THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That Section 113.04 of the Saint Paul Legislative Code is amended to read as follows: 113.04 Orders. Before the department shall abate such nuisance, it shall serve or cause to be served upon the owner or occupant of the abutting property a written order requiring the removal of the snow and/or ice. Such orders shall describe the location of the snow and/or ice to be removed and require removal within three days of the order;-aet-te-ine�nde 6eterday;-6nadey;-er-he�rdeys. Section 2. That Section 113.08 of the Saint Paul Legislative Code is amended to read as follows: 113.08 Penalty. Notwithstanding the above provisions, any owner or occupant who has wtti�ta-a-ene-yeetr-perred been served t�re-er-mere-erders an order to remove a nuisance pursuant to Section 113.04 and has failed to abate the nuisance within the time specified in said erder� order shall be guilty of a petit misdemeanor and may be fined up to a maximum of $100. Providing for tagging after two notices, allows a bad situation to continue for too long. While still requiring one notice insures that no one will be tagged without notice. This is primarily because the limitation preventing ticketing until the second occurrance makes it too difficult.
