THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 The Saint Paul City Council has initiated a study of the adoption of� amendments to the Comprehensive Plan and Zoning Ordinance for the City of Saint Paul regulating the density of residential development, the preservation of open space, and the provision of streets and utilities in undeveloped portions of the area defined above. Section 2 Pending completion of the studies and recommendations of the Planning Commission, and the adoption of necessary amendments to the city's Comprehensive Plan and Zoning Ordinance by the City Council, the following shall be prohibited for the period of time not to exceed one year from the effective date of this ordinance: issuance of building permits (except for accessory structures and remodeling �of existing structures) , preliminary plat approval, lot splits, rezonings, and installation of new streets. The following shall be allowed to continue: issuance of building permits for accessory structures and for remodeling and expansion of existing structures. This moratorium is enacted for a limited period while amendments to the Comprehensive Plan, Zoning Ordinance, and other applicable ordinances are prepared and adopted by the Planning Commission and City Council. The moratorium is ena�ted for the purpose of prohibiting development that is inconsistent with Ci�y and community development . objectives for the area. Paul City Council : I am a developer in the City of St . Paul ( specifically the District 6 Area) . Our company, Total Asphalt , employs approximately t 140 people in your City, and has been in business for 53 years. Another developer in that area who shares our concerns is The Austin P. Keller Company, who employ even more people and have been an established business in this City for a number of years . Between our two organizations , I conservatively estimate that we have paid millions of dollars in taxes into this community over the years , and have employed thousands of workers . Recently, it has been brought to our attention that a vote is coming before this Council on June 19th to impose a 1 year moratorium on the issuance of building permits in the District 6 area. The basic premise behind the moratorium is a very good one; it is to allow time for a plan to be developed , so that the future growth and construction in the area can be controlled . This is probably long overdue, and will greatly enhance both District 6 and the City of St . Paul as a whole. Obviously that benefits all of the developers as well . However , I do have a number of concerns that I wish the Council to consider prior to voting on the proposed Ordinance. They are as follows: 1 . Between myself and Austin P. Keller , we have in excess of 55 developable lots in the District 6 area. These lots were all . � _ 9v - �S� purchased long before there had been any discussion regarding a moratorium. When the moratorium itself was first proposed to us , it was at a District 6 Land Use meeting. Initially the moratorium period was to be 6 months long , and I whole-heartedly supported it . It is easy to see that slow, controlled growth pursuant to a well-conceived plan can only help enhance that or any other area. However , the time period for the moratorium has now been set at 1 year , with a possible extension for up to 2 and 1 /2 years. A 1 year moratorium imposes an extreme financial hardship on me, and the other developers as well . Anything longer than that would have devastating effects on both my business and my family. � 2. The only way to alleviate these effects , if the moratorium is f to last for at least one year, is to immediately have the process of developing the plan commenced immediately, and monitored thoroughly, by the City. There is some uncertainty among City Staff inembers as to how quickly all of this can be accomplished . Ms. Shelly Van Kampen assures me that the District 6 committee has already been established; the City must get a case worker from PED immediately established , in order to get all of this work done in a timely and efficient manner . 3. I need to also know what work can be done during the moratorium period . I have a # of jobs started that are directly tied in with the City' s sewer separation projects. Any delay in grading would seriously affect these projects. I realize that the proposed ordinance indicates that these on-going projects ( for which I already � � �a �� have permits) would not be affected; I simply need to be assured of this. In short , I intend to do everything possible to continue helping to develop District 6 in a manner which benefits both District 6 and the City of St . Paul . I have made a substantial financial commitment to this effect . I am simply asking for the City' s help & consideration to see to it that my investment of time and money is mutually beneficial .
