CITY OF SAINT PAUL, MINNESOTA Presented By Referred To Committee: Date OF THE COUNCIL OF THE CITY OF SAINT PAUL APPROVING THE REDEVELOPMENT PLAN, ENERGY PARK WHEREAS: A. By Resolution C.F. No. 276898, adopted May 26, 1981, the Council of the City of Saint Paul, pursuant'to Minnesota Statues, Chapter 472A (recodified as Sections 469.124 to 469.134) established Energy Park Development District for the purposes stated in said statute and resolution and by Resolution C.F. No. 88-2008 adopted December 21, 1988 added the Twin City Testing Development Area to the Energy Park Development District for the purposes stated in said resolution (herein collectively referred to as the "Municipal Development District") . B. By Resolutions 1499, 1535, 1609, 1607 and 1827 the Port Authority of the City of Saint Paul (the "Port Authority") pursuant to Minnesota Statutes Chapters 458 (recodified as Sections 469.048 to 460.068) established approximately the same geographic area as the Energy Park Development District as Energy Park Economic/Industrial Development District and by Resolution 3028 created the Twin City Testing Industrial and Economic Development District (herein collectively the "Industrial Development District") . C. By Resolution C. F. No. 276900, the City Council, pursuant to Minnesota Statutes, Sections 273.71 to 273.78 (recodified as Sections 469.124 to 469.134) designated the Municipal Development District as a tax increment financing district (the "Tax Increment District") and adopted a Development Program and Tax Increment Financing Plan (the "Tax Increment Financing Plan") for the purpose of financing the capital and administrative costs of the Municipal Development District, as amended by Resolution 89-1466. D. By Resolution C.F. No. 276899, the City Council pursuant to Minnesota Statutes, Section 472A.10 (recodified as Section 469.131) designated the Port Authority as administrator of the Municipal Development District. E. By Resolution C.F. No. 276900, the City Council and by Resolution 1876 the Port Authority approved a Joint Powers Agreement for the Administration, Operation and Financing of the Energy Park Development and Tax Increment Financing District, dated August 18, 1981, which was amended by the Restated Joint Powers Agreement for the Administration, Operation and Financing of Energy Park and Twin City Testing Area Developments and Tax Increment �i���vll�l� 91-231b ✓ Financing Districts dated August 30, 1989, and approved by Resolution C. F. 89-1466 of the City Council and Resolution 3167 of the Port Authority (the "Joint Powers Agreement") . F. The City, Port Authority and Ryan St. Paul Limited Partnership (the "Developer") entered into a Development Agreement dated November 13, 1991, whereby the Developer undertook to acquire, rehabilitate and otherwise improve and redevelop, certain property located in the District ("the Development") , and the Port Authority and City undertook to issue or, if necessary, to cause the Housing and Redevelopment Authority to issue tax increment bonds in the approximate maximum principal amount of $5,000,000 to provide funds to reimburse the Developer for certain development costs. In order to issue these tax increment bonds, it is necessary to also issue (i) tax increment supported bonds in the approximate maximum principal amount of $1,800,000 to refund, in part, the Port Authority's Industrial Park Revenue Bond; and (ii) to issue revenue bonds in the approximate maximum principal amount of $900,000 to also refund, in part, the Industrial Park Revenue Bonds, and further approved the use of District land sales and lease revenues to secure payment of those bonds, and (the "Bor�ds") and the City and the Port Authority entered into a Second Restated Joint Powers Agreement to implement the provision of said Development Agreement. G. The City and Port Authority have requested the Housing and Redevelopment Authority to issue the Bonds and to enter into a Suppleraent to Second Amended and Restated Joint Powers Agreement to implement its financial support of the Development. H. The issuance of the Bonds will (i) in part refund Port Authority Bonds the proceeds of which were used to acquire and clear blighted property, provide necessary public and site improvements and to prepare District property to sell or lease for redevelopment, and (ii) in further part to assist redevelopment of the Development property by private enterprise, all within the meaning of Minnesota Statutes Section 469.002 Subd. 14. I. There has been presented to and considered at this meeting of the City Council a proposed Redevelopment Plan, Energy Park, which defines a Redevelopment Project Area approximating the area of the Municipal Development District, adopts the Development Program of the Energy Park Municipal Development District as the Redevelopment Plan of the Housing and Redevelopment Authority, spells out the implementation responsibilities of the Authority, the Port Authority as more particularly detailed in the above identified Joint Powers Agreements, and is supported by financial and relocation plans. J. The City Council has considered the reports of the Saint Paul Planning Commission, File No. 81-20, adopted June 26, 1981 finding that the Development Program for the Energy Park Development District, and File No. 88-80 adopted November 4, 1988, finding that the Development Program for Twin City Testing Area of the Energy Park Development District conform to the Saint Paul ' Comprehensive Plan, and Resolution No. 91-12/10 - � of the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota, adopted December 10, 1991 making certain findings and adopting the Redevelopment Plan, Energy Park. ��������Id1�. 