WHEREAS, Mr. Randolph Cook was issued a Ta�cicab Driver's License (license ID No. 45560)
by the City of Saint Paul, 4ffice of License, Inspections and Environmental Protectian; and
WHEREAS, Mr. Cook has a criminal history of gross misdemeanor convicrions for indecent
exposure including as follows: on or about June 25, 1997, Mr. Cook pled guilty to a gross misdemeanor
violation of Indecent Exposure; on or about November 24,1 495, Mr. Cook pled guilty to a gross
misdemeanor violation of Indecent Exposure; and
WHEREAS, Saint Paul Legislative Code Sec. 376.16 identifies requirements for the issuance of
TaYicab Driver's Licenses; including §376.16(e)(4) which states that a person "Shall have no nontra�c
gross misdemeanor or misdemeanor convictions in the last three (3) yeazs involving ... indecent
conduct."; and
WHEREAS, Saint Paul Legislative Code §310.06(b) also allows denial of a license when such
matters "indicate a lack of good moral character or fitness to engage in the licensed activity.", or when
"the activities of the licensee in the licensed activity ereated or have created a serious danger to the
public health, safety or welfare, or the licensee performs or has performed his or her work or activity in
an unsafe manner." Now therefor,
BE IT RESOLVED, that the Tasicab Driver's License held by Randolph Cook (License ID No.
45560) is hereby revoked based on the ]icensee's convictions for Indecent Exposure.
This resolution and the action of the Council in this matter are based upon the facts contained in
the Notice of Denial of License Renewal Application to the licensee, and such arguments as may have
been presented to the Council at the public hearing. The facts were not contested by the licensee.

The Office of License, Inspections and Environmental Protection is recommending deniai of your
renewal application for taxicab driver's license. This action is based on the following:
On or about June 25, 1997, pou pled guilty to the violation of Indecent
Eaposure. On or about November 29,1995, yon pled guilty to the violation of
Indecent Ezposure. On or about January 31, 1995, you pled guilfy to two
violations of Indecent Egposure. The above conduct are gross misdemeanor
violations of the law, and constitute grounds under Section 376.16(e)(4) of the
Saint Paul Legislative Code for denial of your license application.
Section 376.16(e)(4) of the Saint Paul Legislative Code does not permit the issuance of a license to
a person having a gross misdemeanor or misdemeanor conviction in the previous three yeazs
involvingindecentconduct
Section 310.06 of the Legislative Code also allows denial of a license when such matters indicate
a lack of good moral character or fitness to engage in the licensed activity.
Under state law, Minn. Stat ch. 364, the City of Saint Pau1 must inform you of certain matters:
First, the grounds and reasons for the denial of the license. These grounds and
reasons aze sei forth above.

Second, any compiainu or grievances that you may have wili be processed and
adjudicated in accordance with the procedures set forth in section 310.05 of the Saint (rr"'4 ��
Paul Legislafive Code. These procedures are substandally similar to those required
by the state administrative procedures act, Minn. Stat. §§ 14.57-.69.
T'hird, the earliest date on which you may reapply for a taxi driver's license will be
one yeaz from the later of the following two dates: (1) the date of your successful
completion of supervised probation, �n�ith a copy of the department of corrections
dischazge order and other documents showing compliance with all terms and
conditions of probation; or (2) the date, pursuant to section 310.02 of the Legislative
Code, your license is denied by the City of Saint Paul. Future reception of a re-
application does not guu that there will be sufficient evidence of rehabilitation,
nor that a license wili be issued at that time.
Fourth, if you reappiy, the City of Saint Paul wiil consider all competent evidence
of rehabilitafion that you wish to present. Examples of the type of evidence that will
be considered aze set forth in secrion 364.03 of the state law.
Since the proposed denial of your reneu�al application for a license is an adverse action, you are
entitied to the hearing procedures established in sec6ons 310A5 and 310.06 of the Saint Paul
Legislative Code. You or your attorney will have to make a written request for a hearing if you wish
to contest the denial of your renewal application.
Hearing Procedures:
If you contest the facts stated above in bold type, a hearing on the
facts will be heazd before an administrative law judge, whose findings
and recommendafions will be given to the St. Paul City Council for
a final determination. If you choose to exercise your right to an
administrative hearing, the Office of License, Inspections and
Environmental Protection will also submit a recommendarion to the
judge to recover the cost of the hearing. You may then be held
responsible for the cost of the administrative hearing.
If you do not wish to contest the facts stated above in bold type, but
wish to proceed with the license application process, you will need to
admit in writing to the facts stated above in bold type. The matter
will then be scheduled for hearing before the St. Paul City Council for
a finat detemunation regazding the status of your taxicab driver's
license.
If you do not wish fo confest the facts stated above in bold type
and dp not wish fo continue to operate as a taxicab driver within
the City of St. Paul, you may surrender yout taxicab driver's license

