WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.400 of the Legislative Code, Donald R. PURPOSE : To consider the approval of a Registered Land Survey for property located at the old NSP Island Power Plant . This property is unplatted and the R . L. S . is needed for recording purposes . B . SITE & AREA CONDITIONS : This property is now located in the Floodway, Flood Fringe , Urban Diversified River Corridor Overlay Zoning District . The proposed Floodway 40 Acre Study zoning study recommends that most of the property be in the Flood Fringe District . It is surrounded by the Mississippi River and Shepard Road. There is an existing building on this site that used to be an old power plant . There are scattered trees and underbrush on site . This is a landlock parcel . C . REOUIRED FINDINGS : 1 . All the applicable provisions of the Legislative Code are complied with . 2 . The proposed subdivision will not be detrimental to the present and potential surrounding land uses . The surrounding land uses are heavy industrial . 3 . The area surrounding the subdivision can be planned and developed in coordination and compatibility with the proposed subdivision. The surrounding area is NSP land and is undeveloped. 4 . The subdivision is in conformance with the Comprehensive Plan. The River Corridor Plan proposes open space for the site with adaptive commercial reuse of the existing building . 5 . The subdivision preserves and incorporates the site ' s important existing natural features , whenever possible . No development has been proposed at this time . , 6 . All land intended for building sites can be used safely without endangering the residents by peril from floods , erosion, continuously high water table , severe soil conditions or other menace . This site is in the Mississippi River Corridor Floodway . Any proposed development must meet all River Corridor Overlay Zoning requirements . 7 . The subdivision can be economically served with public facilities and services . This site has no water services at this time . D . At the committee meeting on March 11 , staff presented the packet of information in their hands and then had Mr. Klinger present his plans in detail , including architect ' s drawings . The committee was well satisfied with the thoroughness of Mr . Klingers responses , recognizing that while late, was all in order beyond any doubts . Tt was because of the late notice that the full Board had referred it to committee rather than set a precedent allowing for a change in a strongly participative process .by rul- ing on an item that had not gone through committee review. The committee did review his plans for improving the corner and the traffic flow, along with his intentions for the future . They came to recognize Mr. Klinger' s professionalism and his good intentions to help the community, and acknowledging the trends along Robert Street as a major thoroughfare, then passed unanimously their recommendation to the WSCO Board for approval of the rezoning request . It does not seem likely that an actual shop area as well as office area can be accommodated in a building of this size. A more likely scenario would be that offices for both real estate and contractor's work would be situated in the building. This type of activity could be accommodated in the OS-1 zoning district. Within one block from the parcel are found four other business districts--OS-1, B-1, B-2 and B-3. To the immediate north of the parcel and on the same block are exclusive one and two family residential uses however. To introduce an intensive commercial zone such as B-3 to an exclusive residential block is inappropriate. A rezoning to OS-1 would accommodate the proposed uses and would provide a reasonable transition from the B-3 use located to the south and the residential uses to the north of this parcel. 6. The City's land use component of the Comprehensive Plan states as policy 4.2-1 that "the City will support a diverse commercial activity base by working with business and community groups to. . .continue efforts to encourage small business." We have not been contacted by said petitioner or by Mr. Klinger, who is now occupying said address, concerninq the issue. The building at 735 S. Robert St. is extremely small and we cannot see how it will accomadate said businesses within environmental codes. Also, the porposed 9 car parking lot leaves us concerned as we have two small children. Their safety will be further compromised by traffic on three sides of our lot located at the opposite end of s�id block 144. We feel strongly too, that 'Mr. Klinger has misrepresented the issues involved , and has blantly done his imQrovements without regard to �roper city procedure or to neighborhood attitudes.
