CITY OF SAINT PAUL, MINNESOTA Presented By � Referred To Committee: Date RESOLUTION MAKING CERTAIN DETERMINATIONS AND FINDINGS NECESSARY FOR ACQUISITION OF PROPERTY UNDER THE DAYTON'S BLUFF NEIGHBORHOOD HOUSING SERVICES, URBAN REVITALIZATION ACTION PROGRAM, DAYTON'S BLUFF DISTRICT 4 WHEREAS, the State of Minnesota has established, and allocated funds for the Urban Revitalization Action Program (URAP) to promote physical and economic redevelopment in neighborhoods of Saint Paul and Minneapolis threatened with deterioration; and WHEREAS, on September 11, 1987, the Planning Commission did by resolution recommend to the Mayor and City Council program guidelines entitled "Saint Paul Urban Revitalization Action Program Guidelines" as the statement of policy and process to guide the development and implementation of the revitalization program for Saint Paul neighborhoods; and WHEREAS, the Council of the City of Saint Paul did approve on September 23, 1987, by Resolution 87-1395, Guidelines for Implementation of the City of Saint Paul Urban Revitalization Action Program (URAP); and WHEREAS, the Saint Paul Capital Improvement Budget Committee, the Saint Paul Planning Commission, affected neighborhood district councils, neighborhood non-profit organizations and City staff participated in a review process of URAP proposal submissions in accordance with approved URAP guidelines; and WHEREAS, the Council of the City of Saint Paul did approve on March 22, 1990, by Resolution No. 90-389 certain activities and financing under the Dayton's Bluff Neighborhood Housing Services URAP proposal which includes acquisition, rehabilitation and clearance of blighting conditions in the area; and WHEREAS, the targeted neighborhood and the City have put forth an extensive effort to revitalize this area in the form of financial assistance in public undertakings and to private owners as a vital part of the economic stability and growth of the City just by virtue of its high visibility; and WHEREAS, the City of Saint Paut by the authority of the Urban Revitalization Action Program adopted by the Legislature was granted the power to engage in development or redevelopment activities by Chapter 469 of the Minnesota Statutes, and the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota, is authorized to engage in activities relating to: ��- � 3/ � 1. Housing projects and development (especially for low and moderate income people); 2. Removal of or prevention of the spread of conditions of blight or deterioration; 3. Bringing substandard buildings and improvements into compliance with public standards; 4. Disposition of land for private development; and 5. Improving the tax base and financial stability of the community, and engages in the aforementioned activities when these needs cannot be met through reliance solely upon private initiative and which can also be undertaken in targeted neighborhoods; and WHEREAS, Minnesota Statutes Chapter 469 gives a specific range of powers including the power to acquire land by the exercise of the power of eminent domain, sell land, engage in planning, employ a variety of financing instruments, and establish land use controls and additionally it requires that redevelopment projects and activities be devised according to a plan or program of which the Targeted Neighborhood Revitalization and Financing Program is a part and which areas were designated by City Council Resolution No. 87-1395; and WHEREAS, on December 12, 1991, the City Council conducted a public hearing on the proposed acquisition, in order that the property owners may attend and indicate their opposition or support for this proposed acquisition. NOW THEREFORE, BE IT RESOLVED by the Council of the City of Saint Paul in view of the foregoing hereby adopted as findings that the public acquisition by the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota (HRA) of the property identified as: 299 Maria, legally described as: Part of Lot Six (6) Dayton Place Addition to Saint Paul, according to the plat thereof on file and of record in the office of Register of Deeds in and for said County, said County, described as follows: Commencing at the most Northerly corner of said lot, being the point of intersection of Maria Avenue and East Third Street, thence Southwesterly along the Southerly line of East Third Street, 100 feet, to a point, thence Southerly parallel with Maria Avenue, 31.25 feet to a point, thence Northerly at right angles to last described line 49.20 feet to a point, thence Southeasterly at right angles to last described line 0.70 feet to the center line of a certain wall, thence Northeasterly along the center line of said wall 50 feet more or less to Maria Avenue, said point being 25.70 feet Southeasterly from the intersection of Maria Avenue and East Third Street, the point of beginning, thence in a Northwesterly direction along Maria Avenue to the point of beginning, together with an easement in the South half of that certain party wall above described, the center of which wall is the Southeasterly line of the property conveyed, and which wall is approximately 1.4 feet in width and 50 feet from front to back, subject to and reserving to the parties of the first part, a like easement in the North half of said party wall. in