The petitioner testified at the hearing. At the close of the public hearing, the Committee voted 4 to 2 to recommend denial of the rezoning. On December 16, 1983, the Planning Comnission upheld the Zoning Comnittee's recommendation on a vote of 10 to 7. This rezoning is scheduled to be heard by the City Council on January 19, 1984. ZONING HISTORY: In 1962 Lot 6 and 7 were rezoned to "C" Residential and the �i� ounci granted an appeal to relax the density standards in order to permit an 11-unit building and 11-car parking lot. In 1964 Lots 8 and 9 were rezoned to "C" Residence. An appeal was approved to permit construction of a 22-unit apartment building with 23 off-street parking spaces. G. FINDINGS: 1 . Petitioner is requesting this rezoning in order to retain a twenty-third unit in the building. This unit was converted from the tenants' recreation room and caretaker's work and storage area. 2. When the 22-unit building was constructed, it was 750 sq. ft. short of the 1 ,000 sq. ft. per unit density standard. The lot has since been enlarged by 1 ,200 sq. ft. with the vacation of the alley to the east. 3. With RM-2 zoning, nineteen 1-bedroom units would be permitted. A lot area of 27,600 sq. ft. would be required for twenty-three 1-bedroom units. A lot area variance of 4,780 sq. ft. must therefore be obtained from the Board of Zoning Appeals if the reioning is approved. 4. According to Division of Nousin� and Suild�r�g �ode Enforcemert records, a 1964 inspection discovered the 23rd unit. Petitioner was told to remove the unit at that time. 5. The build�ng's cer±?�:ca�e �f occ��ancy was renewed in i980 for 22 units. In 1983 the certificate of occupancy inspection revealed the 23rd unit. 6. The Housing Policy Plan states that new development should complement existing neighborhood character. For vacant sites in lower density areas, duplexes or triplexes are recomnended. 8. The intent of the RM-2 district is to provide for more extensive areas of multiple family development with access to major thoroughf ares and transit. H. STAFF ANALYSIS: The petitioner received variances to construct this building in T . At t at time, his plans showed 22 units. Had he requested 23 units, he would have needed a greater density variance. The structure is located in a low density residential area, and is legally nonconforming for 22 units. A substantial lot area variance will be required to allow the 23rd unit. While the building is located near I-35E, the only access to the site is from local streets. There appear to be no compelling reasons to rezone the property. I. ZONING HISTORY: In 1962 Lot 6 and 7 were rezoned to "C" Residential and the i y ounc� granted an appeal to relax the density standards in order to permit an 11-unit building and 11-car parking lot. In 1964 Lots 8 and 9 were rezoned to "C" Residence. An appeal was approved to permit construction of a 22-unit apartment building with 23 off-street parking spaces. G. FINDINGS: 1 . Petitioner is requesting this rezoning in order to retain a twenty-third unit in the building. This unit was converted from the tenants' recreation room and caretaker's work and storage area. 2. When the 22-unit building was constructed, it was 750 sq. ft. short of the 1 ,000 sq. ft. per unit density standard. The lot has since been enlarged by 1 ,200 sq. ft. with the vacation of the alley to the east. � 3. With RM-2 zoning, nineteen 1-bedroom units would be permitted. A lot area of 27,600 sq. ft. would be required for twenty-three 1-bedroom units. A lot area variance of 4,780 sq. ft. must therefore be obtained from the Board of Zoning Appeals if the rezoning is approved. 4. A-:cording to Division of Housing and Building Code Enforcement records, a 1964 inspection discovered the 23rd unit. Petitioner was told to remove the unit at that time. 5. The building's certificate of occuaancy was renewed in 1980 for 22 units. In � 1983 the certificate of occupancy inspection revealed the 23rd unit. 6.
