It has been a long process but I think your effort has been very worthwhile. The Committee's recommendations are excellent and will help insure a practical and sensitive implementation of the ordinance. We have worked with dozens of advisory committees over the years and this one is clearly the best. As little question as possible should be involved in their interpretation. Enforcement involves discretion, based on such factors as resources, priorities and effects on the parties concerned. We believe that these two elements are sufficiently different that they should be discussed separately. Therefore, Chapter 1 is concerned • with guidelines for rules, while Chapter 2 is concerned with guidelines for the enforcement of these rules. • 1 Guidelines for Rules • I. Prohibitions Unless exempted, all packaging used for food sold at retail must be "environmentally acceptable packaging". Packaging that is not exempted or does not conform to the definition of "environmentally acceptable packaging , as defined in the Ordinance, shall thereafter be referred to as "environmentally unacceptable packaging" in further proceedings under the Ordinances. II. Notification The Health Commissioner/�irector, upon detPrmining that a retailer is sell�ng a food product at retail whieh uti� izes environmentally unacceptable packaging, may notify that retailer of the situation by means of an Order indicating the specific package or packages involved and the grounds for believing that the package(s) designated is "environmentally unacceptable and request that a response to the Order be made within a time period specified by the Health Department. The Advisory Committee suggests 30 to 60 days. , III Identification of Packaaes Identification of packages in the application and enforcement of the Ordinances shall be by UPC Product Code as shown on the labeling of the unit of which the package is a part, if present. Otherwise, identification of the package shall be by use of the retailer/manufacturer/distributor's product identification code or other designation should no such code be present. IV. Exemptions - Four types of Categorical Exemptions are provided by the Ordinances: (a) Any flexible packaging of 10 mils or less in thickness. (b) Any packaging used in hospitals or nursing homes. (c) Any paper, cellophane, or other cellulose-based packaging that is coated with plastic. (d) Packaging for which there is no "commercially available" • "environmentally acceptable" alternative. 2 � � . @�-�a-s��i � • (Note that in both ordinances a package is defined in terms of its various parts. Thus an "environmentally acceptable" paper wrapper enclosing a plastic container and lid does not make the container and lid "environmentally acceptable".) A fifth type of exemption is proposed, based on the authority given the Commissioner in the section of the Ordinance covering Rules and Regulations: (e) An Exemption may be issued for a limited time (less than one year) when, in the judgement of the Commissioner/Director, more time is needed. No definition of "commercially available" is given in the Ordinance. The following definition is proposed: A "commercially available" package is one which (1) Has previously been used for the same product, or the like, or, (2) Is currently being used for the same product, or the like, or, (3) Is offered for sale by an established packaging material supplier for the packaging of the same product or the like, • and, (4) Is available for purchase and use in place of the package cited as "environmentally unacceptable". V. Response to Package Order The retailer/manufacturer/distributor of a package described in an Order as "environmentally unacceptable" may make one of the following responses if they wish to continue using the retail distribution system for the sale of that package: (a) Decide that the judgment of the Commissioner/Director in determining that the package(s) described in the Order are "environmentally unacceptable" is in error, present reasons for believing that this is so and request a� Exemption until the issue is resolved. (b) Decide to change to an "environmentally acceptable package", . provide the Commissioner/Director with a plan and timetable for implementing such a change, and request an Exemption to cover the time period required. (c) Assert that no suitable "commercially available° - "environmentally acceptable" package alternative exists for the • package cited and request� an Exemption. - ' 3 '. :, (d) Assert that the use of any possible "commercially available" • "environmentally acceptable" package alternative for the package covered by the Order will cause undue harm to the retailer/manufacturer/distributor, the public or other persons in terms of harmful competitive effects and economic costs; and request an Exemption. (e) Assert that study is needed to determine which response to make and request an Exemption. A careful analysis of the question of who must and who may respond to an Order turns what appears on the surface to be a simple matter into a quite complex question. The retailer who receives an Order is obligated to respond in some manner. However, a number of retailers will receive Orders listing the same packages. On the other hand, packages listed in the grocery sector will have only one manufacturer/distributor (packages in the food