the Dayton's Bluff Neighborhood Housing Services URAP Project Area, Dayton's Bluff District 4 is hereby approved in accordance with the following: . . ��_ a ��o 1. That the Dayton's Bluff Neighborhood Housing Services Project Area approved under the Urban Revitalization Action Program and the City Wide Redevelop Plan, together with Minnesota Statutes 469.012(6)(7) which includes acquisition, clearance, or rehabilitation of blighted conditions to allow for new construction of housing for low/moderate income families together with acr�uisition, demolition or rehabilitation providing commercial improvements to afford maximum opportunity consistent with the sound needs of the community as a whole for the provision of creating new jobs, businesses and expansions providing economic stability for the area. 2. That, in accordance with the Housing and Community Development Act of 1974 and Minnesota Statutes 117.52, the acquiring authority shall provide all relocation assistance services, payments and benefits required by the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 as amended. 3. That acquisition of the properties herein described are hereby approved to be undertaken by the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota, by direct purchase or by the exercise of the power of eminent domain. 4. That pursuant to Chapter 548, Laws of Minnesota 1984, it is hereby certified that said properties meet the conditions of Minnesota Statutes Section 272.02, Subd. 1(7) and 469.040, Subd. 1 and are exempt from property taxes until sold for private redevelopment. (DBNHS) submitted a URAP application which the City Council approved March 22, 1990. Their proposal focused on the East Third and Maria area and called for the redesign of the East Third Street Gateway stressing improvements to the areas appearance and viability. Project activities included the elimination of blighting influences and underutilized commercial space, assembly of land for residential development, establishment of a user-friendly commercial node, providing off-street parking and completion of an attractive streetscape. The proposal specifically identified thirteen (13) parcels for acquisition. (See attached map and parcel description.) Eight (8) parcels were identified for housing development, three (3) parcels were identified for off-street parking and two (2) parcels were identified for a neighborhood retail center. CURRENT STATUS Assembly of the parcels for the neighborhood retail center at the Country Club Market site have been completed. This Spring the site was advertised for development proposals, but none were received. Currently, the site has been graded, seeded and future advertising for commercial development will be contingent upon improved market conditions. Appraisals have been secured on six (6) of the eight (8) housing development parcels. HRA staff have been in communication with the owners of two parcels (299 Maria and 289 Maria), and options have been tendered on both properties. The owner of 289 Maria has signed an option. That property, with a purchase price of $124,200, is a one-story commercial structure that currently is housing two business operations. The owner of the second property, 299 Maria, Glass Bar, has not accepted HRA staff's option and it is unlikely that further negotiations will result in a friendly purchase. If these negotiations, are fruitless, it will be essential to commence eminent domain proceedings to acquire this property within 90 - 120 days. HRA staff will continue negotiations on this property in the hopes of reaching an agreement prior to finalizing any condemnation proceedings. RECOMMENDATlONS Staff is requesting authorization to acquire 289 and 299 Maria. Staff is further requesting that if they are unsuccessful in achieving a friendly purchase of 299 Maria, they be authorized to schedule a public hearing before the City Council to commence condemnation and 90 day Quick Take Action. The funding to undertake the entire project involving the acquisition of these two properties is through the URAP with matching CDBG funds in the approved amount of$1,114,500. James Zdon _ RESOLUTION NO. 91- RESOLUTION AUTHORIZING ACQUISITION OF PARCELS 289 MARIA AND 299 MARIA, DAYTON'S BLUFF NEIGHBORHOOD HOUSING SERVICES, URBAN REVITALIZATION ACTION PROGRAM, DAYTONS BLUFF DISTRICT 4 WHEREAS, the Minnesota State Legislature, in 1987, adopted the Urban Revitalization Action Program (URAP), which is the first new initiative to assist Saint Paul revitalize its neighborhoods in the 1980s, funded through a 1987 state initiative and matched by City resources (CDBG) the program aims to ensure a strong and improving future for those neighborhoods that are most distressed by physical deterioration and lack of economic opportunity; and WHEREAS, in the third cycle of URAP funding in 1990, Dayton's Bluff Neighborhood Housing Services submitted a URAP application which the City Council approved March 22, 1990; and WHEREAS, the City Council did approve on March 22, 1990 by Resolution 90-389, certain activities and financing under the Dayton's Bluff Neighborhood Housing Services URAP Phase II proposal which includes acquisition, rehabilitation and clearance of blighting conditions in the area; and WHEREAS, the City of Saint