9 Chapter 376 of he Legislative Code is hereby amended so as to add the following
10 thereto:
11
12 Sec. 376.16. Taxicab driver's license.
13
14 (a) License r Effective March 15, 1991, no person shall drive a taxicab, nor
15 shall any owner or lessee of a ta�cicab allow any other person to drive a taxicab, within
16 the city of Sain Paul, unless that person has first obtained a taxicab driver's license
17 under the provi ions of this Code.

19 (b) Drivers fro other cities. Any driver licensed to operate a taxicab in another city
20 may carry pass gers from that city to any place within the city of Saint Paul and may
21 freely enter an travel upon the streets for that purpose. In that case it shall not be
22 deemed necess ry for the taxicab driver to obtain a Saint Paul license but the driver
23 shall not be pe 'tted to accept or offer any passenger for hire in the city of Saint Paul,
24 or otherwise op rate a taxicab within the city without first obtaining a license under the
25 provisions of th s Code. While within the city of Saint Paul the taxicab driver shall be
26 required to obs rve all of the applicable regulations and conditions of this section and
27 shall have in p ssession and display to any person upon demand the license certificate
28 for the taxicab.

30 (c) License ap lication Every applicant for a taxicab driver's license shall file an
31 application wit the License Division. The application shall be made on a form
32 provided by sai division, containing such information as the license inspector may
33 require, includi g but not limited to a complete employment history, to verify that the
34 terms and cond tions of this chapter have been met. The application shall be signed and
35 sworn to by the applicant. Prior to the issuance of the license, every licensee sha11 be
36 photographed. e chief of police or his representative shall investigate each applicant
37 and shall forwa d the results of the application to the license inspector. Any false
38 statement on t application shall be grounds for denial, refusal to renew, or revocation
39 of a license. To receive a taxicab driver's license by March 15, 1991, the applicant must
40 in addition to eeting the other requirements of law file the application with the
41 division by Nov mber 15, 1990, for drivers whose last names begin with the letters A

2 the letters G t ough and including L; January 15, 1991, for drivers whose last names

4 last names begi with the letter S through and including the letter Z.

6 (d) L�e f+� Each applicant for a taxicab driver's license shall, at the initial time of
7 filing his or her application, pay a nonrefundable license fee of twenty-five dollars
8 ($25.00).

10 (e) Prerequisit to license. Eligibility to be licensed to operate a taxicab sha11 be as
11 follows:

13 1. Posse s a valid Minnesota driver's license,
14
15 2. Be at least eighteen (18) years old,
16
17 3. Be a itizen of the United States, or an alien admitted for permanent
18 residence or who has otherwise obtained work authorization from the U.S.
19 Immigrat on and Naturalization Service,
20
21 4. Shall ave no felony convictions in the last �ve (5) years; sha11 have no
22 nontraffi gross misdemeanor or misdemeanor convictions in the last three (3)
23 years inv lving the use or threat of use of force, possession or sale of a controlled
24 substanc prostitution, or indecent conduct. The license inspector may grant,
25 pursuant o state statute, an exception to the above provisions upon evidence that
26 the offe e is not related to the occupation of taxicab driver.

28 5. Shall ave a driving record meeting the following standards:
29
30 a) No convictions in the last five (5) years for any of the following
31 of nses involving injury or death; no convictions in the last three (3) years
32 fo any of the following offenses not involving injury or death:
33
34 i) leaving the scene of an accident,
35
36 ii) driving under the influence of an alcoholic beverage or drug, or
37
38 iii) reckless or careless driving.
39
40 b) For original licensure: No more than four (4) moving violations within
41 th last three (3) years, and no more than two (2) moving violations in the
42 las year. For renewal: No more than four (4) moving violations within
43 th last three (3) years and no more than three (3) moving violations in
44 th last year. Moving violations shall mean for this subsection those
45 vi ations specified above in subsections 5(a)(i), (ii) and (iii), and speeding
46 vi ations involving speeds 15 mph or more in excess of the speed limit.

48 c) Every new applicant shall have at least one year's driving experience as
49 a 1 censed driver. Such prior driving experience shall be verified by an
50 aff davit signed by a reputable person and submitted with the license
51 ap lication.

1 d Fxceptions. Upon submission of proof of suitability and evidence of
2 ' urability, the license inspector may waive one or more of the
3 r uirements listed above provided that any such waiver sha11 indicate the
4 unds for the inspector's decision and shall be approved by the Director
5 o the Department of Finance and Management Services.

7 6. Have a demonstrated knowledge of the provisions of the taxicab ordinance
8 relating o the conduct of taxicab drivers and the operation of a taxicab.