service sector may have more than one manufacturer/distributor), who will usually have a larger stake in the outcome and is most likely to be better equipped to respond. The Advisory Committee recommends that the following procedure be provided: The manufacturer/distributor of a package covered in an Order issued to any retailer may, at the option of the manufacturer/distributor, assume responsibility for the response • to an Order with respect to that package. If the manufacturer/distributor so chooses, they must so notify the Commissioner/Director who issued the Order and all retailers who received an Order listing the package. By this action, the obligation to respond is removed from the retailer. The foregoing does not affect in any way a retailer's obligation to cease sale at retail of any package actually banned by the Commissioner/Director. If option (c) or (d) is selected, the applicant shall provide written support for the position taken to the Commissioner/Director covering at least the following elements: - (1) A detailed description of the search conducted. (2) A full description of the data obtained. (3) The criteria used in reaching the conclusion presented. (4) A request for an Exemption for the package(s) involved. " It is possible that some of tfie information needed for a response under options (c) or (d) will be considered proprietary by the responder. Should this be so, the responder may specifically identify � such information and request that it be held confidential to the extent possible under applicable Minnesota law. 4 �� � � �9�-y�� such information and request that it be held confidential to the extent � possible under applicable Minnesota law. We do request that the drafters of the actual rules and regulations keep this problem in mind as they carry out their task. ) Given this information, the Health Commissioner/Director shall provide notice and hearing covering the requested Exemptions and upon completion of such hearing, issue such Categorical Exemptions as may be necessary to carry out the purposes of the Ordinance. The Commissioner/Director may issue exemptions subject to later confirmation by notice and hearing. The Advisory Committee believes that effective coordination between governmental units is essential to the successful achievement of the objectives of the Packaging Ordinances. The Committee recommends that a joint powers or similar agreement be adopted by all municipalities with similar ordinances. All Exemptians issued shall be reviewed on an annual �asis and notice and hearing si�all be provid2d covering the annual extension of such Exemptions. Upon completion of such hearing, the Commissioner/Oirector shall issue a one year extension for all Exemptions deemed necessary to carry out the purposes of the Ordinances. • • , 5 Enforcement of Rules � I. Enforcement Principles An essential factor in achieving the objectives of the Packaging Ordinances is a clearly defined and fully accepted e�forcement strategy. The Advisory Committee proposes that the enforcement strategy be based on the following principles: 1. Food safety is a crucial consideration for food packaging. 2. Voluntary compliance is key to successful enforcement. 3. The purpose of enforcement is to cause change consistent with the objectives of the Packaging Ordinances. 4. Enforcement should cause the most change of the most desired kind with the least consumption of resources by the Health Departments. 5. Exemptions are the single most powerful enforcement tool available. They can be used to provide both time for those affected to make changes in a well planned and organized manner and to provide unrelenting pressure on them to do so. • 6. Control of the resources of the Health Department must remain with the Commissioner/Director. The Heaith Department is a vital community resource. Determination of prioriti2s of �he use of this resource must remain with the Commissioner/Director. 7. local retailers should not be subjected to undue hardship as a result of actions by sources of supply over which they have little practical control . II. Discussion 1. Food Safety Assurance of food safety has historically come before any other consideration in food packaging. If its food products are not safe for consumption, a food company should not remain in business for very long. 2. Voluntary Compliance In our society, voluntary compliance by those subject to regulation is essential . Achieving voluntary compliance should be the cornerstone of the enforcement strategy. For voluntary compliance to � occur, the following must be true: _� 6 /� __.-% / - .� � �90���/ (a) Rules must be widely and well understood � (b) Rules must make sense to those regulated (c) Enforcement must assure that no one gains an advantage by deliberate non-compliance. 3. Objective of the Ordinances The objective of the Packaging Ordinances is to minimize, through the use of environmentally acceptable packaging, the amount of solid waste generated by the community and to encourage a reusable, recyclable and compostable waste stream for the volume remaining and so minimize the use of land filling and incineration for disposal of solid waste. 