to the license division and request to withdraw your renewal application ��' ��'�

as to whether you admit or deny the highlighted facts stated above, and whether you wish to have
an administrative hearing on those facts. As stated above, if yon choose to proceed with an

I went to the jail annex_to_ talk to the suspect. I advised him of his
rights by use of form PM 247.1. He said he understood the rights 2 read
to him and he signed the form. He identified himself as Randolph George
Cook, date of birth 8-23-54.
He told me he would not-talk to me until he talked to an attorney. The
interview waws terminated.

5-21-97 0745� Indecent Conduct
I called Marilyn Saclolo at her home. She said when he stopped his cab
and offered her a ride he didn't say anything about paying £or the ride.
Before they started moving he turned to her ,as she sat in the back seat
and said to her that she_was a very pretty girl. He at the same time
grabbed her hand. She jerked away and sat as far back as she could. He
tried again to grad lier hand but he missed.
He then drove west on University. About two blocks later he leaned way
back in his seat and pulled his 'dick' out and began to masturbate his
'dick'. She could see that it was his penis that he had in his hand. He
asked her if she had ever seen a cadillac and told her he was rock hard.
She said he then leaned down and put his head between his legs. What she
saw and interpreted was that he was trying to suck his own ' dick'. She
said he was trying to steer the car with his knee while he had his.head
down. He did this for several blocks. During the ride the car was
swerving all over University from curb to median. She said he dida't stop
until they pulled into the Midway_Center. She had him let her off near
MeDonalds. He wanted to take near the front door but ahe was aEraid to be
seen by anyoae. --
She said she was frightened the whole way but thought that if she kept
her mouth shut she might be safe and he would let her out. She said she
paid for the ride because about 1/2 way through the ride he yelled to
her, "you have money for the ride, right?" She told him, yes. She gave
him a twenty dollar bill aad he gave her change.

Floor, Saint Paul City Hall and Ramsey County Courthouse.

WHEREAS, Mr. Randolph Cook was issued a Ta�cicab Driver's License (license ID No. 45560)
by the City of Saint Paul, 4ffice of License, Inspections and Environmental Protectian; and
WHEREAS, Mr. Cook has a criminal history of gross misdemeanor convicrions for indecent
exposure including as follows: on or about June 25, 1997, Mr. Cook pled guilty to a gross misdemeanor
violation of Indecent Exposure; on or about November 24,1 495, Mr. Cook pled guilty to a gross
misdemeanor violation of Indecent Exposure; and
WHEREAS, Saint Paul Legislative Code Sec. 376.16 identifies requirements for the issuance of
TaYicab Driver's Licenses; including §376.16(e)(4) which states that a person "Shall have no nontra�c
gross misdemeanor or misdemeanor convictions in the last three (3) yeazs involving ... indecent
conduct."; and
WHEREAS, Saint Paul Legislative Code §310.06(b) also allows denial of a license when such
matters "indicate a lack of good moral character or fitness to engage in the licensed activity.", or when
"the activities of the licensee in the licensed activity ereated or have created a serious danger to the
public health, safety or welfare, or the licensee performs or has performed his or her work or activity in
an unsafe manner." Now therefor,
BE IT RESOLVED, that the Tasicab Driver's License held by Randolph Cook (License ID No.
45560) is hereby revoked based on the ]icensee's convictions for Indecent Exposure.
This resolution and the action of the Council in this matter are based upon the facts contained in
the Notice of Denial of License Renewal Application to the licensee, and such arguments as may have
been presented to the Council at the public hearing. The facts were not contested by the licensee.

