THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section l . That Chapter 45 of the Saint Paul Legislative Code is hereby amended in Section 45. 10(4) by adding the following sentence at the end thereof: "In any case where no owner or responsible party appears at the hearing in the furtherance of the appeal and the enforcement officer advises the council that the nuisance has been abated in its entirety, then the council may strike the appeal with the matter being regarded as closed and no further action need be taken. " Section 2. That this ordinance will take effect and be in force thirty (30) days after its passage, approval and publication. As we understood it , you wanted to eliminate the preparation of a resolution and resulting time lag in those situations where the owner does not appeal at the hearing on the abatement order and further, the enforcing officer advises that the nuisance has been abated. The language in the amendment should provide the degree of finality in the above situations that you desire .
