The council of the city of Saint Paul does ordain:
That Section 60.210.J. of the Saint Paul Legislative Code be
amended so at to eliminate the definition of junkyard as follows:

That Section 60. 213 .M. of Saint Paul Legislative Code be amended
so as to add the following definition thereto:
Motor Veheicle Salvage Operation. Any business whose
princiPal activity is to obtain used motor vehicles to
salvaqe and sell usable parts therefrom and which maintains
a premises upon which to accumulate and dismantle such
vehicles.
That Section 60.218. R. of the Saint Paul Legislative Code be
amended so as to add the following four definitions thereto:
Recyclable Material , reusable material including but not
limited to glass, plastics and synthetic materials, paper
products such as newspapers, stationery, scrap paper,
computer paper and corruqated cardboard, rubber, batteries,
ferrous and non-ferrous metals, concrete, asphalt, wood, and
building materials not including yard waste.

Recvclinct Collection Center A recyclinq collection
�acility in a building for the acceptance by donation
redemption or purchase of recvclable materials. Such a
facility may allow limited compacting or crushinct of
recyclable materials.
Recvclina Drop-off Station. A facility consistinq of
reverse vendinq machines or unattended weather resistant
containers that are provided for the collection of
recvclable materials. Any such recyclable material
collected shall be of a size permitting it to be placed
com�letelv inside an enclosed reverse vendinq machine
weather resistant container or trailer so that said
materials are not exposed to the elements Such a facility
mv be established in conjunction with and accessorv to an
existincr commercial or industrial use The term recyclinq
droo-off station shall not include temporary mobile
collection containers.
Recvclina Processing Center. A facility that accepts
stores and processes recyclable materials whether or not
maintained in connection with another business Processincr
includes but is not limited to baling briquettinq
crushing compacting qrinding shredding sawing shearing
and sortina of recvclable materials and the heat reduction
or meltinct of such materials.
That Section 60. 532 of the Saint Paul Legislative Code be amended
so as to add the following revision thereto:

That the current Sections 60.532 (4) and 60. 532 (5) of the Saint
Paul Legislative Code be renumbered as follows:
� Other uses similar to the above uses.
� Accessory building, structures and uses as defined in
Section 60.201.

That Section 60.542 of the Saint Paul Legislative Code be amended
so as to add the following revision thereto:

That the current Section 60. 542 (14) of the Saint Paul Legislative
Code be renumbered as follows:
15 Accessory building, structures and uses as defined in
Section 60. 201.
That Section 60. 612 (18) of the Saint Paul Legislative Code be
amended so as to add the following revision thereto:
18 Recycling Processinct Center provided that:
� All processinq activities are conducted within a
wholly enclosed building; and
j� Outdoor storaqe of materials are within covered
containers or behind an opacxue visual screen
meeting the requirements of Section 62. 107 on
three sides. Such outdoor storage is located at
least three hundred (300) feet from any
residential district; and
� There is no outdoor open burning on the site; and
� Al1 types of processing are allowed except heat
reduction that would otherwise be permitted in I-2
districts.

That Section 60. 624 (1) of the Saint Paul Leqislative Code is
hereby repealed in its entirety and the following adopted in
place thereof:
(1) Recyclinq processing center, and motor vehicle salvage
operation, provided that such facilities conform to the
followinQ recLuirements:
jal All operations are entirely enclosed within a
building or within an open area behind an eiqht
foot obscurinq wall, fence, or landscape buffer.
The Planning Commission may modify this
requirement where a wall, fence, or buffer may
interfere with the operation of the business.
Outdoor storage shall meet the requirements of
Section 60. 623 (2) except such a fence must be
eight (81 feet high; and
� There shall be no outdoor open burning on the
site. The use of cutting torches, furnaces and
other equipment which g,roduce a flame shall not be
construed to constitute open burning; and
uc , There shall be no stacking of material above the
height of the wall or fence, except that material
set back three hundred (300) feet from the nearest
residential district may be stacked on (1) foot
higher over the wall or fence up to a maximum of
sixty (60) feet for every five (5) feet the

The Planning Commission initiated the first and the third �ortions of this 40-Acre Study
recognizing that the current Zoning Code doesn't allow shared parking between residential
and business zoning districts and doesn't define or satisfactorily regulate recyclinq
facilities in the City. The City Council initiated the second portion of this study
recognizing that the current Zoning Code doesn't require setbacks for commercial and
industrial buildings along parkways to be the same as for residential uses.
ADVANTACiE3 IF APPHOVED:
The City of Saint Paul and its citizens will benefit from each of the three �roposals in the
40-Acre Study: (1) providing additional ontions for businesses to meet off-street �arkinn
requirements, (2) mainta�ning and preserving the residential and open space character_of its
parkways, and (3) recognizing the existence of recycling facilities through Zoninc� Code
revisions and regulating their location and operation within the City. .
DISADVANTAGES IF APPROVED:
Each of the three proposals may raise concerns on the part of particular nroperty owners: `
(1) Shared narking arrangements may have some tax liability and insurance liability
- conceros._be�ween �par_ti:�ip�n�s. (2) Some businesses �vith propertv along parkways may be �
restricted in how they may utilize their property. (3) Some recycling facilities mav
have difficulty in meeting required setbacks from nearby residential properties.

An ordinance amending Chapter 61 of the Saint Paul Legislative
Code pertaining to maintaining the residential and open space
character of parkways and protecting them from encroachment by
commercial and/or industrial buildings.
The council of the City of Saint Paul does ordain:
Section 1
That Section 61. 103 (g) of the Saint Paul Legislative Code is
hereby added to read as follows:
� On those lots or parcels, or portions of lots or
parcels, which adjoin a right-of-way line oi a parkway,
the reauired setbacks from the parkway right-of-way
line shall be equal to that required for residential
uses in effect alonq the parkway right-of-way or 25
feet, whichever is greater.
That Section 61. 103 (h) of the Saint Paul Legislative Code is
hereby added to read as follows:
� Those parkways and portions of parkways listed below
are excluded from the setback requirements established
in Section 61. 1031g�
Ford Parkway (from Kenneth St. to Finn Street and north
side between Finn Street and Mount Curve Blvd )
Gannon Road
Section 2
That Section 61. 104 (f) of the Saint Paul Legislative Code is
hereby added to read as follows:
� On those lots or parcels, or portions of lots or