The Office of License, Inspections and Environmental Protection is recommending deniai of your
renewal application for taxicab driver's license. This action is based on the following:
On or about June 25, 1997, pou pled guilty to the violation of Indecent
Eaposure. On or about November 29,1995, yon pled guilty to the violation of
Indecent Ezposure. On or about January 31, 1995, you pled guilfy to two
violations of Indecent Egposure. The above conduct are gross misdemeanor
violations of the law, and constitute grounds under Section 376.16(e)(4) of the
Saint Paul Legislative Code for denial of your license application.
Section 376.16(e)(4) of the Saint Paul Legislative Code does not permit the issuance of a license to
a person having a gross misdemeanor or misdemeanor conviction in the previous three yeazs
involvingindecentconduct
Section 310.06 of the Legislative Code also allows denial of a license when such matters indicate
a lack of good moral character or fitness to engage in the licensed activity.
Under state law, Minn. Stat ch. 364, the City of Saint Pau1 must inform you of certain matters:
First, the grounds and reasons for the denial of the license. These grounds and
reasons aze sei forth above.

Second, any compiainu or grievances that you may have wili be processed and
adjudicated in accordance with the procedures set forth in section 310.05 of the Saint (rr"'4 ��
Paul Legislafive Code. These procedures are substandally similar to those required
by the state administrative procedures act, Minn. Stat. §§ 14.57-.69.
T'hird, the earliest date on which you may reapply for a taxi driver's license will be
one yeaz from the later of the following two dates: (1) the date of your successful
completion of supervised probation, �n�ith a copy of the department of corrections
dischazge order and other documents showing compliance with all terms and
conditions of probation; or (2) the date, pursuant to section 310.02 of the Legislative
Code, your license is denied by the City of Saint Paul. Future reception of a re-
application does not guu that there will be sufficient evidence of rehabilitation,
nor that a license wili be issued at that time.
Fourth, if you reappiy, the City of Saint Paul wiil consider all competent evidence
of rehabilitafion that you wish to present. Examples of the type of evidence that will
be considered aze set forth in secrion 364.03 of the state law.
Since the proposed denial of your reneu�al application for a license is an adverse action, you are
entitied to the hearing procedures established in sec6ons 310A5 and 310.06 of the Saint Paul
Legislative Code. You or your attorney will have to make a written request for a hearing if you wish
to contest the denial of your renewal application.
Hearing Procedures:
If you contest the facts stated above in bold type, a hearing on the
facts will be heazd before an administrative law judge, whose findings
and recommendafions will be given to the St. Paul City Council for
a final determination. If you choose to exercise your right to an
administrative hearing, the Office of License, Inspections and
Environmental Protection will also submit a recommendarion to the
judge to recover the cost of the hearing. You may then be held
responsible for the cost of the administrative hearing.
If you do not wish to contest the facts stated above in bold type, but
wish to proceed with the license application process, you will need to
admit in writing to the facts stated above in bold type. The matter
will then be scheduled for hearing before the St. Paul City Council for
a finat detemunation regazding the status of your taxicab driver's
license.
If you do not wish fo confest the facts stated above in bold type
and dp not wish fo continue to operate as a taxicab driver within
the City of St. Paul, you may surrender yout taxicab driver's license

to the license division and request to withdraw your renewal application ��' ��'�

as to whether you admit or deny the highlighted facts stated above, and whether you wish to have
an administrative hearing on those facts. As stated above, if yon choose to proceed with an

I went to the jail annex_to_ talk to the suspect. I advised him of his
rights by use of form PM 247.1. He said he understood the rights 2 read
to him and he signed the form. He identified himself as Randolph George
Cook, date of birth 8-23-54.
He told me he would not-talk to me until he talked to an attorney. The
interview waws terminated.

