THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That section 66.107 of the Saint Paul Legislative Code be amended so as to add the following new definition thereto: Electronic message sign. A sign which allows for periodic changes in copy or symbols by electronic means. Section Z. That section 66.108 of the Saint Paul Legislative Code be amended so as to add the following new definition thereto: Flashing sign. An illuminated sign on which the illumination is not kept stationary or constant in intensity or color at all times when the sign is in use. An electronic message sign is not considered a flashing sign. Section 3. That section 66.111 of the Saint Paul Legislative Code be amended so as to add the following new definition thereto: Illuminated sign. That section 66. 118 of the Saint Paul Legislative Code be amended so as to add the following new definition thereto : Parkway. A street designated as a parkway by chapter 145 of this Code and also Interstate Highway I-35E between West Seventh Street and Interstate Highway I-94. Section 5. That the definition of "Portable Sign" contained in section 66 . 118 of the Saint Paul Legislative Code be amended so as to read as follows : Portable sign. A sign which is attached to a chassis with wheels or skids or to a metal or wood frame, which is not permanently mounted into the ground, and which is used as a temporary outdoor sign. Section 6. That section 66. 120 of the Saint Paul Legislative Code be amended so as to add the following new definition thereto : Right-of-way. The publicly owned land on which medians , roadways, shoulders , slopes , frontage roads , boulevards , sidewalks , or on and off ramps are located. Section 7 . That section 66 . 201 (6) of the Saint Paul Legislative Code is hereby amended to read as follows : (6) All signs with the display surfaces back-to-back and parallel shall have no more than an eight-foot distance between each surface; . All signs with the display surfaces at an angle to one another shall have the angle no greater than 35 degrees . Display surfaces shall face in opposite directions and shall be owned by the same permittee. 2 . �� ��. .. . . , , , � , � �7�3 G Section 8 . That section 66. 201 (10) of the Saint Paul Legislative Code be amended to read as follows : (10) For parking lot areas , one identification sign not to exceed a total of fifteen ( 15) square feet in area is permitted per parking lot entrance. An identification sign up to twenty-five (25) square feet in area, however, may be permitted if such sign incorporates the following uniform parking symbol : fifty ( 50) percent of the total sign area of the parking identification sign must bear thereon a blue rectangle with a white letter "P" in Gothic type face with the letter "P" being not less than fifty (50) percent of the area of the blue rectangle. The remaining portion of the sign incorporating such a parking symbol may be used for other pertinent infor- mation. In addition to the one identification sign per parking lot entrance , however , one directional sign not to exceed a total of four (4) square feet is permitted per entrance or exit. Such directional signs may be up to ten (10) square feet in area if they also incorpor- ate the above-prescribed parking symbol . These parking identification and directional signs are in addition to other signs permitted in each zoning district . No sign shall project higher than 15 feet above grade. Section 9. That section 66. 201 (11 ) and (12) of the Saint Paul Legis- lative Code be amended to read as follows : (11 ) Illuminated signs are permitted, except that flashing signs are prohibited. (12) Except in heritage preservation districts and special sign districts which prohibit adver- tising signs , advertising signs on benches and bus shelters shall be permitted at bus stops designated by the Metropolitan Transit Com- mission in all zoning districts and shall be exempt from prohibitions of advertising signs from residential , commercial , or industrial 3. . .. , , , , � � ��'-°�� J; �7,�'3 � zoning districts . On benches , one advertising sign not to exceed 15 square feet shall be per- mitted. On bus shelters , the advertising shall be on one end panel , shall be limited to one-third of the vertical surface of the shelter, may be placed on one or both sides of a panel , and shall not exceed four feet by six feet. Advertising signs on benches and bus shelters shall be permitted to be located within the public right-of-way, shall not be placed within 150 feet of a park or parkway, and shall be exempt from regulations requiring a minimum distance between advertising signs . Section 10. That section 66.201 of the 5aint Paul Legislative Code is hereby