As I indicated to you, the recommended penalty is for a one-week suspension of pour taxicab driver's license, but it is the CounciPs right to make the decision as to the actual penalty. You also asked me if this wouid appear on your driving record. This matter is an action against your taxicab driver's license, and does not impact your Minnesota driver's license. In order for a conviction to appear on your driver's license, you would need to be charged and either plead guilty or be found guilty in criminal court of the offense of careless or reckless driving. You were not chazged by either the County or the city as a result of this incident, but the underlying facts can still be used to pursue adverse action against your t�icab driver's license, which is what the Office of License, Inspections and Envuonmental Protection has done. This matter will be scheduled for a hearing, and notice of the time, date and place of the City Council hearing will be sent to you. Please feel free to call if you have any additional questions. This recommendation is based upon the following information: On September 1, 1997, a police report was filed in which it is alleged that you and a fare got into an argument. When the fare left the cab, witnesses told the police that you drove oa to the sidewalk, nearly striking the fare. The report states that your cab swerved towards the victim, causing him to jump to avoid you. Saint Paul Legislative Code §310.06 (b)(6)a. permits adverse action to be taken against a license when "(tlhe licensee or applicant (or any person whose conduct may by law be imputed to the l,icensee or applicant) has violated, or performed any act which is a violation of, any of the provisions of these chapters or o£ any statute, ordinance or regulation reasonably related to the licensed activity, regardless of whether criminal charges have or have not been brought in connection therewith. The foregoing facts constitute careless and reckless driving, violations of Minn. Stat. §§169.13, subdivisions 1& 2. As I indicated to you, the recommended penalty is for a one-week suspension of pour taxicab driver's license, but it is the CounciPs right to make the decision as to the actual penalty. You also asked me if this wouid appear on your driving record. This matter is an action against your taxicab driver's license, and does not impact your Minnesota driver's license. In order for a conviction to appear on your driver's license, you would need to be charged and either plead guilty or be found guilty in criminal court of the offense of careless or reckless driving. You were not chazged by either the County or the city as a result of this incident, but the underlying facts can still be used to pursue adverse action against your t�icab driver's license, which is what the Office of License, Inspections and Envuonmental Protection has done. This recommendation is based upon the following information: On September 1, 1997, a police report was filed in which it is alleged that you and a fare got into an argument. When the fare left the cab, witnesses told the police that you drove oa to the sidewalk, nearly striking the fare. The report states that your cab swerved towards the victim, causing him to jump to avoid you.
