WHEREAS, Pursuant to Minnesota Statutes, . 462.357 and . 64.21 of the Legislative Code, Albert E. Bisciglia and Joseph A. Befort duly pe itioned to rezone 336 and 350 W. He said he has no objection to a boat repair and s rage facility, but is concerned about other uses that may be allowed in an I-1 zoning. He said the smokestacks on the applicant's building are tall, and he d esn't want pollution coming out of the smokestacks, or plastic chemical smells. He said he is an e gineer and inventor and is well aware of the chemical smells that could be produced. Hd said he s a friend of Mr. Befort and has nothing against him expanding his business, but he requests t at the property not be rezoned to allow a refinery, packing plant, or other undesirable use. Philomena Kraft, 334 Cherokee, spoke in opposition. She stated that she has o objection to a boat repair service, but does not want any manufacturing uses which would cause undesirable smells or noise. She said it would destroy the quality of life in the neighborhood abov the bluff. She asked that the committee deny the request for rezoning. Hearing no further testimony, Mr. Pangal closed the public hearing portion o the meeting. The committee discussed the split zone. Mr. Lanegran asked Mr. Befort how he property got its shape. Mr. Befort said he did not know, it was bought that way. Mr. Lanegran asked to see the slides of the site again. Mr. Pangal said that Mr. Befort stated that at one time there were individual ots, he questioned if the lots were joined for tax purposes. Ms. Datsko showed a section map indic ting individual lots had been joined together. Ms. Datsko showed slides of the site, noting that there was no fence indicatin separation of the properties. Mr. Lanegran asked where the smokestacks were located. Ms. Datsko pointed hem out on the slide. Mr. Lanegran moved denial of the rezoning based on the fact that: 1) Mr. Bis 'glia had no definite use in mind, and that a boat repair could be allowed under a special conditio use permit and 2) that the I-1 zoning would be too close to the property above the bluff. Ms. Morton seconded the motion. Ms. Summers asked if Mr. Bisciglia could apply for a special condition use pe mit to operate a boat repair service. Mr. Segal said no, that the use must be permitted in an R-4 zo e. Mr. Pangal said that Mr. Bisciglia cannot apply for a special condition use per it because the property is currently zoned R-4. He said the R-4 zoning is not feasible since omes couldn't be built there anyway. Mr. Lanegran stated that rezoning to a business district would be okay, but n I-1. He said that manufacturing could produce fumes and that pollution from the smokestacks ould go above the bluff. He said an industrial zone is not necessary. Mr. Pangal stated that a business zone would be spot zoning. Ms. Summers asked what industrial uses were located f urther down the street. Mr. Lanegran said a pallet plant and outdoor storage are two current uses.
