This property is legally described as follows, to wit: Lot 42, Block 7 Bachman Addition WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by the Division of Public Health on or before September 4, 1991 the following are the now known interested or responsible parties for the Subject Property: Marguerik A. I.edo, 1480 Sterling Avenue So., St. Paul, MN 55119; 7ames Savage, Address Unknown; Carrie 7o Savage, Address Unknown; Rose Marie Walter, 1480 Sterling Avenue South, St. Paul, MN 55119; Kathleen 7ohnson, 1279 Ripley Avenue, St. Paul, MN 55109; Ed Hitchcock, Fiitchcock Law Firm, 1465 Arcade Street, St. Paul, MN 55106; Ramsey County Property Taxation, C/O Beatrice Backer, 15 Kellogg Blvd. W. #138, St. Paul, MN 55102 WHEREAS, the Division of Public Health has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" (aka: Abandoried Building Notice with Dangerous Accessory Structure) dated August 27, 1991 which is attached and incorporated as part of this Resolution; and WI�REAS, the order informed the then known interested or responsible parties that the house and garage located on the Subject Property is a nuisance building(s) pursuant to Sections 45.02, Subd. 8 and a nuisance pursuant to Chapter 45.03 Subd. 7; and WHEREAS, this order informed the interested or responsible parties that they must either repair or demolish the structure located on the Subject Property by September 27, 1991; and WHEREAS, an extension was granted on September 27, 1991 until October 26, 1991; and � WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition, subject to demolition; and ��������� WI�REAS, this nuisance condition has not been conected and the Division of Public � Health has requested that the City Clerk schedule public hearings before the Neighborhood �I"%/a.?Y'�2 Services Committee of the Cit y Council and the Saint Paul Cit y Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of theses public hearings; and WI�REAS, a hearing was held before the Neighborhood Services Committee of the Saint Paul City Council on Wednesday, December 4, 1991 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request by the Division of Public Health to order the interested or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remQVe its blighting influence on the community by rehabilitating this structure in accordance with all applicable codes and ordinances, Qr in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within�tq.(.�9�of the date of the publication of this resolution; and �:��f{�,, C,s) WHEREAS, a hearing was held before the Saint Paul City Council on Tuesday, December 10, 1991 and a11 testimony and evidence including the action taken by the Neighborhood Services Committee was considered by the Council; and NOW THEREFORE, BE IT RESOLVED, that based upon all of the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 1566 Point Douglas Road South: 1. That the building(s) located on the Subject Property comprise a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45.02 Subd.8. 2. That the costs of demolition and removal of this building(s) is estimated to exceed three thousand dollars ($3,000.00). 3. That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) (aka: Abandoned Building Notice with Dangerous Accessory Structure) was sent to the then known responsible parties to conect the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been conected. 6. That the Division of Public Health has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. 7. That this building has been routinely monitored by the Vacant/Nuisance Buildings Code Enforcement Program. 8. That the known interested parties and owners are as previously stated in this resolution and that they have been properly served notice of the public hearings. -2- �������� RDER .. �-���.�Z �� ✓ The Saint Paul City Council hereby makes the following order: 1. The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfaze and remove its blighting influence on the community by rehabilitating this structure and correcting all deficiencies as prescribed in the above � referenced Order to Abate Nuisance Building(s) (aka: Abandoned Building Notice with Dangerous Accessory Structure) in accordance with all applicable codes and ordinances, c�r in the alternative by.demolishing and removing the . structure in accordance with all applicable codes and ordinances. If the above corrective action is not completed within this period of time the City of Saint Paul, Division of Public Healtti is hereby authorized to take whatever steps are necessary to demolish and remove this structure and fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Section 45.08 of the Saint Paul Legislative Code. 3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which shall unreasonably interfere with the demolition and removal shall be removed from the building by the responsible parties by the end of this time period. If the personal property is not removed, tfie City of Saint Paul shall remove and dispose of such property and fixtures as is provided by law. 4. The ordinance further states that an abandoned building and a dangerous structure are both nuisances and may be ordered demolished and removed by the City. NOTICE: If you do not want to have the City begin action to have the buildings torn down, then the attached list of deficiencies must be repaired or you must demolish and remove the buildings on or before September 27, 1991. If you are unable to finance the conection or rehabilitation of the premises to comply with this order, there are state and local rehabilitation programs for which you may qualify. Information about these programs is available from the Department of Planning and Economic I�evelopment, Rehabili.tat�on Section at (612) 228-3105. Ask to speak to a loan officer. If you sell, transfer or cunvey, in any manrier, the ownership or responsibility for this property, you must within seven ('n days of such action, provide the Division of Public Health with the names and addresses of any new owners or responsible parties. You must also notify any new owners or responsible parties of this pending action by the Division of Public Health. Any repair or demolition must be completed in accordance will all applicable laws. If the rehabilitation work is not completed or if you have not demolished and removed the house and detached, deteriorated, dangerous garage by the above date, the Division of Public Health will refer this matter to the City Council to receive authority to have the house and the detached, deteriorated, dangerous garage demolished and removed. All costs incuned in wrecldng and removing the buildings will be charged against the real estate as a special assessment to be collected in the same manner as taxes. The City Council will schedule public hearings to consider the necessity and advisability of ordering the buildings repaired or demolished and removed. The date for compliance with these orders shall not be extended unless you receive written approval from the Division of Public Health. - If you wish to have the City demolish and remove your house and the detached, deteriorated, dangerous garage, you may do so by requesting a consent form be sent to you from our office to sign and return to the Division of Public Health. Permits must be obtained where changes and/or additions to an electrical system require upgrading of the service size to current National Electrical Code (N.E.C.) requirements. Some plumbing repairs may necessitate updating of the fixtures and/or piping involved. A permit is required for any repair or new installation. Permits may be obtained from the Building Inspection and Design Division, Room 445, City Hall. - REMEDIAL ACTION _ The below list of deficiencies is not necessarily all the de�iciencies present in the above referenced property. �As first remedial action, a Code Compliance Inspection must be obtained from the Building Inspection and Design Division, Room 445, City Hall, identifying all necessary repairs. Electrical Service l. TherP is a 60 amp service to a 100 amp panel. 2. The electrical service is cut at the pole. 3. The wiring, outlets and fixtures have improper installation of non-metallic sheathed cable. Plumbing System 4. There is an uncapped drain in the unfinished addition. 5. The gas piping on the exterior is disconnected. 6. The exterior oil tank is disconnected. 7. The well pump head is damaged and improperly wired. Attic (viewed from the outside) 8. Appears warped, off kilter, with rotted ends. Lack of proper roofing indicates continuing moisture damage.