amended so as to add the following new provision thereto : (14) Only one side of a double faced sign or V shaped sign shall be used to compute the gross surface display area, display surface area, or sign area of a sign. Section 11 . That section 66.204, subdivision a (Identification Signs) of the Saint Paul Legislative Code is hereby amended so as to add the following new clause thereto: ,�, No sign shall project higher than 30 feet above grade. Section 15. That section 66.204, subdivision b (Temporary Signs) of the Saint Paul Legislative Code is hereby amended so as to add the following new clauses thereto: (5) For parks, community centers, and religious, educational, civic or philanthropic institutions, portable signs and temporary signs are permitted for special events under the following conditions: (a) Portable Signs. (1) on zoning lots with a street frontage of 330 feet or less, the gross surface display area of the signs shall not exceed 100 square feet. On zoning lots with a street frontage of over 330 feet, the gross surface display area of the signs shall not exceed 300 square feet; (2) the signs shall be permitted two non-consecutive times per calendar year for a period of not more than 14 days per time; (3) the signs shall not be flashing signs or located in a required yard, required off-street parking space or maneuvering area, or public right-of-way. (b) Temporary Signs. This section 66.204(5)(b) shall expire on February 1, 1989. (1) the gross surface display area of the signs shall not exceed 100 square feet; (2) the signs shall be permitted for periods of not more than 14 days per time; (3) the signs shall not be flashing signs or located in a required off-street parking space or maneuvering area, or public right-of-way. That section 66. 205 , subdivision a (Business Signs) of the Saint Paul Legislative Code is hereby amended so as to add the following new clause thereto: ( 3) No sign shall project higher than 37-1/2 feet above grade , except wall signs and pole signs on zoning lots abutting principal and intermediate arterials. Wall signs may project to the height allowed by the height restriction in the zoning code . On zoning lots which abut a principal or intermediate arterial , one pole sign may project to 37-1/2 feet above the surface of the arterial . Section 17 . That section 66.205 , subdivision b (Temporary Signs) of the Saint Paul Legislative Code is hereby amended to read as follows : (4) Temporary signs shall be permitted as follows : a. Banners , pennants and stringers. b. That section 66. 205 of the Saint Paul Legislative Code is hereby amended so as to add the following new subdivision thereto: (c ) Portable Signs. Portable signs are permitted under the following conditions : (1 ) on zoning lots with a street frontage of 330 feet or less , the gross surface display area of the signs shall not exceed 36 square feet. That section 66.207 of the Saint Paul Legislative Code is hereby repealed in its entirety and the following adopted in place thereof: Sec . 66. 207. B-4 Business District. (a) Business signs . Portable signs are permitted and subject to the conditions specified in the OS-1 and B-1 districts , section 66 .205 , subd. c . Section 28 . That section 66 . 214 of the Saint Paul Legislative Code is hereby repealed in its entirety and the following adopted in place thereof: Sec . 66. 214. Advertising Signs . (a) Permitted in district. Advertising signs shall be permitted in B-2, B-3 , I-1 , I-2 , and I-3 districts. In B-5 districts , advertising signs shall be permitted within 660 feet of the right-of-way of the Lafayette Freeway and Interstate Highway 94 between the Lafayette Freeway and Robert Street. (b) Area, spacing, height. The gross surface display area, spacing, and height of advertising signs shall be regulated according to the functional classification of the street along which the signs are placed, as shown in Table 1 , below. 14. . . . , . Land within a River Corridor advertising control segment 1 shall not be counted in the measurements of depth and width above. (c) Functional Classification. The functional classification of streets shall be shown on the map entitled "Functional Street Classification" which accompanies this chapter and which is incorporated into this chapter and made a part thereof. (d) Spacing. The spacing between signs shall apply to advertising signs on the same side of the same street. (e) Extensions, Cutouts, or Top Lettering. Any rectangular advertising sign may contain extensions, cutouts, or top lettering which occupy a total area not in excess of 25 percent of the area of the basic advertising sign and form an integral part of the design thereof, and provided further that no