Dear Sir: On September 1 , 1983 the Zoning Corrmittee of the Planning Commission held a public hearing on this rezoning. The petitioner testified and explained his plans. Six people testified in opposition to the B-3 rezoning. The petitioner stated that he would be willing to change his rezoning request to a more restrictive commercial classification. At the close of the public hearing, the Zoning Committee laid the matter over to September 15 so that the applicant could meet with the neighbors. On September 15, 1983 this matter was again considered by the Zoning Comnittee. At that time the petitioner indicated that a rezoning to a B-1 or B-2 would be acceptable but that they still had no specific plans for the site. One of the residents testified that the neighbors would like the property to remain RM-2 but would agree to an OS-1 classification. At the close of this portion of the meeting, the Zoning Committee again laid the matter over to November 3, 1983 to allow time for the applicant to submit a site plan. On November 3, 1983 the matter was once again considered by the Zoning Corr�nittee. At that time a drawing was submitted of a bulding and some parking, and a letter was submitted requesting that the property be rezoned to B-1. There was still no site plan and no tenants firmly lined up. The Corrmittee considered laying the matter over once again but instead voted to recorr�nend denial of the 6-3 zoning. - ' C.F �L/-:�9f . � i 7/�� Zoning File #9431 - Simon Page 2 On November 5, 1983 the Planning Comnission considered the Zoning Committee's recommendation and upheld it on a vote of 13 to 0. After that meeting, representatives for the petitioner requested that the City Council hearing be postponed until a site plan could be developed. In late January, 1984, the applicant submitted a site plan proposing an office and retail building with parking in the front yard that appears to meet the standards of the Zoning Code. While there still appear to be no tenants committed to using the building, the applicant is requesting that the City Council consider the petition to rezone to B-1. This rezoning is scheduled to be heard by the City Council on February 23, 1984. They would not object to aVB-1 or OS-1 because it is a more restricted type of commercial zoning. The residents are concerned that some type of corrmercial will go in that will increase the traffic, litter, noise and add to the congestion in their neighborhood. ZONING HISTORY: The site was zoned corrnnercial prior to 1975, when it was rezoned RM- . G. FIN�INGS: 1 . Petitioners propose re-establishing co�nmercial zoning for this property. They have no specific uses in mind. 2. The Land Use Plan recommends developing specific plans for mixed use strips to ensure development that is compatible with adjacent residential uses. The Plan also supports clustering of corrrnercial uses. 3. An objective of the Housing Policy Plan is to construct at least 10,000 new housing units by 1990. 4. Recommendations in the District 15 Plan are: "Encourage clustering of neighborhood shops and to discourage spotty, mixed land use along major thoroughfares," and "Limit further corr►xnnercial and industrial development to areas presently zoned thus.° 5. The District 15 Housing Development Plan recommends apartments for this site, and statesthat the location may be appropriate for rezoning to RM-3. 6. At RM-2 density, 31 rooms would be permitted on this parcel . The site could � thus accommodate 15 one-bedroom or 10 two-bedroom units. 7. The B-3 district is intended to be located on major traffic arteries or adjacent to Community Business Districts. Snelling is a major thoroughfare (minor arterial level B). 8. Permitted uses in the B-3 district include all permitted and special candition uses of the OS-1 , B-1 , and B-2 districts except community residential facilities and gas stations. In addition, auto repair, mortuaries, contractors shops, and auto sales are permitted. The billboards on the site are presently legally nonconforming, both as to use and spacing. Billboards are permitted in the B-2 and B-3 districts; although the present spacing would still be nonconforming. H. STAFF ANALYSIS: Petitioners wish to re-establish the commercial zoning and then e�termine a proposed use for the site. Snelling Avenue is divided here, with B-3 zoning on the west and multiple family on the east. Rezoning this property would interrupt the solid multiple family face of this block. While it is possible that some kind of commercial or commercial-residential mix might be suitable at this location, B-3 is the least restrictive corr�nercial zoning in the Zaning Code, and would be clearly incompatible with the apartments to the north and south as as well as the singl� f amily uses across the alley. The request for rezoning appears to be speculative, and based largely on the desire ta increase the income potential of the property. I. WHEREAS, Pursuant to Minnesota Statutes §462 .357 and §64. 210 of the Legislative Code, Robert W.
