The petitioner testified. At the close of the public hearing, the Committee determi d at the proposed use was more typical of a craftsman's workshop found in a B-2 zone rat er an typical B-3 zone uses. One a vote of 4 to 1, the Committee approved the rezonin j to -2 based on staff findings and testimony. On May 3, 986, the Planning Commission upheld the Zoning Committee's recommendation on a un im us voice vote. This rez in is scheduled to be heard by the City Council on June 12, 1986. HAROLD N T ON #9907 : Rezone property at 1310 Payne from RM-2 to B-3 to allow a model-ma ing hop to be established. The appli ' nt as present. There was no opposition present at the hearing. Ms. Datsk sh ed slides of the site and reviewed the staff report with a recommendation for approval. ', Ms. Ziema as ed what was meant by models. Ms. Datsk j sta ed the models are prototypes of a product, and that the product would then be manufact ed lsewhere. Mr. Panga �sta d that the District 5 Planning Council submitted a letter in support. Harold K ts , 24 E. Sandralee Drive stated that this property previously had an F-2 commercial rating. H sai that neighbors in the area petitioned to have the zoning changed to RM-2, which limits the ote tial of this property. Ron Moga '899 Burr, stated that the building presently has a legal nonconforming status. Mr. Laneg n ked Mr. Moga if he intends to enlarge the building. Mr. Moga ate that he would like that option. Ms. Ziema as ed Mr. Moga what he does. Mr. Moga ate that he builds prototypes, some are full size and some are miniature. He stated he does prod t d velopment for clients and that he also has some ideas of his own that he wants to patent. - Ms. Ziema as ed if he would have employees working for him. Mr. Moga ate that to start with it would only be himself, but that he may expand over time and hire an of ce erson and maybe a machinist or draftsman. Mr. Tracy ske what types of materials he would work with. Mr. Moga ate it would be mostly metal and plastic. Ms. Tracy I 'ske if he would be doing any casting. Mr. Moga ate he would not do any casting, but that he does have machines that rework plastic. Mr. Laneg n ked if the painting would be similar to painting done in an auto body shop. Mr. Moga s ate it would not be like that: Ms. Tracy ske if the machines that he uses would be noisy. Mr. Moga ate the building is made of concrete blocks. He said the business is variable, and the amount of ois depends on the machine he is using. Ms. Tracy ske if there would be delivery trucks going to his business. Mr. Moga ate there would not. Mr. Knuts st ted that when the building was built it had a good roof put on it and that the building i Isit ted at the far north end of the property, so there is a lot of room to add on. He stated the uil ing is 1,300 sq ft and there is ample room for parking on the property. Hearing n fu her testimony, Mr. Pangal closed the public hearing portion of the meeting. Mr. Laneg , n oved approval of the rezoning from RM-2 to B-3 based on findings 1 through 4 and the st f alysis. Mr. Levy seconded the motion. Ms. Ziema as ed if this use could be in a B-2 zone instead of a B-3 zone. She read the definition of B-2 fro th code. She stated that she would hate tp see a B-3 zoning if it could be in a B-2 zone. Ms. Datsk i not d that Mr. Moga stated he would be manufacturing small components, this is why staff reco 'me ds a B-3 zoning. Ms. Lane s te that if the committee could find this�use is more similar to a workshop it could be in a B-2 z e. he also said the zoning could remain RM-2 and the applicant could apply for a change of on nforming use permit, but then he would not be allowed to expand. Mr. Laneg n ithdrew his previous motion, and moved approval of the rezoning from RM-2 to B- 2 based on, in ings 1-4, the staff analysis, and testimony received. Ms. Zieman seconded the motion. Mr. Segal ad he uses allowed in a B-2 zone from the zoning code. He stated that the present use, an electric 1 c ntracting firm, would be allowed in a B-2 zone. Mr. Knuts n s ted the reason he wants the property rezoned to B-3 is because staff told him this is the zoni g c assification he would need to allow the model-making use. Mr. Knutson stated this property i ; no suitable for most uses that would normally be allowed in a B-3 zone, such as a car wash or f ' t f od restaurant.