4. Change Desired The Ordinances define two types of change that result in definitive solutians to the problem of environmentally unacceptable packaging: (a) Provide acceptable means of returning for reuse or recycling the package used and thus convert that package into one that is "environmentally acceptable". , (b) Change the package to one that is currently "environmentally acceptable". Enforcement methodology should use both types of change to achieve the largest possible improvement in the composition of the solid waste stream. Changes to "exempted" packages should not be encouraged except when an improvement in the composition of the solid waste stream results. (Improvement being defined as changes that lead toward the objectives of the ordinances) The Committee feels stro�gly that recycling should be a major strategy for addressing the issue of environmentally acceptable packaging. In order to ensure rational , high quality recycling systems, the Committee recommends periodic review of recycling systems which - result in packages receiving Exemptions or achieving "environmentally acceptable" status under the Ordinances. Furthermore, a review using these same criteria should be conducted for all other recycling systems and recycled materials. The review should include the following criteria: (1) Likely rate of participation (2) Marketability of materials collected (3) Cost of the program (4) Recovery rate • 7 5. Use of Exemptions � Exemptions should be simple to obtain, but difficult to retain. They should be a privilege, not a right. That is, Exemptions should require a good faith effort to make the desired changes. Exemptions used to simply support the status quo should be difficult to retain. 6. Control of Priorities The Commissioner/Director should have the full authority to determine priorities and to decide which "environmentally unacceptable" packages to cover in an Order and which to deal with in the future. However, the Advisory Committee expects that the Commissioner/Director will receive requests for Exemptions and evaluations for packages not covered in an order. The Commissioner/Director should be required to respond to such requests in a timely manner. (The Advisory Committee suggests that a response be made within 60 days) . Procedures developed to provide this timely response should give priority to requests involving new product development by the requester. These procedures should also include means to determine the cost of providing this service and provide for a reasonable fee to cover the cost of the service. � 7. Sensitivity to Local Retailers Local retailers are in a potentially difficult position. Enfor�ement actions could put them at a serious competitive disadvantage with respect to retailers in nearby communities that do not have similar packaging ordinances. The Commissioner/Director should carefully assess competitive effects on local retailers in selecting enforcement actions. Given fair and sensitive treatment, local retailers can be a vital resource in achieving voluntary compliance since food processors are often very responsive to feedback from the retailer. - III Enforcement Methodoloqy The Advisory Committee recommends that enforcement be based on a hierarchy of tiered enforcement priorities based on packaging by product group. In establishing this hierarchy of enforcement priorities, the Commissioner/Oirector should view the food industry in terms of Grocery and Food Service/Oeli sectors (using the same definitions currently used by the Health Departments), and a separate set of tiered priorities should be established for each of these sectors. • 8 � (��d-�3/ Tier I enforcement efforts for the Food Service/Deli sector should � proceed simultaneously with Tier I enforcement efforts in the Grocery sector. The Advisory Committee proposes the following descriptions for these tiers: Grocerv Sector Tier I - Packaging by product group sold in very high volumes with a consequent proportionately large effect on the solid waste stream. Tier II - Packaging applications where existing technology makes it technically most practical to convert to an environmentally acceptable package. This does not imply that substitutio� is preferable to recycling. Group A - Packaging by product group where an "environmentally acceptable" package is in concurrent use with an "environmentally unacceptable" package. Group B - Packaging by product group �here an "environmentally acceptable" package was used in the past and is still commercially available. Group C - Packaging by product group where a probable alternative is a "degradable" package as defined in the Ordinances. � Food Service�Deli Sector Tier I - Packaging used for pro�ucts consumed on premises. Tier II - Packaging used for products consumed off premises, including those co�sumed off premises as part of a catering function that includes cleanup as well as food service. IV. Tier Assiqnment The following Tier assignments are proposed: - Grocery Sector - The Grocery sector tier assignments are based on an assessment of the packaging used by each product class combined with sales pattern data supplied by Rainbow Foods. Tier I Milk Carbonated beverages Ice cream/frozen desserts Yogurt Noncarbonated water iTier II, Group A 9 Pasta sauces Preserves/toppings � Mustard Edible oils Syrups Bouillon/spices Peanut butter Vinegar Honey BBQ sauce Coffee whiteners Ketchup Tier II, Group B Individual serving containers Soft margarine Tier II, Group C Cottage cheese Whipped