such extension, cutout, or top lettering may project more than six feet from the top, 18 inches from either side, or 15 inches from the bottom of the basic rectangular advertising message. (f) Measurement of Spacing. The spacing between signs shall be measured by projecting the nearest points of the signs to the property line of the right-of-way from which they are intended to be read and measuring the distance in a straight line between the projected points . The determi- nation of whether an advertising sign is intended to be read from a roadway should be based upon, but not limited to, the following factors : the angle of the sign to the roadway, the duration of the view from the roadway, the distance the sign is from the roadway, the size of the sign relative to the classification of the roadway, and any obstructions to the view from the roadway. (g) Height. The height of advertising signs may be measured from grade or surface of the roadway, which- ever is higher. (h) Roof Signs. No advertising sign shall be permitted to be constructed on a roof top or to overhang a roof, except signs permitted to be relocated as regulated in Section 66. 302. (i ) River Corridor , Advertising Sign Control 5egments. There are hereby created advertising sign control segments 1 and 2 shown on the official map which accompanies this chapter and which is incorporated into this chapter and made a part hereof. Advertising signs shall be prohibited within advertising device control segment l . Advertising signs may be erected or maintained within advertising sign control segment 2 provided they meet the following requirements : (1 ) The parcel on which it is proposed to erect or maintain the sign is otherwise zoned for such use. 16. . � . , . . , , , , ����� �7�3� (2) All other provisions of this chapter or any other provision of law regarding spacing, size illumi- nation, construction or other features are complied with. ( j ) Heritage Preservation Districts . Advertising signs shall be prohibited from all historic preservation sites or districts designated by the City Council . (k) Signs Next to Residential Districts , Parks , Parkways , Schools . No advertising sign shall be placed within 75 lineal feet, as measured along the road, of a residential district ; within 300 feet of a park which is over 2 acres in area; within 150 feet of a parkway except along Lexington Parkway between the alley north of University Avenue and the northerly right-of-way of I-94, and between the alley south of Larpenteur Avenue and Larpenteur Avenue, and that portion of Ford Parkway between Prior Avenue vacated and the Mississippi River Boulevard; or within 75 lineal feet, as measured along the road, of a church or public , parochial , and other private elementary, junior high, or high school offering courses in general education, and not operated for profit. Provided that in no case shall a sign be located closer than 50 feet to a residential district. (1 ) Obstruction. Advertising signs may not be located in such a manner as to obscure or otherwise interfere with the effectiveness of an official traffic sign, signal , or device, or obstruct or interfere with the driver ' s view of approaching, merging, or intersecting traffic . Section 29. That sections 66. 215 (Heritage Preservation Districts) and 66 . 217 (Advertising signs along advanced speed arteries) are hereby repealed in their entirety. Section 30. Any adver- tising sign existing as of the date of this ordinance amendment which is located in a zoning district which does not permit advertising signs or which does not conform to the size , height and/or spacing requirements of this Chapter may be replaced, relocated, or renovated in the manner provided in this section; provided, how- ever, that such activity shall bring the sign into greater compliance with the provisions of this Chapter and satisfy the following standards : (a) Advertising signs to be replaced, relocated, or renovated on the same zoning lot: (1 ) The zoning lot must be within a zoning district in which advertising signs are a permitted use , as specified in Section 66.214, subd. a or i , or as permitted in a Special Sign District approved by the City Council ; and (2) The advertising sign must be brought into conform- ance with the size and height requirements as set forth in Section 66 . 