Referred To Committee: Date An ordinance amending Chapter 60 of the Saint Paul Legislative Code pertaining to zoning for the City of Saint Paul and the zoning maps thereof. Whereas, Pursuant to Minnesota Statutes, §462.357 and §64.400 of the I.egislative Code, Elzena Wiley/Amoco Oil Company duly petitioned to rezone 384 Lexington Parkway North (east �ide between Saint Anthony and Fuller), being legally described as Lot 4, Block 2, American Building Company Plat #3 from RM-2 to B-3 for the purpose of development which will expand an existing gasoline service station, the petition having been certified by the Planning Division on September 5, 1990 as having been consented to by at least two-thirds of the owners of the area of the property ta be rezoned, and further having been consented to by at least 67% of the owners of the property situated within 100 feet of the total contiguous property within one year preceding the date of the petition; and Whereas, The Zoning Committee of the Planning Commission on October 11, 1990, held a public hearing for the purpose of considering the rezoning petition, and pursuant to §107.03 of the Administrative Code, submitted its recommendation to the Planning Commission that the petition be granted; and Whereas, The Planning Commission considered the rezoning petition at its meeting held on October 19, 1990 and recommended that the City Council approve the petition; and Whereas, Notice of public hearing before the City Council on the said rezoning petition was duly published in the official newspaper of the City, and notices were duly mailed to each owner of affected property and property situated wholly or partly within 350 feet of the property sought to be rezoned; and Whereas, A public hearing before the City Council having been conducted on November 1, 1990, where all interested parties were heard, the Council having considered all the facts and recommendations concerning the petition; now therefore THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 That the zoning map of the City of Saint Paul, Sheet Number 19, as incorporated by reference in §60.301 of the Saint Paul I�egislative Code, as amended, is hereby further amended as follows: 0 ��I G,I���l A L: - . The applicant wa�s present. One person spoke in support. One spoke in opposition. Mr. McGuire show�d slides of the site and reviewed the staff report with a recommendation tp approve rezoning of the property from R"i-2 to B-3 to expand development of t�e existing gasoline service station. Mr. Peter Bachma�, 150 South Sth Street, Minneapolis, attorney for the applicant, addre�sed the committee. He discussed their meetings with area committees: Aurpra/Saint Anthony Area Block Club and District 8 Community Issues Committee, from which they received unanimous approval for the proposal. District 8's Board of Directors made their approval contingent on two conditions: 1) that Amoco work with neighborhood organizations in an effort to reloca�e the apartment building, and 2) that Amoco relocate or move the fence more t�an four feet away and plant some large� fast-growing trees. Mr. Kris Kristof�k, 5001 West 80th Street, Suite 890, Minneapolis, Amoco Business De�velopment Representative, addressed the committee. He said that Amoco is wi�ling; to cooperate with the City in any way in order to get on with this project. Mr. Ronald �auli�e, President of the Aurora/Saint Anthony Area Block Club, Inc. , spoke' in s�pport of the request. Mr. Joseph Shasic�, Central Avenue West� spoke in opposition representing Mr. Joseph Sandhoffe�. The concerns raised were inadequate time for Mr. Sandhoffer to deyelop an opposition statement, the fuel tanks and outside storage due to a �lzoning violation, and the vacancy of the property immediately to the north of t�he Amoco property because of contractual agreements between Amoco and owner of building which is in contradiction of the District 8 plan which states tha� housing is the single most important issue in District 8. He suggests that traffic safety will be in jeopardy because of the addition of this business ac�ivity at this site. The last concern is economical loss to �� ����� File #90-207 Zoning Committee ;Seeting October 11, 1990 Page two Mr. Sandhoffer, s nce this is Mr. Sandhoffer's only source of income. He suggested that an�ther possibility be considered: the vacant school to th� east of the prope�ty. The numbeZ one concern, in Mr. Shasky's opinion, was Mr. Sandhoffer's $nability to obtain the zoning file regarding this case. He contends that Mr. ISandhoffer was denied access to the site plan until late Saturday afternoo�t when he received it in the mail and that he has been unable to talk to anyone regarding this issue. Mr. Sandhoffer requests a 30-day postponement of aidecision until such time as all concerns can be addressed by himself and a11 concerned neighbors as well as the problems of housing to the housing autho�ities and traffic to the traffic authorities. Ms. Hirte asked tt�at Mr. McGuire comment on the procedure following the committee's recomc�endation today. Mr. McGuire explai�ned the zoning process following committee action. In addition, he addr ssed some of the accusations that were directed at staff by Mr. Shask3► rep�esenting Mr. Sandhoffer. _ Mr. Bachman resporlded with a brief rebuttal. He stated that several attempts had been made to qontact and meet with :�r. Sandhoffer, however Mr. Sandhoffer chose to ignore th�ese requests. He also denied the accusation that the apart- ment building waslvacant due to a contractual agreement. The traffic issue was of no co�cern ''to the City in the site plan review. � Public hearing wasj closed. Mr. Kajer made a �dotion based on staff findings and recommendations to approve the rezoning of th�e property which was seconded by Ms. Hirte and passed on a unanimous voice vdte.
