THE COUNCIL OF THE CITY OF ST. PAUL OES ORDAIN:
Sec ion 1.
That Section 29.01 of the St. P ul Legislative Code be and that same is
hereby amended to read as follows:
"Section 29.01. Prohibition. t shall be unlawful for any person to
use city property for a politic 1, personal, family or household
purpose."
Sec ion 2.
This ordinance shall take effec and be in force thirty (30) days fram
and after its passage, approval and ublication.

I have reviewed the above-re erenced amendment and my correspon-
dence with the Legislation ommittee during April of 1987 . My
assessment of this provisio has not changed since then. I
believe that in its present form it is unconstitutionally vague
in that it does not provide lear, adequate notice of the conduct
� prohibited, and is unconsti utionally overbroad. For example ,
�Elv � � under the section as prese tly written, a city employee could
.��'--^ not use a city telephone to make or receive a personal call or
����,�.b�city pencil and paper to w ite a reminder note to oneself of
��� ;� a personal nature.

8. ORDINANCE 4�88-623 - Amending Chapt r 24 of the Administrative Code
pertaining to a code of ethics for city officials and employees by
redefining public officials, by pr hibiting gifts to family members and
employees of public officials, by efining conflict of interest, by
requiring public officials and cit employees to report corruption,
defining the process for such repo ts, and by providing for requests to
the Ethical Practices Board for a advisory opinion. (Referred to R & P