214, subd. b ; and ( 3) The gross surface display area of the advertising sign shall not be made larger nor shall the height of the advertising sign be made higher than was the previously existing nonconforming sign; and (4) The advertising sign may be relocated or replaced within the original zoning lot and the spacing requirements of Section 66.214, Subd. b and k shall not apply thereto, provided, however, that the sign may not be placed within 150 feet from the I-35E Parkway right-of-way; and ( 5) An advertising sign which is less than 400 square feet in area may be located on a roof top, and all advertising signs may overhang a roof; and 18 . , • . � ���. '. -�d2 /7s3� (6) If the advertising sign is not replaced or rebuilt within 12 calendar months of removal of the sign, then the sign may not be replaced or rebuilt on the same lot , provided that Subdivision b, Clause 6 , nonconforming sign area credits , shall be applicable to the sign area not replaced or rebuilt; and (7) Any net reduction in total advertising sign face area resulting from the rebuilding or relocating of an advertising sign on the same zoning lot shall not qualify for nonconforming sign face credits as provided in subdivision b (6) of this section. (b) 1Vonconforming sign face credits may be reserved and used to build other advertising signs on zoning lots other than the original zoning lot, provided, that the credits are used by the owner thereof within 5 years of the removal of the original conconforming sign. (c) All signs rebuilt with nonconforming sign face credits shall comply with the size and height requirements of section 66. 214, subd. b, and the spacing requirements from residential districts , parks , parkways and schools in section 66. 214, subd. k, but need comply with only two-thirds (2/3) of the spacing distance requirements in section 66.214, subd. b. We have borrowed in excess of $120,000 dollars and invested every dime into the local economy . We buy all of our equipment materials and supplies from St . Paul business ' s and we hire residents to help us with our sales , production, and construction . Each summer we employ 7 or more young college students for daily work . For the past 3 years we have donated poster space (at no cost) to the following St . Paul non profit organizations : St . Paul Chambor of Commerce Salvation Army Air National Guard Local Army Recruiters Payne-Arcade Small Business Assoc . Highland Business Assoc . Grand Ave Business Assoc . YMCA Association of Retarted Citizens Reach Out Program Trailways Runaway Youth Program and we are sending a copy of our counter proposal to other small bus- inessmen and non profit organizations , asking for their support in persuading the city to reconsider the proposed ordinance , thereby allowing Midwest Outdoor to remain in business in St . Paul . Peter Remes , ownerand operator of Midwest 0utdoor , was born in St . Paul in 1959 . He grew up in the Highland Park area , attending Hoarce Mann Elementary School , Highland Park Jr . and Sr . High and graduated from the University of Minnesota . Money to begin Midwest Outdoor was borrowed from St . Paul banks and private lenders . At present Midwest Outdoor has S1 St . Paul customers using our 40 Jr . Poster boards at an average of $6 ,000 per month gross billing . Our C . P . A. has informed us that our break even point is 100 structures generating at least $14 ,000 gross billing . The Great American Dream is to own your own business , prosper and then retire . I have this dream , but if the city approves the proposed ordinance as is , my dream will be shattered . By proposing this strict ordinance the city through its planning commission will have prohibited any future growth for Jr . Posters within the city limits . The following will site examples of this bold statement : , , Sometime during, June 1986 , Naegele has bought out Far-Vue Outdoor Advertising for many millions of dollars . Given Naegele ' s current 500+ locations in St . Paul (over 3500 in the metro area ) and given the 100+ locations acquired from Far-Vue (all of which will become grandfatherd in) and given the spacing suggested in the proposed ordinance , Midwest will not be able to expand and would have to shut down . If the reason for the proposed ordinance is to prevent other out- door advertising companies from entering the local market , then you will have succeeded . You will have permitted a huge national company, located in Augusta Georgia , to control 99% of the local outdoor ad- vertising market at the expense of small locally owned companies such as Midwest . To support this staement we will demonstrate on a 4 ft . map of St . Paul , using IIniyersity_ Ave . as the example . You will note that iri � this 50 � block - stretch from downtown St . Paul to the city limits of Minneapolis , that Naegele has 58 12 x 24 (300 Sq . ft . ) signs , and 16 14 x 48 ( 672 sq . ft . ) signs . This is 74 locations or more then 1 location per city block . You will also note that Midwest has only 8 Jr . Posters in the same 50 block stretch. Given the suggested spacing in the proposed ordinance , no one else will ever be able to locate on University Ave . Under the spacing requirements of the present ordinance , there are 5 locations still available on University Ave . If we could secure these 5 locations , we would have a total of 13 locations on University Ave . On Snelling , Randolph, and West-7th„ we currently have 1 Jr . Poster on each of these arterials , with no additional leaseable locations left available . Under the current ordinance we could add approx . 