toppings Eggs Sour Cream & substitutes Meat trays Produce trays Processed meats Food ServiceJDeli Sector - The Food Service/Deli sector tier assignment is based on an assessment of feasible operations within the sector. This does not imply that substitution is preferable to recycling. Tier I � Any packaging used for products consumed on premises. Tier II Any packaging used for products consumed off premises including those consumed off premises as part of a catering function that includes cleanup as well as food service. V Effective Date and Imalementation of the Ordinances - Except as discussed below, the Advisory Committee recommends that the Ordinances be made effective as of July 1, 1990, with enforcement carried out as follows: In order to provide for an enforcement phase-in period, the Commissioner/Director shall issue an Exemption for all product groups effective on July l, 1990 (or such other date established as the effective date of the Ordinances) . This Exemption shall apply to all Tier I product groups in both the Grocery sector and the Food Service/Deli sector for a period of, say, 3 to 6 months; and to Tier II Group A product groups in the Grocery sector for a period of, say, 6 to � 9 months; and to Tier II, Group B and C product groups in the Grocery lo � . � . �9a���/ sector and in the Food Service/Oeli sector for a period of, say, 12 • months from that date. A retailer/distributor/manufacturer of a Tier I product group may apply for an Exemption during the phase-in period provided. If they do so, their product group will be deemed in compliance with the Ordinances during the application and effective periods of their Exemptions. A retailer/distributor/manufacturer of a Tier II product group may apply for an Exemption after the expiration of the Tier I phase-in period and before the expiration of the Tier II phase-in periods. If they do so, their product groups will also be deemed in compliance with the Ordinances during the application and effective periods of their Exemptions. Any "environmentally unacceptable" package which is not covered by an Exemption (or an application for Exemption) after expiration of the respective phase-in periods shall be subject to a removal Order issued by the Commissioner/Director. The Advisery Committee recommendation f�r a July 1, 1990 effective aate is �ontingent on the accomplishment of the following tasks: 1. The Minneapolis and St. Paul Ordinances are amended so that identical language is present in both Ordinances. The Advisory Committee recommends that this amending include the � following changes: (a) Exempt any flexible package material of 10 mils or less unless specifically disapproved by the Commissioner/Director. The Commissioner/Director should, after appropriate notice and hearing, disapprove those f]exible package materials referred to in Section 236.06 (a) in the St. Paul ordinance and Section 204.70 (a) in the Minneapolis ordinance, not being recycled when the alternative package is being recycled. (Eliminates the requirement of specific approval by the Director while retaining the power to deal with any unusual material . ) (b) In the Minneapolis Ordinance, move "Degradable - Packaging" from Section 204.20 - b "Environmentally Acceptable Packaging" to Section 204.70 "Exemptions"; and in the St. Paul Ordinance move "Degradable Packaging" from Section 236.02-b "Environmentally Acceptable Packaging" to Section 236.06 "Exemptions". . (c) Revise the language in section 204.20 - b(3) in the Minneapolis Ordinance and section 236.02 - b3 in the St. Paul Ordinance defining "Recyclable Packaging" so that it is uniform between the two Ordinances. The Committee suggests the following definition: "Packaging made of materials that • are separable from solid waste by the generator or during collection and that is currently collected for recycling in : - 11 a municipally approved program. Packaging made of either � polyethylene terepthalate (P.E.T. ) or high density polyethylene (H.D.P.E. ) shall be considered to be recyclable if and when it is collected for recycling in the same manner as here stated." 2. Regulations based on these Guidelines have been drafted, notice and hearing completed, and finished regulations promulgated by both Minneapolis and St. Paul . 3. Enforcement systems in both cities are compatible with each other. Exemptions issued in one city should be valid in the other city as well . The City Council of the City of Minneapolis dc ordain as follows: Section 1. That the Minneapolis Code of Ordinances be amended by adding thereto a new Chapter 204 to read as follows: Chapter 204. Environmental Preservation: Environmentally Acceptable Packaging 204.10. Legislative Purpose. The City Council finds that discarded packaging from foods and beverages constitutes a significant and growing � portion of the waste in Minneapolis' waste stream. Regulation of food and beverage packaging, therefore, is a necessary part of any effort to encourage a recyclable and compostable waste stream, thereby reducing the disposal of solid waste and the economic and environmental� costs of waste management for the citizens of Minneapolis and others �working or doi�g business in Minneapolis. The Council further finds that plastic packaging is rapidly replacing other packaging material, and that most plastic packaging used for