Paul by the authority of the Urban Revitalization Action Program adopted by the legislature granted the power to engage in development or redevelopment activities from Chapter 469 of the Minnesota Statutes, Housing and Redeve�opment Act, and that the Housing and Redevelopment Authority of the City of Saint Paul, is authorized to engage in activities relating to: 1) housing projects arrd development (especially for low and moderate incomes people); Their proposal focused on the East Third and Maria area and called for the redesign of the East Third Street Gateway stressing improvements to the areas appearance and viability. Project activities included the elimination of blighting influences and underutilized commercial space, assembly of land for residential development, establishment of a user-friendly commercial node, providing off-street parking and completion of an attractive streetscape. The proposal specifically ident'ified thirteen (13) parcels for acquisition. (See attached map and parcel description.) Eigh# (8) parcels were identified for housing development, three (3) parcels were identified for off-street parking and two (2) parcels were identified for a neighborhood retail center. CURRENT STATUS Assemb�y of the parcels for the neighborhood retail center at the Country Club Market site have been completed. This Spring the site was advertised for development proposals, but none were received. Currently, the site has been graded, seeded and future advertising for commercial development will be contingent upon improved market conditions. Appraisals have been secured on six (6) of the eight (8) housing development parcels. HRA staff have been in communication with the owners of two parcels (299 Maria and 289 Maria), and options have been tendered on both properties. The owner of 289 Maria has signed an Y option. Ttiat property, with a purchase price of $124,200, is a one-story commercial structure that currently is housing two business operations. The owner of the second property, 299 Maria, Glass Bar, has not accepted HRA staff's option and it is unlikely that further negotiations will result in a friendly purchase. If these negotiations, are fruitless, it will be essential to commence eminent domain proceedings to acquire this property within 90 - 120 days. HRA staff have been in communication with the owners of two parcels (299 Maria and 289 Maria), and options have been tendered on both properties. The owner of 289 Maria has signed an . ✓ option. That property, with a purchase price of$124,200, is a one-story commercial structure that currently is housing two business operations. The owner of the second property, 299 Maria, Glass Bar, has not accepted HRA staff's option and it is unlikely that further negotiations will result in a friendly purchase. If these negotiations, are fruitless, it will be essential to commence eminent domain proceedings to acquire this property within 90 - 120 days. HRA staff will continue negotiations on this property in the hopes of reaching an agreement prior to finalizing any condemnation proceedings. RECOMMENDATIONS Staff is requesting authorization to acquire 289 and 299 Maria. Staff is further requesting that . if they are unsuccessful_in achieving a friendly purchase of 299 Maria, they be authorized to schedule a public hearing before.the City Council to commence condemnation and 90 day Quick Take Action. WHEREAS, in the third cycle of URAP funding in 1990, Dayton's Bluff Neighborhood Housing Services submitted a URAP application which the City Council approved March 22, 1990; and WHEREAS, the City Council did approve on March 22, 1990 by Resolution 90-389, certain activities and financing under the Dayton's Bluff Neighborhood Housing Services URAP Phase II proposal which includes acquisition, rehabilitation and clearance of blighting conditions in the area; and WHEREAS, the City of Saint Paul by the authority of the Urban Revitalization Action Program adopted by the legislature granted the power to engage in development or redevelopment activities from Chapter 469 of the Minnesota Statutes, Housing and Redevelopment Act, and that the Housing and Redevelopment Authority of the City of Saint Paul, is authorized to engage in activities relating to: 1) housing projects ana development (especially for low and moderate incomes people); 2) removal of or prevention of the spread of conditions of blight or deteriorations; 3) bringing substandard buildings and improvements into compliance with public standards; 4) disposition of land for private dev�lopment; and 5) improving the tax base and the financial stability of the community, and engages in the aforementioned activities when these needs cannot be met through reliance solely upon private initiative and which can also be undertaken in targeted neighborhoods; and WHEREAS, the Act gives a specific range of powers including the power to acquire land, sell land, engage in planing, employ a variety of financing instruments, and establish land use controls and additionally, it requires that redevelopment projects and activities be devised according to a plan or program of which the Targeted Neighborhood Revitalization and Financing Program is a part and which areas were designated by City Council Resolution 87- 1395.