5-21-97 0745� Indecent Conduct
I called Marilyn Saclolo at her home. She said when he stopped his cab
and offered her a ride he didn't say anything about paying £or the ride.
Before they started moving he turned to her ,as she sat in the back seat
and said to her that she_was a very pretty girl. He at the same time
grabbed her hand. She jerked away and sat as far back as she could. He
tried again to grad lier hand but he missed.
He then drove west on University. About two blocks later he leaned way
back in his seat and pulled his 'dick' out and began to masturbate his
'dick'. She could see that it was his penis that he had in his hand. He
asked her if she had ever seen a cadillac and told her he was rock hard.
She said he then leaned down and put his head between his legs. What she
saw and interpreted was that he was trying to suck his own ' dick'. She
said he was trying to steer the car with his knee while he had his.head
down. He did this for several blocks. During the ride the car was
swerving all over University from curb to median. She said he dida't stop
until they pulled into the Midway_Center. She had him let her off near
MeDonalds. He wanted to take near the front door but ahe was aEraid to be
seen by anyoae. --
She said she was frightened the whole way but thought that if she kept
her mouth shut she might be safe and he would let her out. She said she
paid for the ride because about 1/2 way through the ride he yelled to
her, "you have money for the ride, right?" She told him, yes. She gave
him a twenty dollar bill aad he gave her change.

I took the complaint and warrant to Judge M. DeCourcey for signing. Judge
DeCOUrcey changed the bail to $12,000.00. I then filed the case with the

WHEREAS, Mr. Randolph Cook was issued a Ta�cicab Driver's License (license ID No. 45560)
by the City of Saint Paul, 4ffice of License, Inspections and Environmental Protectian; and
WHEREAS, Mr. Cook has a criminal history of gross misdemeanor convicrions for indecent
exposure including as follows: on or about June 25, 1997, Mr. Cook pled guilty to a gross misdemeanor
violation of Indecent Exposure; on or about November 24,1 495, Mr. Cook pled guilty to a gross
misdemeanor violation of Indecent Exposure; and
WHEREAS, Saint Paul Legislative Code Sec. 376.16 identifies requirements for the issuance of
TaYicab Driver's Licenses; including §376.16(e)(4) which states that a person "Shall have no nontra�c
gross misdemeanor or misdemeanor convictions in the last three (3) yeazs involving ... indecent
conduct."; and
WHEREAS, Saint Paul Legislative Code §310.06(b) also allows denial of a license when such
matters "indicate a lack of good moral character or fitness to engage in the licensed activity.", or when
"the activities of the licensee in the licensed activity ereated or have created a serious danger to the
public health, safety or welfare, or the licensee performs or has performed his or her work or activity in
an unsafe manner." Now therefor,
BE IT RESOLVED, that the Tasicab Driver's License held by Randolph Cook (License ID No.
45560) is hereby revoked based on the ]icensee's convictions for Indecent Exposure.
This resolution and the action of the Council in this matter are based upon the facts contained in
the Notice of Denial of License Renewal Application to the licensee, and such arguments as may have
been presented to the Council at the public hearing. The facts were not contested by the licensee.

The Office of License, Inspections and Environmental Protection is recommending deniai of your
renewal application for taxicab driver's license. This action is based on the following:
On or about June 25, 1997, pou pled guilty to the violation of Indecent
Eaposure. On or about November 29,1995, yon pled guilty to the violation of
Indecent Ezposure. On or about January 31, 1995, you pled guilfy to two
violations of Indecent Egposure. The above conduct are gross misdemeanor
violations of the law, and constitute grounds under Section 376.16(e)(4) of the
Saint Paul Legislative Code for denial of your license application.
Section 376.16(e)(4) of the Saint Paul Legislative Code does not permit the issuance of a license to
a person having a gross misdemeanor or misdemeanor conviction in the previous three yeazs
involvingindecentconduct
Section 310.06 of the Legislative Code also allows denial of a license when such matters indicate
a lack of good moral character or fitness to engage in the licensed activity.
Under state law, Minn. Stat ch. 364, the City of Saint Pau1 must inform you of certain matters:
First, the grounds and reasons for the denial of the license. These grounds and
reasons aze sei forth above.