foods and beverages is nondegradable, nonreturnable and nonrecyclable. The Council also finds that the two main processes used to dispose of discarded nondegradable, nonreturnable and nonrecyclable plastic foods and beverage packaging, are land filling and incineration, both of which Should be minimized for environmental reasons. • Chemicals hazardous to human health and to the safety of the environment are present in the composition of plastic packaging, • are believed to leach into the groundwater when this packaging is placed in landfills, have been found to escape into the air when this packaging is burned in incinerators, and contribute to environmental problems associated with ash residue resulting from the incineration process. The Council therefore finds that the minimization of no�degradable, nonreturnable and nonrecyclable food and beverage packaging originating at retail food establishments within the City of Minneapolis is necessary and desirable in order to reduce the-City's waste stream, so as to reduce the volume of landfilled waste, to minimize toxic by-products of incineration, to make the waste stream less damaging to the environment, and to make our City and neighboring communities more environmentally sound places to live. 204.20. Definitions. As used in this Chapter, the following terms and phrases shall have the meanings as defined in this section: (a) "Fackaging" shail mean and include all food-related wrappings, adhesives, cords, bindings, strings, tapes, ribbons, bags, boxes, coverings and containers; and shall further include cups, glasses and similar containers for drinking out of or for holding liquids, and plates and serving trays, but shall specifically exclude plastic knives, forks and spoons sold or � intended for use as utensils. (b) "Environmentally acceptable packaging" shall mean and include any o� t�e following: (1) DEGRAOABLE PACKAGING: Paper or other cellulose-based packaging capable of being decomposed by natural biological or biochemical processes; (2) RETURNABLE PACKAGING: Food or beverage containers or packages, such as, but not limited to, soft drink bottles and milk containers that are capable of being returned to the distributor, such as but not limited to, dairies and soft drink bottlers, for reuse as the same food or beverage container use at least once; (3) RECYCLAB�E PACKAGING: Packaging made of materials that are separable from solid waste by the generator or during collection and are currently collected for recycling in an organized fashion in a municipally sponsored program within the • � � ��a 'y�/ �City of Minneapolis. Packaging made of either polyethylene terepthalate (P.E.T.) or high density polyethylene (H.D.P.E.) shall be considered to be recyclable if and when it is collected for recycling in the same manner as • here stated. (c) "Food establishment" as used in this Chapter means a "food establishment" as defined in Section 188.10 of the Minneapolis Code of Ordinances. (d) "Commissioner" shall mean the Commissioner of Health of the City of Minneapolis or the Commissioner's designee. 204.30_ Prohibitions. No person owning, operating or conducting a f�ood-establishment within the City of Minneapolis shall do or allow to be done any of the followi�g within the City: Sell or convey at retail or possess with the intent to sell or convey at retail any food or beverage that is placed, wrapped or packaged, at any time at or before the time or point of sale, in or on packaging which is not environmentally acceptable packaging. The presence on the premises of the food establishment of packaging which is not environmentally acceptable packaging shall constitute a rebuttable presumption of intent to sell or convey at retail, or to provide to retail customers packaging which is not environmentally acceptable packaging; provided, however, that this subparagraph shall not apply to manufacturers, brokers or warehouse operators, who conduct or transact no retail food or beverage business. 204.40. Enforcement. The Commissioner shall have the duty and the authority to enforce provisions of this chapter. • 204.50. Rules and Regulatio�s. The Commissioner may, upon notice and hearing, promulgate such rules and regulations as may be necessary to carry out the purposes of this Chapter and protect the health of the public, including the development of exemptions under Section 204.10 for packaging for which there is no commercially avai7able alternative and for flexible packaging. In promulgating such rules the Commissioner shali consider the legislative purposes provided in Section 204.10 of this Chapter and shall consult with the operators of affected food establishments. 