40 more Jr . Posters on other major arterials such as White Bear Av; Rice St , Minnehaha , and Dale . Under the proposed ordinance no more then 4 locations are available and then subject to obtaining a lease . Your continuing efforts to pass the proposed sign ordinance are unnecessary (because 99+ % of the locations will be grandfathered in) and unfair ( because companies like Naegele or other wealthy national or international corporations are able to purchase the competition , thereby obtaining all sign locations both permitted and grandfathered) . For temporary portable signs, the Commission recommends that the regulation permitting portable signs to be used four times a year for a period of not more than 14 days per time should apply to the zoning lot rather than to the businesses on the lot. This will reduce the potential clutter of portable signs in business areas. For instance, on a zoning lot with 10 businesses in a building, a portable sign would be permitted to be used four times during a year. It would prohibit each of the 10 businesses from using a portable sign four times a year, or 40 times a year for all of the businesses on the lot. For electronic message signs, the Commission recommends that the signs not be permitted in B-2 districts. The Commission believes that permitting the signs in the B-2 district will allow them in too large an area, since the B-2 district is the most common business zone in neighborhoods. Attached are five additional amendments to the proposed ordinance. The City Council requested that amendments 1 through 4 be drawn up at its November 12, 1987 meeting. Planning staff is proposing Amendment 5. Underlined language in the attached amendments show the changes to the proposed ordinance. �r Amendment 1. This will permit temporary and portable signs to be placed on church, school, and park property in residential areas twice a year for 14 day periods. This is in response to the Council's concern about portable signs in parks. r Amendment 2. This will restrict the use of portable signs on a zoning lot to four times a year for all of the businesses on the lot. The Planning Commission has recommended this amendment. �� Amendment 3. This will prohibit electronic message signs from the B-2, Community Business Districts. The Planning Commission also has recommended this amendment. � Amendment 4. This will not permit the 700 square foot signs to be built along non-freeway state and federal highways which run through large commercial and industrial areas. � }-,, Amendment 5. This will Qermit the 700 square foot signs to be built along `�non-freeway state and federal highways which run through large commercial and industrial areas. To ensure that the signs are built only in the largest commercial and industrial areas, the area must be at least 1,320 feet wide, as well as 660 feet deep, before a sign can be built within it. The minimwn spacing between signs also has been increased from 660 feet to 1,000 feet. This is the same minimum spacing as is proposed along freeways. On zoning lots with a street frontage of over 30 feet, the gross surface display area of the signs shall not exceed 300 square feet; (b) the signs shall be permitted two non-consecutive times ver calendar year for a period of not more than 14 days per time; (c) the signs shall not be flashing signs or located in a required yard, required off-street parking space or maneuvering area, or public right-of-way. Reichert r y�— Roger Ryan RE: Zoning Code Sign Amendments This memorandum provides a summary of the revisions staff recomtnends to the proposed Zoning Code Sign Amendments. Planning staff has been working on these further revisions since the City Council's committee review in April of the Planning Commission's proposal. At that time, the Council raised questions about code provisions affecting outdoor advertising signs, electronic message signs, and portable signs. With all three types of signs, staff has researched and analyzed the issues further. In the case of outdoor advertising signs, we have had extensive discussions with industry representatives to learn more about their concerns with the proposed regulations and to explain to them more clearly