Second, any compiainu or grievances that you may have wili be processed and
adjudicated in accordance with the procedures set forth in section 310.05 of the Saint (rr"'4 ��
Paul Legislafive Code. These procedures are substandally similar to those required
by the state administrative procedures act, Minn. Stat. §§ 14.57-.69.
T'hird, the earliest date on which you may reapply for a taxi driver's license will be
one yeaz from the later of the following two dates: (1) the date of your successful
completion of supervised probation, �n�ith a copy of the department of corrections
dischazge order and other documents showing compliance with all terms and
conditions of probation; or (2) the date, pursuant to section 310.02 of the Legislative
Code, your license is denied by the City of Saint Paul. Future reception of a re-
application does not guu that there will be sufficient evidence of rehabilitation,
nor that a license wili be issued at that time.
Fourth, if you reappiy, the City of Saint Paul wiil consider all competent evidence
of rehabilitafion that you wish to present. Examples of the type of evidence that will
be considered aze set forth in secrion 364.03 of the state law.
Since the proposed denial of your reneu�al application for a license is an adverse action, you are
entitied to the hearing procedures established in sec6ons 310A5 and 310.06 of the Saint Paul
Legislative Code. You or your attorney will have to make a written request for a hearing if you wish
to contest the denial of your renewal application.
Hearing Procedures:
If you contest the facts stated above in bold type, a hearing on the
facts will be heazd before an administrative law judge, whose findings
and recommendafions will be given to the St. Paul City Council for
a final determination. If you choose to exercise your right to an
administrative hearing, the Office of License, Inspections and
Environmental Protection will also submit a recommendarion to the
judge to recover the cost of the hearing. You may then be held
responsible for the cost of the administrative hearing.
If you do not wish to contest the facts stated above in bold type, but

I went to the jail annex_to_ talk to the suspect. I advised him of his
rights by use of form PM 247.1. He said he understood the rights 2 read
to him and he signed the form. He identified himself as Randolph George
Cook, date of birth 8-23-54.
He told me he would not-talk to me until he talked to an attorney. The
interview waws terminated.

5-21-97 0745� Indecent Conduct
I called Marilyn Saclolo at her home. She said when he stopped his cab
and offered her a ride he didn't say anything about paying £or the ride.
Before they started moving he turned to her ,as she sat in the back seat
and said to her that she_was a very pretty girl. He at the same time
grabbed her hand. She jerked away and sat as far back as she could. He
tried again to grad lier hand but he missed.
He then drove west on University. About two blocks later he leaned way
back in his seat and pulled his 'dick' out and began to masturbate his
'dick'. She could see that it was his penis that he had in his hand. He
asked her if she had ever seen a cadillac and told her he was rock hard.
She said he then leaned down and put his head between his legs. What she
saw and interpreted was that he was trying to suck his own ' dick'. She
said he was trying to steer the car with his knee while he had his.head
down. He did this for several blocks. During the ride the car was
swerving all over University from curb to median. She said he dida't stop
until they pulled into the Midway_Center. She had him let her off near
MeDonalds. He wanted to take near the front door but ahe was aEraid to be
seen by anyoae. --
She said she was frightened the whole way but thought that if she kept
her mouth shut she might be safe and he would let her out. She said she
paid for the ride because about 1/2 way through the ride he yelled to
her, "you have money for the ride, right?" She told him, yes. She gave
him a twenty dollar bill aad he gave her change.

for 5:30 p.m., Wednesday, July 22,1998, and will be held in the City Council Chambers, Third
Floor, Saint Paul City Hall and Ramsey County Courthouse.

CiTy Council for their consideration. This is an uncontested hearing based in that the facts
concerning your convictions involving indecent exposure have not been disputed. The
recommendarion of the licensing office is for the immediate revocation of your Taxicab Driver's
license.