204.60. Advisory Comnitee on Environmentally Acceptable Packaging. The City Council shall , by resolution, establish an Advisory Committee on Environmentally Acceptable Packaging. The resolution shall provide for the membership, manner of appoi�tment, the Committee's charge and its duration. The membership shall be drawn from affected governmental units, business and industry, trade associations, general business organizations, consumer - groups, environmental groups and others as determined in the resolution. The Advisory Committee shall include a member designated by the Hennepin County Board of Commissioners from outside the City of Minneapolis and a member designated by the Association of Metropolitan Municipalities. The charge of the Committee shall include the following: � • • r . (a) monitoring industry and governmental actions relating to • environmentally acceptable packaging; (b) advising the Commissioner of Health on implementation issues; (c) advising the City Council on the feasibility of the effective date of this Ordinance and recommending whether or not the effective date should be extended; (d) assisting in efforts to expand the City's recycling program to include the collection of potentially recyclable materials not presently collected, including consideration of financial assistance; (e) recommending actions other levels of government and industry can take to advance the goals of this Chapter� (f) assisting in the development and implementation of public education programs on recycling and packaging; (g) Encouraging adoption of substantially similar regulations by surrounding cities, particulariy those cities with a border in common with Minneapolis. 204.70. Exemptions. Notwithstanding any other provision to the contrary, this chapter shall not apply to: (a) any flexible packaging of 10 mils or less in thickness unless • disapproved by the Commissioner pursuant to rules promulgated under Section 204.50 above; (�) any packaging used at hospitals or nursing homes; (c) any paper, cellophane or other cellulose-based packaging that is coated with plastic; (d) any packaging which is not environmentaily acceptable, but for which there is no commercially available alternative as determined by the Commissioner by rule promulgated pursuant to Section 204.50. In determining whether there are commercially available alternatives the Commissioner shall consider the following: (1) the availability of environmentally acceptable packaging for affected products; (2) the economic consequences to manufacturers, suppliers, retai7ers and other - vendors of requiring environmental7y acceptable packaging when available; and (3) the competitive effects on manufacturers, suppliers, retailers and other vendors involved in the sale of product brands or labels available only in packaging that is not environmentally acceptable packagi�g. Every rule creating an exemption under this paragraph shall be reviewed annually by the Commissioner to determine whether current conditions continue to warrant the exemption. � �� ��a -��i 204.80. Penalties. Each violation of any provision of this Chapter or of lawful regulations promulgated under Section 204.50 • hereof shall be a petty misdemeanor, for which the maximum fine shall be $50.00. Each day on which a violation occurs constitutes a separate violation. 204.90. License Adverse Action. A violation of Section 204.30 shall be sufficient grounds for the revocation, suspension, denial or non-renewal of any license for the food establishment at which the violation occurs. 204.100. Severability. If any part or provision of this Chapter or the application thereof to any person, entity, or circumstances shall be adjudged unconstitutional or invalid by any court of competent jurisdiction, such judgment shall be confined �in its operation to the part, provision or applicatio� which is directly involved in the controversy in which such judgment shall have been rendered, and shall not affect or impair the validity of the remainder of this Chapter or the application thereof to other persons, entities, or circumstances. 204.110. Effective Date. This Ordinance shall take effect July 1, 1990� The City Council may, however, pursuant to the recortanendations of the Advisory Committee created under Section 204.60 hereof and the Commissioner of Health, delay the effective date of this Chapter for a period not to exceed six (6) months. . THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 A new chapter of the Saint Paul Legislative Code is here'oy enacted to read as follows: Chapter 236 ENVIRONMENTAL PRESERVATION: PLASTIC PACKAGING • Section 236.01 Legislative Purpose. The Council finds that discarded packaging from foods and beverages constitutes a significant and growing portion of the waste in Saint Paul' s waste stream. Regulation or food and beverage oackaging, therefore, is a necessary part of any effort to encourage a r2cyclable and com oostable wast2 stream, theraby reducing the disposal of solid waste and the economic and environm ental costs of waste management for the citizens of Saint Paul and others working or doing business in Saint Paul. The Council further finds that plastic pac;caging is rapidly replacing other packaging material , and that most plastic packaging used for foods and beverages is nondegradable , nonreturnable and nonrecyclable. Chemicals hazardous to human health and to the safety of the . environment are present in the composition of plastic packaging and have been found to escape into the air when this packaging is burned in incinerators, and con�ribu�e to envirorimental problems associated with ash residue resulting from the incineration process. The Council therefore finds that the minimization of nondegradable, nonreturnable and nonrecyclable food and beverage packaging originating at r2tail food establishments within the • City of Saint Paul is necessary and desirable in order to reduce the City's waste stream, so as to reduce the volume of landfilled waste, to minimize