroom
unit on the second floor and a 1-bedroom and an efficiency unit on the first
floor for a total of 8 rooms.
5. Petitioner's lat area is 6,957 square feet. At RM-2 density, 11 rooms ��ould
be permitted; RM-1 permits 7 rooms. Petitioner therefore needs a rezoning ta
RM-2.
6. There has been some confusion about the size of the upstairs unit. At one
point the Zoning Specialist was toid that the upper unit had only two
bedrooms, making a total of 7 rooms in the structure. The initial rezoning
petition therefore requested RM-1 designation. Since there are three
bedrooms in the upstairs unit, a new petition requestirg fZM-2 zoning has been
submitted.

7. 7he lot has sufficient area for a duplex structure and appears to meet the
Planning Commission's interim duplex conversion guidelines.
8. The lot does not have the minimum area required for multi-family use. Should
� the rezoning be approved, petitioner would have to obtain a lot area variance
of 3,042.8 square feet f rom the Board of Zoning Appeals.
9. The structure is 1,260 square feet at ground level . It would appear to be
sufficient for three units.
10. The lot contains a 3-car garage, an� there is a paved area with space for �
another car to the side of the garage. New construction would require four � �
spaces.
11 . The college grounds across Randolph provide some open space in the area, and
there are public parks within one-half mile of the site.
12. The area is largely single-family residential . There are no other duplexes
on the block. The corner of Cleveland and Randolph is commercial .
13. The 1975 code states that existing duplexes in R-4 districts are not
nonconforming as to use and may be �nlarged, extended, and reconstructed.
14. The intent of the RM-2 district is to provide for more extensive areas of
multiple family development.
H. STAFF ANALYSIS: This structure was to have been a duplex according to the
ui ing permit, but was changed to three units the same year it was constructed.
The lot area and low density character of the surrounding neighborhood indicate
that appraving RM-2 would be a spot rezoning. The most appropriate use of the
property appears to be duplex. Ma�intaining the duplex use does not require a
rezoning.
I. STAFF RECOh1N1ENDATION: Based on findings 1 through 5, 7, 8, 12-14, and the
staff analysis, staff recorr�nends denial of the rezoning to RM-2.

Dear Mr. Bryan,
This is in regard to the application by Ambrose Gonshorowski to re-zone
� the property at 2033 Randolph Avenue to allow that building to continue
, to. be a tri pl e x.
The District 14 Community Council would like to go on record as being in
support of re-zoning necessary to allow a triplex at that address. The
building has been a triplex since 1973 and has apparently caused no
problem in the neighborhood, probably because of the ample amount of
off-street parking available. The neighborhood is "used to" the building
being a triplex and there is no opposition to re-zoning the property.
The applicant originally appl�ied to re-zone the property to RM-1. However,
he has since been advised that a re-zoning to RM-2 is needed and a new
application and consent petition is now in the process for a re-zoning to
RM-2.
Wh-ilz our council supports re-zoniny so that tt�e trip;ex car� can��i��ue, we
have reservations about RM-� which apparently would allow for a fourth unit
in that building. We wauld prefer instead to see the building re-zoned to
either RM-1 or RT-2 with a density variance. The app7icant has no intention
of creating anothzr unit in that building; hawever, as a community council
w� are concerned about the prospect of another owner being able to do this
at some time in the future.
We hope that the Zoni ng Corr�ni ttee wi 11 recorrrnnnend the re-zoni ng of thi s
prope rty but that the re-zoning will be into a category which wi11 7egalize
the third unit but not allow a fourth.