the nature of our concerns with the impact of existing billboards under the current ordinance in both the downtown and neighborhoods. Based on this further analysis and discussion, staff has further refined the proposed ordinance amendments. We believe that these revisions are generally consistent with and supportive of the Planning Commission's basic objectives incorporated in the original proposal: to promote a system of advertising signs that is compatible with the character and scale of our city, both in our neighborhoods and in the downtown. With respect to billboards, only minor revisions have been suggested to the Planning Commission proposals affecting permitted districts, parkways, and the size, spacing, and height. Size and spacing requirements have been related even more strongly to the type of street and the character of adjacent commercial development. Freeway scale billboards will now be prohibited on virtually all neighborhood commercial streets. Another new provision will prohibit construction of most billboards on roof tops or to overhang roof tops. This provision has been added to promote further the goal of appropriate scale. Mayor George Latimer September 3, 1987 Page 2 The major revision to the ordinance affecting billboards relates to existing signs that will become nonconforming under the new ordinance. The "move to conformance" provisions have been carefully drafted to promote in effect a quality "build down" of the outdoor advertising signs throughout the city. The industry can continue to upgrade its product, but to locate signs in locations and scale consistent with the character of Saint Paul. As such, it is important to note that no existing nonconforming signs may be rebuilt or relocated in prohibited areas: residential districts, downtown (except a portion of the North Quadrant) , historic districts, and special sign districts (Highland, Grand Avenue, and Smith Avenue) . With respect to temporary portable signs, staff recommends that we adopt stricter regulations to govern their use and location rather than simply prohibit them altogether. Given the extensive, albeit intrusive, use of temporary signs by small businesses throughout the city, we believe a total prohibition would be unacceptable. Stricter regulation--so that, for example, temporary signs are not placed on public streets, driveways, and sidewalks--is demanded by neighborhood groups and supported by the sign industry. With respect to electronic message si�ns, staff recommends that they be permitted throughout the city rather than just in the downtown as they are now. There will be spacing requirements and restrictions on the modes of displaying the sign's messages, however, to ensure that the signs will be compatable with the city's neighborhoods. Following is a summary, point by point, of the proposed advertising sign amendments as refined by staff over the past three months. The specific proposed amendments, in ordinance form, are attached. Outdoor Advertising Signs 1. Permitted Districts . Permitted only in B-2, B-3, I-1, I-2, I-3 Districts . Prohibited in B-4 and B-5 downtown districts, except a portion of the North Quadrant--within 660 feet of Lafayette Highway and I-94 between Lafayette and Robert Street . Prohibited in all Historic Preservation Districts . May continue to be prohibited in Special Sign Districts if so prohibited in the special ordinance (i.e. , Highland, Grand Avenue, Smith Avenue) Mayor George Latimer September 3, 1987 Page 3 2. Signs next to residential districts, parks, parkways, schools . Prohibits advertising signs within 75 feet of residential districts, 300 feet of parks over 2 acres, 75 feet of churches and public schools . Prohibits advertising signs within 150 feet of parkways except along three commercial areas: 1) Lexington Parkway between I-94 and the alley north of University Avenue; 2) Lexington between Larpenteur and the alley south of Larpenteur; and 3) Ford Parkway between vacated Prior Avenue and Mississippi River Boulevard Note: Advertising signs along Ford Parkway are prohibited by the Special Sign District for Highland. Staff believes that the special sign ordinance should continue to be the vehicle to regulate signs on Ford Parkway rather than the overall city ordinance. 