toxic by-products of incineration, to make the waste stream less damaging to the environment , and to make our City and neighboring communities more environmentally sound places to live. The Council finds that the plastic packaging used for foods and beverages contributes significantly to litter and the disposal of litter , is more difficult to collect, and lasts indefinitely until picked up or cleaned up. - The Council has also been made aware of the facts recited in the Addendum to this ordinance, which facts have been weighed and considered as part of the record supporting its passage. Section 236.02. Definitions. As used in this chapter , the following terms and phrases shall have the meanings as defined in this section: (a) "Packaging" shall mean and include all food-related wrappings, adhesives, cords, bindings, strings, tapes, ribbons, bags, boxes , coverings and containers; and 2 • , . ", �" 90-��� � shall further include cups , glasses and similar containers for drinking out of or for holding liquids, and plates and serving trays but shall specifically exclude plastic knives, forks and spoons sold or intended for use as utensils. (b) "Environm entally acceptable packaging" shall mean and include: ( 1 ) DEGRADABLE PACKAGING : Paper or other cellulose -based packaging capa 'Qle of bein� decomposed by natural biologicai or biochemical processes; (2 ) RETURNABLE PACKAGING: Food or beverage containers or packages , such as but not limited to , soft drink bottles and milk containers, that • are capable of being returned to the distributor, such as but not limited to, dairies and soft drink bottlers , for reuse as the same food or beverage container use at least once; (3) RECYCLABLE PACKAGING: Packaging made of materials that are separable from solid waste, by the generator or during collection, for which there is an existing city-approved curbside recycling program operating in and maki�g curbside pickups in the City of St. Paul. Packaging made of either polyethylene terepthalate (P.E.T.) or high density polyethylene (H.D. P.E) shall be considered recyclable if and when it is collected for recycling in the sam e manner as here stated. (c) "Retail food establishment" as used in this chapter means a "food establishm ent" as defined in section 331.f�7 of the Saint Paul Legislative Code. References to retail food establishment in section 236.g3 are specifically defined herein to include, for the purposes of prohibitions, penalties and adverse actions against licenses , the owner of such • 3 � , � . � establishment and all persons, firms or corporations operating and/or managing such establishment. (d) "Director" shall mean the direetor of the division of public health of the department of community services, or the said director's designee. Section 236. g3 . Prohibitions. No person , firm or corporation owning , operating or managing a retail food establishment located within the City of Saint Paul shall do or allow to be done any of the following : (a) Within the City of Saint Paul , sell or convey at retail, or possess with the intent to sell or convey at retail, any food or beverage which is placed , wrapped or packaged at any time at or before the time or point of sale in or on packaging which is not environmentally • acceptable packaging; nor (b) Within the City of Saint Paul , prov.ide to retail customers, or possess with the intent to provide to retail customers , packaging which is not environmentally acceptable packaging. (c) The presence on the premises of the retail food establishment of packaging which is not environmentallyacceptable packaging shall constitute a rebuttable presumption of intent to sell or convey at retail , or to provide to retail customers packaging � which is not environmentally acceptable packaging; provided , however , that this subparagraph shall not apply to m anufacturers, brokers or warehouse operators, who conduct or transact no retail food or beverage � business . Section 236.�d4. Enforcement. The director shall have the duty and the authority to enforce provisions of this chapter. Section 236.05. Rules and Re�ulations. Section 236.16. Exemptions. Notwithstanding any other provision to the contrary, this chapter shall not apply to: (a) any f lex itle packag ing of 4J.25 mm (0.01 in.) or less in thickness approved by the director pursuant to rules prom ulgated under section 236.05 above; (b) any packaging used at hospitals or nursing homes; (c) any paper , cellophane or other cellulose-based • packaging that is coated with plastic; (d) any packaging which is not environmentally acceptable for which there is no commercially available alternative as determined by the director by rule promulgated pursuant to section 236.P15. The presumptive penalty for the first a�gearance of such a licenseholder before the city council shall be a two�day suspension of all licenses held at or by the said retail food establishment. Section 236.PJ9. Severability. The resolution shall provide for the membership, manner of appointment , the Committee's charge and its duration. The membership shall be drawn from affected governmental units , business and industry, trade associations , general business organizations, consumer groups, environmental groups and others as determined in the resolution. The Committee shall be staffed by the Health Depart�ent.
