of the Saint Paul Legislative Code pertaininq to nuisances.
THE COU IL OF THE CITY OF SAINT PAUL DOES ORDAIN:

Section 1.
That Se tion 45.09 of the St. Paul Leqislative Code is amended to read as follows:

il) . By personal service;
(2) By mail, unless it is a written order which qives three (3) days or

less for the completion of any act it requires; or
(3) If the �n�ended-reeip�er►� appropriate party or h3s address cannot
- be determined after reasonable effort, by posting a copy of the order
in a conspicuous place on the property.
f a mailed order or notice is returned by the United States Postal Service, a
ood faith effort shall be made to determine the correct address, unless ��
he order or notice orders abatement and that abatement has been completed.
Section 2.
This ordinance shall take effect and be in force 30 days after its passage,
appr val, and publication.

When the nuisance ordinance, Chapter 45, was passed in
December of 1986, the preamble indicated the intent to
delete chapter 233 on weeds since the new chapter 45
incorporated all the pertinent regulations on weeds.
However,the section deleting chapter 233 was inadvertently
omitted.
There are two language problems in 45.09, a section which
deals with service of notices and orders. We need to
clarify when posting constitutes proper service. In
addition we wish to remove the ambiguous "it" from the last
sentence.
We have drafted ordinance proposals which will rectify
these problems. They are attached along with the required
green sheets. Please review them for form.
