THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: _ Section 1. That Section 66.04 of the St. Paul Administrative Code � be and the same is hereby amended to read as follows : � 66.04. Exemptions. In the case of property owned, occupied3 and used by the church for worshi� or religious education or hos ital care� the city shall determine the amount o service charges to be cha.rged or assessed thereon as all other property is being charged or assessed. Such church owned property sha.11 then be exempt from the payment of the service charges so cha.rged or assessed. Such charges shall not be spread or applied against other property. Section 2. This ordinance sha.11 take effect and be in force 30 days from and after its passage, approval, and publication. One of the city councilmen shall be designated as chair- man of the special assistance committee. The city clerk shall be the secretary of said committee.Once appointed,each of the mem- bers of the special assistance committee will serve so long as they hold their respective offices. Basically the committee will receive and either approve or disap- prove applications from senior citizens,widows, and other low in- come families(hardship cases)to qualify for the low 80 cents col- lection rate each week and the subsidy from the city of Saint Paul. The committee will be asked further to develop the criteria,stand- ards, and qualifications of who will qualify for the low collection rate and the subsidy, will prepare the forms and instructions nec- � essary for making application to the special assistance committee, will take the necessary steps to publicize this to all citizens of the city of Saint Paul, and will develop a timetable for the implemen- tation, all of the foregoing to be subject to the approval, prior to implementation,by the city council. (Adopted Ord. 15007,Jan. 4, 1972.) CHAPTER 66.TOWN SQUAftE PARK-MAINTENANCE AND SERVICE CHAR.GES 66.01. Definitions. For the purpose of this chapter the terms herein shall have the meaning ascribed to them as follows: (1) "Town Square"means those city owned public areas,includ- ing but not limited to pedestrian concourses or skyways, bounded by Cedar, Eighth, Minnesota and Sixth Streets, which are used publicly for leisure activity,pedestrian traffic or other public use. (2) "Operation and/or maintenance" rneans all services ren- dered or contracted for by the city in the day to day operation or maintenance of Town Square including but not limited to such services as management fees, cleaning, sweeping, light- ing, heating, repairing, replacing, insuring and policing. (3) "Service charges"means the costs and expenses to be incur- red or incurred by the city in the operation and maintenance ' of Town Square which costs and expenses may be collected against bene�tted property in a manner and amounta as � determined by the city and as provided herein. (1) The council of the city of Saint Paul,having the power to op- erate and maintain public areas defined in Section 66.01(1), may charge and collect all or part of the service charges incur- red therefor pursuant to this chapter. (2) The council each year shall estimate the services and the costs necessary to operate and maintain Town Square under this chapter and the charges to be levied against benefitted proper- ty as provided herein. After these estimates have been made the city council shall fix a date for public hearing,and the city clerk shall cause to be published notice of such hearing in a legal newspaper at least twice no less than one week prior to such public hearing.Not less than ten days before the hearing, notice thereof shall also be mailed to the owner of each parcel within the area proposed to be charged, but failure to give mailed notice or any defects in the notice shall not invalidate the proceedings. For the purpose of giving mailed notice, owners shall be those shown to be such on the records of the county auditor or county tax statements, but other appropri- ate records may be used for this purpose. The notice shall state the date, time and place of such hearing, the particular services to be performed,and the estimate of the costs and ex- penses of such services to be charged against benefitted prop- erty. - (3) At such hearing the council shall hear property owners with reference to the scope and desirability of the proposed services and the method of collection for such services. 66.03. Procedure for collection of service chargea. Any annual service charge levied or imposed under this chapter shall be placed or distributed against property if the city reasonably deems such property has benefitted, under Article X Sec. 1 of the Min- nesota State Constitution, by the continued clean and safe oper- ation and maintenance of Town Square; shall be payable in one single installment but collected in two payments in the same man- ner as real property taxes; and shall be payable when due not- withstanding any appeal as provided in Section 66.05,except that in the event an appealing party is successful on appeal the city shall reimburse the appealing party by the amount reduced or eliminated. With these exceptions, service charges shall be col- lected using the procedures set forth in Minn. Any property owner aggrieved by the city's adoption of the service chargelassessment roll may ap- peal to the district court in the manner set forth in Chapter 14 of ' the St. Paul City Charter. 66.06 Severability. If any one or more of the provisions of this chapter are deemed unlawful for any reason, all other provisions contained herein nevertheless shall remain in full force and effect.
