91-2320 ����-; L �� Council File # f j .�---�� � Green Sheet # RESOLUTION f I O INT PAUL, MINNESOTA ;.��� Y��LL�,, ��� � � ,, Presente By Referred Committee: Date RESOLVED, that the Into�cicating Liquor On Sale, Sunday On Sale Liquor, Entertainment, Restaurant and Catering licenses held by Bilco Inc., dba Billy's on Grand for the premises at 857 Grand Avenue in Saint Paul are hereby suspended for a period of seven consecutive day(s), provided that two of the days of suspension are stayed for a period of until July 17, 1993 (which is a period of 30 months from the first violation on January 17, 1991), with the five days actual suspension to take place on the second Sunday following publication of this resolution. The conditions of the stay for the two days are as follows: 1. The licensee shall prepare a new set of policies within 60 days from the date of this Resolution, and submit such policies to this Council for review and approval after having submitted them to the License Division for its review and comments. This requirement is a condition of the two days's stay of suspension. 2. The licensee shall adopt a policy of uniform carding, which shall require all employees to card every person seeking to purchase an alcoholic beverage at the licensed establishment before the sale is made. By agreement of the licensee, this condition is not only a condition of the stay of two days' suspension, but is also incorporated into the on-sale into�ucating liquor licenses held by the above licensee as a condition of the continuation of such licenses. The facts as outlined in the police report were not contested by the licensee, as evidenced by the attached letter signed by William T. Wengler, President. The action taken is also based on the facts, circumstances and arguments presented by and on behalf of the licensee during the public hearing. This action represents a downward departure from the presumptive penalty in Section 409.26 of the Saint Paul legislative Code. The reasons for such departure are that the licensee did in fact implement the procedures he outlined in his letter of February 11, 1991; that the establishment is large and has many employees, making it more difficult to control all such employees; that it is a high volume business; and that the licensee has agreed to accept a condition upon his intoxicating liquor licenses that will require the carding of every person who seeks to purchase an alcoholic beverage in the establishment. Please note that both of the conditions that the Council imposed relate to the two days' stay, but that the second condition on uniform carding also becomes a condition on the license. The License Division should print a new license for Billys which has this condition on its face, and put that into their computer so that it will repeat itself on renewals of the license. Dear Mr. Wengler: Enclosed is a copy of the City Council Resolution that suspends all of your City of Saint Paul Licenses for seven (7) consecutive days with two of the seven days stayed for a period of 30 months. This resolution was passed by the City Council in verbal form after the Public Hearing that was held on November 19, 1991. The resolution is scheduled to be adopted in final written form on December 19, 1991. There is no need for you to be present and the matter is not scheduled as a public hearing. If the resolution is adopted as expected on the 19th of December it will be published in the Lega1 Ledger on December 28, 1991. As a result the suspension will be effective Sunday, January 5, 1992 and will run through and include Thursday, January 9, 1992. THIS MEANS THAT YOUR ESTABLISHMENT MUST BE CLOSED TO THE PUBLIC ON JANIIARY STH, 6TH, 7TH, STH, AND 9TH, 1992. Failure to comply with the City Council's order is grounds for license revocation.
