RESOLVED, that the Intoxicating Liquor On Sale (License ID #16168), and
Sunday On Sale Liquor licenses held by Hunan Inc., dba Hunan Garden for the premises
at 380 Cedar Street in Saint Paul are hereby suspended for a period of three consecutive
days, provided that one of the days of suspension is stayed for a period of eighteen
months, with the two days of actual suspension commencing on January 19, 1992 for the
violation of "Sale of alcoholic beverages to a Minor". The Entertainment, Restaurant,
and Cigarette licenses are not suspended, and the establishment may remain open and
provide the services allowed under these licenses during the period that the liquor
licenses are suspended. During the two days of suspension the licensee must post a
notice of the reasons for the suspension of the liquor license, said notice to contain the
language established by the License Inspector.
This Resolution and the action taken above are based upon the facts contained in
the attached police report dated September 27, 1991. The facts as outlined in the police
report are not contested by the licensee, as evidenced by the attached letter signed by
Maurice Fung, President. The action taken is also based on the facts, circumstances and
arguments presented by and on behalf of the licensee during the Public Hearing. This
action represents a downward departure from the presumptive penalty in Section 409.26
of the Saint Paul legislative Code. The reasons for such departure are that the
establishment has had no prior liquor license related violations, they have recently re-
emphasized their underage sales controls to a11 employees, and that the employee
involved was working his last day at the establishment and was careless, as outlined in its
letter dated December 2, 1991. This action also departs from prior policy of suspending
all licenses held by the establishment. The deviation from this policy is based on the fact
that this establishment is primarily a restaurant business and the severe economic

Dear sir,
It is astonishing to me to receive your letter in regard
to one of our employees , Remy Jovenal serving a beer to a
minor . The date of incidence happens to be Remy' s last
date of employment . He told us he ' s leaving Hunan for Las
Vegas to work for his family a week before the incidence .
Remy has been working for Hunan since 1982 and has been
careful carding bar patrons . His carelessness to check
that particular person is due to his emotional leave of
Hunan on his last �ay. "It is our practice in Hunan to
check our patrons for identification. We do not encourage
sale of liquor as most places do because we are a food
establishment . We normally close our bar one hour after
the closing of our dining rooms( that is around 11 : 00 to
11 : 30 p.m. ) After the incidence, I have stressed the im-
portance of ID checking to all our employees and also sign
with ID requirement �efore purchase is also posted at conspica.��:s
place .
Please accept our apology. We are not contesting this
violation and hope a lower penalty will be advised to the
council . Since it is a liquor violation, is there a possibilty
that the penalty be on only the liquor license and not on
the food license . Thank You.

Dear sir,
It is astonishing to me to receive your letter in regard
to one of our employees , Remy Jovenal serving a beer to a
minor. The date of incidence happen,s to be Remy' s last
date of employment . He told us he ' s leaving Hunan for Las
Vegas to work for his family a week before the incidence.
Remy has been working for Hunan since 1982 and has been
careful carding bar patrons . His carelessness to check
that particular person is due to his emotional leave of
Hunan on his last day. It is our practice in Hunan to �
check our patrons for identification. We do not encourage
sale of liquor as most places do because we are a food
establishment . We normally close our bar one hour after
the closing of our dining rooms( that is around 11 :00 to
11 : 30 p.m. ) After the incidence, I have stressed the im-
portance of ID checking to all our employees and also sign
with ID requirement vefore purchase is also posted at conspici��s
place .
Please accept our apology. We are not contesting this
violation and hope a lower penalty will be advised to the
council . Since it is a liquor violation, is there a possibilty
that the penalty be on only the liquor license and not on
the food license. Thank You.
