An ordinance to exempt private
clubs having their own liquor
licenses from the definition
of "large organization" under
Section 409. 21(c) of the Saint
Paul Legislative Code .
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1
Statemaent of Pur ose. Ordinance No . 17676 (C .F. 89-1082) ,
effective cto er , , was enacted to facilitate the trans-
ition of clubs holding city-issued private club licenses from
establishments which could only allow members to display and
consume alcoholic beverages on the club premises , to establish-
ments which could apply for and receive on=sale intoxicating
liquor licenses allowing sales to members and bona fide guests
of inembers only. An ordinance to exempt those clubs from
certain Charter provisions relating to the numbers of licenses
in liquor patrol limits ha� been introduced and will be considered
by the Charter Commission and the City Council . All such private
clubs , when operating as private clubs , were entitled to carry
on charitable gambling under former Chapter 404 of the Legislative
Code. The Council never intended, in passing Ordinance No . 17676 ,
to prohibit such private clubs from carrying on charitable
gambling activities in their own premises . However, when such
clubs will become licensed under Chapter 409 of the Legislative
Code, they will arguably fall under the definition of "large
organizations" in Section 409 . 21(c) , with the practical result
that they will be unable to conduct charitable gambling on their

premises . This ordinance is intended solely to rectify that un-
anticipated result, and exempts private clubs from the "large
organization" definition so long as they have an intoxicating
liquor license and so long as the charitable gambling is carried
out solely on their licensed premises . All other requirements
of Chapter 409 relating to gambling in licensed establishments
will apply to such clubs and compliance will be enforced.
Section 2
Section 409. 21 (c) of the Saint Paul Legislative Code is
hereby amended by adding a new subsection (4) at the end
thereof to read as follows :
"(4) The term "large organization" for the purpose
of section 409. 21(c) shall not include a club as
defined in section 409. 02 of this chapter where
such club has an on-sale intoxicating liquor license
issued under this chapter and the only charitable
gambling carried out on the licensed premises is
operated hy the club itself in conformity with
applicable state and municipal licenses and regu-
lations thereunder. "

Section 3
This ordinance shall take effect and be in force thirty (30)
days following its passage, approval and publication.

Re: Private Clubs
Enclosed is a draft ordinance to take care of the problem with
gambling in the private clubs once they have shifted over and
become on-sale licensees. It is ready to go if you have no changes,
but if there is anything you would like added or changed, let me
know. I put in a r�a�tively long statement of purpose, hoping that
will save both of us from having to make interminable explanations
of what it does. It's actually just a sort of housekeeping measure.
