An ordinance to amend section 409.26
of the �Saint Paul Legislative Code

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1
Section 409 .26 of the Saint Pau1 Legislative Code is hereby
amended by adding the following new subsection (12) at the end of
the existing section 409.26 (b) providing for presumptive penalties:

This ordinance shall take effect and be in force thirty (30)
days following its passage, approval and publication.

Recent cases coming to the City Council have included violations of the requirement to carry
liability insurance. The current penalty matrix does not carry a penalty for failure to
carry such insurance.

City Council will have a consistent method for penalizing licensed liquor establishments for
failure to carry liability insurance.

Council will be forced to continue case by case determination of penalties.� This will lead t
difficulty in meeting the requirement that penalties be consistent from case to case.
Council will also be forced to delinate reasons for deviating from the penalty matrix
whenever a case includes violation of the requirement to carry liability insurance.