91- 23i6 ,/ K. The Redevelopment Plan, Energy Park, when approved by the City Council,will provide a plan for the development or redevelopment of the Redevelopment Project Area defined in said Plan sufficiently complete to identify need for and statement of objectives .and program of the City and HRA for carrying out of a redevelopment project including property to be acquired, public improvements and facilities including open space to be provided, land use controls including proposed reuse of land for private redevelopment and other redevelopment project activities and operations consistent with the Development Program for the Municipal Development District and the Saint Paul Comprehensive Plan. L. On December 17, 1991, the City Council conducted a public hearing upon the Redevelopment Plan and project thereby proposed all after published notice of hearing in the Saint Paul Ledger on December 7, 1991, at which hearing the City Council heard testimony from all interested, and having considered the findings and determinations of the Planning Commission and Housing and Redevelopment Authority, and additional reasons and supporting facts, recited herein and in said Redevelopment Plan. • NOW THEREFORE, the Council of the City of Saint Paul having reviewed and considered the documents submitted and the recitals, representations and provisions contained therein, and having wieghed and considered testimony presented at the public hearing together with evidence developed in connection with previous Council consideration of the adoption and implementation of the Energy Park Municipal Development District, resolves l. It is hereby found and determined as follows: A) That the Redevelopment Plan, Energy Park (and Municipal Development District Program adopted by reference therein) and the Energy Park Redevelopment Project proposed thereby constitute a Redevelopment Plan within the meaning of Minnesota Statutes Section 469.002 Subd. 16 and a Redevelopment Project within the meaning of Section 469.002 Subd. 14. B) That the Development Property would not be made available without the financial assistance and bonding authorizations sought by the City of Saint Paul and Port Authority. C) That the Redevelopment Plan and development covered by the Development Agreement affords maximum opportunity consistent with the needs of the locality as a whole for redevelopment of the Pro�ect and property by private enterprise. D) That the Redevelopment Plan conforms to the Saint Paul Comprehensive Plan, the general plan for the community as a whole. �+K���1�11�►�. II. REDEVELOPMENT PLAN The Housing and Redevelopment Authority for the City of Saint Paul, Minnesota (hereinafter referred to as the "Housing and Redevelopment Authority") acting pursuant to Minnesota Statutes, Sections 469.001 through 469.047, inclusive, adopts as its Redevelopment Plan for the Energy Park Redevelopment Project the Development Program for the Energy Park Development District adopted by the Council of the City of Saint Paul pursuant to Minnesota Statutes, Chapter 472A (recodified as Minnesota Statutes, Sections 469.124 through 469.134, inclusive) on May 26, 1981 by Resolution, Council File No. 276898, as amended on December 20, 1988 by Resolution, Council File No. 88-2008. III. IMPLEMENTATION RESPONSIBILITIES The Area of the Energy Park Redevelopment Project and of the Energy Park Development District is also the approximate Area of the Energy Park Economic/Industrial Development District established by the�Port Authority of the City of Saint Paul. Said Authority and the City of Saint Paul executed a Joint Powers Agreement For The Administration, Operation and Financing Of The Energy Park Development And Tan Increment Financing District, dated August 18, 1981, and a Restated Joint Powers Agreement for the Administration, Operation and Financing of the Energy Park and Twin City Testing Area Developments and Tax Increment Financing Districts, dated August 30, 1989. In December 1991, the Port Authority and City of Saint Paul entered into a Second Amended and Restated Joint Powers Agreement for the Administration, Operation and Financing of the Energy Park and Twin City Testing Area Developments and Tax Increment Financing Districts. These Joint Powers Agreements (hereinafter referred to collectively as the "Joint Powers Agreements") place the responsibility for the implementation of the Energy Park Development District in the Port Authority. In connection with the implementation of the Development District the Port Authority and City of Saint Paul have requested the Housing and Redevelopment Authority to undertake the Energy Park Redevelopment Project and to enter into a Supplement To Second Amended And Restated Joint Powers Agreement with . 2 �I- 2316 ✓ said Port Authority and City (hereinafter refened to as the "Joint Powers Agreement Supplement") for the purpose of issuing certain conduit revenue bonds more fully identified in the Joint Powers Agreement Supplement to assist the Port Authority in its implementadon of the Development District and Economic/Industrial Development District and for the purpose of delegating to the Port Authority the responsibility for implementing the Energy Park Redevelopment Project. PART IV. FINANCING STATEMENT Financing of the Energy Park Redevelopment Project, Development District and Economic/Industrial Development District will be provided under the Energy Park Tax Increment Financing District and Energy Park Financing Plan Budget as amended and attached as Exhibit A and the Twin City Testing Tax Increment Financing District and Twin City Testing Financing Plan adopted by the Council of the City of Saint Paul on December 20, 1988 by Resolution, Council File No. 88-2008. PART V. �2EPORT OF 1� PLANIVING COMMISSION The City of Saint Paul Planning Commission (hereinafter referred to as the "Planning Commission") reviewed the Development Program for the Energy Park Development District in 1981 and in Planning Commission Resolution, File No. 81-20 found that it conforms to its general plans for the development and redevelopment of the City of Saint Paul. In 1988 the Planning Commission reviewed the Twin City Testing Development Program and in Planning Commission Resolution, File No. 88-80 found that the Twi.n City Testing Development Area Amendment to the Energy Park Development Plan and District to be consistent with the Comprehensive Plan of the City of Saint Paul. PART VI. RELOCATION PLAN Relocation of displace persons and businesses has been carried out by the Port Authority in accordance with the provisions and requirements of the Federal and State relocation statutes and implementing regulations.