3. Area, Spacing, Height Regulations . Size and spacing of advertising signs will vary according to functional classification of street . No advertising signs will be permitted along local residential streets . Large signs (700 square feet) will be permitted along intermediate and principal arterials (i.e. , I-94, Lafayette Freeway) but only on minor arterial state and federal highways where the industrial or commercial zoning extends at least 660 feet (2 blocks) in depth back from the roadway. For example, large signs will be prohibited along almost all of University Avenue except for the industrial area south of University and west of Prior. Large billboards at University and Snelling, Lexington, Dale, etc. will be prohibited. . Only the very small (100 square feet) signs will be allowed on collector streets (i.e. , Saint Clair, East Third, Payne) . Medium sized signs (300 square feet) will be permitted at a few high traffic (15,000 trips per day) intersections of two collector streets (i.e. , Fairview and Saint Clair) . Height of all advertising signs will be limited to 37-1/2 feet . Spacing along freeways and principal/intermediate arterials will be increased from 660 feet to 1000 feet . Spacing of inedium sized signs along neighborhood commercial streets (minor arterials) will be increased from 100 feet to 660 feet (one block) . Spacing of small signs along collector streets will be 200 feet 4. Roof Top Signs . Measurement of Spacing The method of ineasuring the spacing between signs has been made more precise and guidelines are given to determine when a sign is intended to be read from a roadway. 6. Nonconforming Signs The most significant revision to the proposed ordinance affects existing signs which do not conform to the new ordinance provisions. The proposed revisions would allow an existing nonconforming sign to be rebuilt if it is "brought into greater conformance" with the new ordinance. "Greater conformance" is strictly specified and intended to insure that over time, there will be fewer, smaller, lower, and further spaced advertising signs in the city. Essentially, the "move to conformance" provisions will require that any existing sign can only be rebuilt or relocated in a permitted district, and at the permitted height and size. The basic "forgiveness" afforded to the rebuilding or relocating of a nonconforming sign involves relaxation of the full new spacing requirement. A nonconforming sign rebuilt on the same lot need not meet the new spacing requirement. A nonconforming sign moved to a new location must meet two-thirds of the new spacing requirement, but even this will be a significant increase in spacing from that required in the current ordinance along neighborhood commercial streets. Temporary Portable Signs Permitted in business and industrial districts . restricting the length of time the signs can be used to four 14 day periods a year . requiring the signs to have a permit and the installers to be licensed . prohibiting the signs from sidewalks, driveways, parking spaces, and required yards. Temporary Signs For Special Events In Residential Districts Temporary signs for special events, such as a pancake breakfast, will now be permitted at churches, schools, and parks in residential districts. The signs, up to 300 square feet in area on large lots, may be displayed for 30 days, once a year. ' Mayor George Latimer September 3, 1987 Page 5 Electronic Message Signs . Electronic message signs will be permitted in B-2, B-3, B-4, B-5, I-1, I-2, and I-3 districts. . The signs must be 660 feet from any other electronic message sign. . The signs must be 75 feet, measured along the road, and 50 feet, measured radially, from a residential district. Any rectangular advertising sign may contain extensions, cutouts, or top lettering which occupy a total area not in excess of 3A �5 percent of the area of the basic advertising sign and form an integral part of the design thereof, and provided further that no such extension, cutout, or top lettering may pro�ect more than 6 feet from the top, 18 inches from either side, or 15 inches from the bottom of the basic rectangular advertising message. The area of an extension, 10 ' . � cutout, or top lettering shall be deemed to be the area of the smallest rectangle into which such extension, cutout, or top lettering will fit. SUBD. 6 MEASUREMENT OF SPACING The spacin� between signs shall be measured by p�jecting the nearest voints of the si�ns to the property line of the right of way from which they are intended to be read and measuring the distance in a straight line between the proj ected points. The determination of whether an advertising sign is intended to be read from a roadwav should be based upon, but not limited to. the followin� factors: the ang,le of the sign to the roadwa,y, the duration of the view from the roadway, the distance the sign is from the roadway. the size of the sign relative to the classification of the roadway. and any obstructions to the view from the roadwav. SUBD. 7. HEIGHT. The height of advertising signs may be measured from grade or surface of the roadwav. whichever is higher. SUBD. 8. ROOF SIGNS.