10 ,� Duty to it licens� Effective March 15, 1991, every taxicab driver while on duty
11 sha isp ay hi or her taxicab driver's license on the dashboard of the vehicle in a
12 location readily visible to passengers, which license displays the driver's photograph and
13 license number on the front�a�_�e ,s�_a�ess-�-t�e .be�lc, in a manner approved
14 by the license i pector. In addition to any other penalties, a deputy inspector or police
15 officer may ord r the licensee to discontinue operations until such time as the licensee
16 has a license in possession.

18 (g) Issuance o licens� Each taxicab driver's license shall have upon it a number by
19 which the lice e shall be designated, a photograph of the licensee, and such other
20 information as he license inspector may require. The License Inspector may issue
21 licenses for a t rm of less than one year for a prorated initial fee in order to evenly
22 distribute lice e�iration dates throughout the year.

24 (h) Requir of valid Mvrrresota dniver's licenr� Any time that a licensee's Minnesota
25 driver's license 's suspended, revoked, or cancelled, his or her ta�cicab driver's license
26 shall likewise b immediately suspended, revoked, or cancelled. No person shall operate
27 a ta.�cicab witho t a valid Minnesota driver's license.

29 (i) Renewal� taxicab drivers' license shall be issued annually. The license inspector
30 may cause the enewal of a taxicab driver's license from year to year by appropriate
31 endorsement u on the application for renewal and payment of an annual fee of twenty
32 ($20.00). The river shall make such renewal application upon a form to be furnished
33 by the License ivision. The renewal form shall be filled out with the full name and
34 address of the pplicant, together with the date and number of the original license. If a
35 driver has not een licensed in the previous license year, he or she shall be considered a
36 new applicant.

38 (j) Suspenrior� �+evocation� mul noru+enewaL A taxicab driver's license may be revoked,
39 suspended, or ot renewed by the license inspector at any time for cause pursuant to the
40 provisions of t 's Chapter and Chapter 310 of the Legislative Code. When a taxicab
41 driver's license as been revoked or suspended, it shall immediately be returned to the
42 License Divisio . If the City Council stipulates that a licensee whose taxicab driver's
43 license has bee revoked may reapply after a speci�c period of time has elapsed, that
44 period of time hall not commence until the taxicab driver's license has been retumed to
45 the License Di 'sion.

47 (k) Revocation of Mi�viesota driver's license; limited licenses; akohol�lated drivin,g
48 conviction.

50 1. Any erson holding a taxicab driver's license, whose Minnesota driver's license
51 is suspe ded, cancelled or revoked for any reason, shall immediately sunender his

1 or her t 'cab driver's license to the License Division. The taxicab driver's
2 license s all be retumed to the licensee upon reinstatement of the Minnesota
3 driver's li ense or issuance of a limited license authorizing operation of a taxicab,
4 provided, however, that suspension, cancellation or revocation of a Minnesota
5 driver's ' ense due to refusal to submit to a legally-required blood alcohol test
6 under th state implied consent statute sha11 be grounds for the revocation,
7 nonissua ce or nonrenewal of the taxicab driver's license.

9 2. Any 1 censed taxicab driver whose Minnesota driver's license has been revoked
10 and who as been issued a limited license authorizing the operation of a taxicab
11 shall i ediately notify the License Division of the same. At that time, the
12 licensee hall furnish to the license inspector a copy of the limited license and a
13 written s atement containing a schedule of the days and hours of each day during
14 which he or she will be driving a taxicab during the term of the limited license.
15 No devi ion from the schedule shall be permitted. In addition, the licensee shall
16 person furnish to the license inspector copies of all trip sheets for all shifts
17 worked uring the term of the limited license.

19 3. Any erson holding a taxicab driver's license shall notify the License Division
20 immedia ely whenever he or she is convicted of an alcohol-related driving offense,
21 whether r not it involves the operation of a taxicab.

23 4. Failu e to comply with the provisions of this section shall be grounds for
24 revocati n of a taxicab driver's license.

28 This ordinance shall take effect and be in force thirty (30) days after its passage,

Current law regulat s taxicab companies and taxicab license holders, so that taxicab
companies can be pe alized for the illegal actions of drivers. Because the drivers are .
usually independent contractors rather than employees of a taxicab company, enforcement
against taxicab com anies only has proven insufficient.
ADVANTA�ES IF APPROVED:
Taxicab drivers wil be more accountable to the City for violations of law. Standards
for eligibility for a taxicab driver's license will help assure that drivers are
minimally qualified to serve Saint Paul citizens. Taxicab driver's licenses will be
displayed so taht c tomers will have a way to make effective complaints.
