REGISTERED LAND SURVEY APPROVAL
WHEREAS, Glacier Park Company has submitted the attached proposed Registered Land
Survey, located at the south end of Stella Street between Como Avenue and the
Burlington Northern railroad tracks, for City Council approval; and
WHEREAS, the appropriate City departments have reviewed the proposed Registered
Land Survey; and
WHEREAS, the proposed Registered Land Survey has been determined to meet the
requirements of Section 67 of the zoning code; �nd
WHEREAS, the proposed Registered Land Survey has been implemented to define the
legal boundaries of this site,
' NOW, THEREFORE, BE IT RESOLVED; �that the City Council accepts and approves this
Registered Land Survey; and
BE IT FURTHER RESOLVED, that this approval of the Registered Land Survey does not
indicate that the City Council approves any development of this site unless this
property is platted as per City standards.

A. PURPOSE: To consider approval of a registered land survey (RLS) that
will create two tracts, one of which will be used for the University of
Minnesota intercampus transitway.
B. SITE � AREA CONDITIONS: This property of approximately 3.2 acres
consists of a generally flat paved area used for bus storage and vacated
Stella Street at its western edge. The adjacent properties to the north
and east are developed for industrial uses. To the south is the
Burlington Northern mainline tracks. The School District Service
Facility is located to the west.
C. BACKGROUND: The applicant is in the process of selling the proposed
Tract A to the State Fair which will use the land for parking during the
fair. Tract A will probably be used by Medicine Lake Lines for bus
parking during the rest of the year, as is adjacent property. Tract B
will be used for the U of M intercampus transitway which will cross over
the railroad tracks to the south on a bridge. This bridge will extend
onto Tract B. The transitway will cross Como Avenue at grade.
The western half of the existing Stella Street right-of-way will be used
for the transitway bridge and right-of-way. Property to the east of the
existing Stella Street ROW is being acquired for a new, realigned Stella
Street with cul-de-sac. Construction on this phase of the transitway is
� expected to begin on March 1, 1992.
� There are several issues related to utilities that the City's Department
of Public Works should coordinate with transitway planners. The Port
Authority constructed a large storm sewer through Tract B in 1984.
Public Works will want an easement for this sewer from the University--
the intended owner of Tract B. The easement cannot be required as a
condition of RLS approval. In addition, the Department of Fire and
Safety Services wants to see a fire hydrant installed at the southernmost -
end of realigned Stella Street �

D. DISTRICT COUNCIL POSITION: The Saint Anthony Park Community Council
voted at its December 11, 1991 board meeting to recommend approval of the
proposed RLS.
E. REOUIRED FINDINGS:
1. AI1 the applicable provisions of the Legislative Code are complied
with.
City staff have reviewed the proposed RLS and determined that it meets
all requirements and standards of the City.
2. The proposed subdivision wi11 not be detrimental to the present and
potentisl surrounding Zand uses.
The property is and will be developed with uses compatible with the area.
3. The area surrounding the subdivision can be planned and developed in
coordination and compatibility with the proposed subdivision.
The development of the property and surrounding area can be coordinated
and compatible.
4. The subdivision is in conformance with the Comprehens�ve P1an.
The property and proposed uses are in compliance with the comprehensive
plan for this area of the city.
5. The subdivision preserves and incorporates the site's important
existing natural features, whenever possible.
The proposed property lines are similar to� existing property boundaries
and will not affect the site's natural features. The site appears to
have few, if any, significant natural features.
6. AIZ Zand intended for building sites can be used safely without
endangering the residents by peril from floods, erosion, continuously
high water table, severe soil conditions or other menace.
The land can be safely developed for use as intended.
7. The subdivision can be economically served with public facilities and
services.
The tracts can be served by public facilities and services.
F. STAFF RECOIYIIrIENDATION: Based on the above findings, staff recommends
approval of the proposed registered land survey.

The review of the above referenced proposal has been completed. The
Department of Public Works has �o objection to the approval of the
RLS subject to the following recommendation:
A utility easement for sewer purposes must be recorded by separate
document for the existing public storm sewers south of Stella Street
as depicted on the attached drawings. Please contact Peter lJhite in
the Real Estate Division of the Finance Department, 292-5317, to initiate
the easement process.
If the current property owner is unwilling to give us the requested
easement, the future property owners should be advised of the existing
10 foot s�orm sewer and the need for a 60 foot easement through this
a rea.
