WHEREAS, the Division of Public Health has requested the City Council to hold
public hearings to consider the advisability and necessity of ordering the repair or wrecking
and �emoval of the two story, wood frame, dilapidated, deteriorated, condemned, hazardous,
single family residential structure located on property hereinafter refened to as the "Subject
Property" and commonly known as 430 Minnehaha Avenue East This property is legally
described as follows, to wit:
The West 16 2/3 feet of Lot 6, and the East lb 2/3 feet of Lot 7, Block 8,
Warren and Winslow's Addition to St. Paul
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by the Division of Public Health on or before September 12, 1991,
the following are the now known interested or responsible parties for the Subject Property:
First Nationwide Bank, C/O Phil Black, REO Department, P.O. Box 340910, Sacramento,
CA 95834; O'Neill, Burke, O'Neill, Leonard and O'Brien, Ltd, 800 Norwest Center, 55
East Sth Street, St. Paul, MN 55101;
WHEREAS, the Division of Public Health has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order
to Abate Nuisance Building(s)" (aka: Dangerous Structure Notice) dated September 24, 1`991
which is attached and incorporated as part of this Resolution; and
WHEREAS, the order informed the then known interested or responsible parties that
the house located on the Subject Property is a nuisance building(s) pursuant to Sections
45.02, Subd. 8 and a nuisance pursuant to Chapter 45.03 Subd. 7; and
WHEREAS, this order informed the interested or responsible parkies that they must
either repair or demolish the structure located on the Subject Property by October 9, 1991,
and
WHEREAS, an extension was granted on October 2, 1991 until October 23, 1991;
and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition, subject to demolition; and

WHEREAS, this nuisance condition has not been conected and the Division of Public
Health has requested that the City Clerk schedule public hearings before the Neighborhood
Services Committee of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in
accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time,
date, place and purpose of theses public hearings; and
WHEREAS, a hearing was held before the Neighborhood Services Committee of the
Saint Paul City Council on Wednesday, December 4, 1991 to hear testimony and evidence,
and after receiving testimony and evidence, made the recommendation to approve the request
by the Division of Public Health to order the interested or responsible parties to make the
Subject Property safe and not detrimental to the public peace, health, safety and welfare and
remove its blighting influence on the community by rehabilitating this structure in accordance
with all applicable codes and ordinances, or in the alternative by demolishing and removing
the structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition of the structure to be completed within fifteen (15) days of the date of the
publication of this resolution; and
WHEREAS, a hearing was held before the Saint Paul City Council on Tuesday,
December 10, 1991 and all testimony and evidence including the action taken by the
Neighborhood Services Committee was considered by the Council; and
NOW THEREFORE, BE IT RFSOLVED, that based upon all of the testimony and
evidence presented at the above referenced public hearings, the Saint Paul City Council
hereby adopts the following Findings and Order concerning the Subject Property at 430
Minnehaha Avenue East:
1. That the building(s) located on the Subject Property comprise a nuisance
condition as defined in Saint Paul Legislative Code, Chapter 45.02 Subd.8.
2. That the costs of demolition and removal of this building(s) is estimated to
exceed three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) (aka: Dangerous Structure
Notice) was sent to the then known responsible parties to correct the
deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That the Division of Public Health has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.

7. That this building has been routinely monitored by the Vacant/Nuisance
Buildings Code Enforcement Program.
8. That the City of Saint Paul has had to board accessible openings at the subject
property.
9. That the known interested parties and owners are as previously stated in this
resolution and that they have been properly served notice of the public
hearings.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject
Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating
this structure and conecting all deficiencies as prescribed in the above
referenced Order to Abate Nuisance Building(s) (aka: Dangerous Structure
Notice) in accordance with all applicable codes and ordinances, or in the
alternative by demolishing and removing the structure in accordance with all
applicable codes and ordinances. The rehabilitation or demolition and removal
of the structure must be completed within fifteen (15) days of the date of the
publication of this resolution.
2. If the above conective action is not completed within this period of time the
City of Saint Paul, Division of Public Health is hereby authorized to take
whatever steps are necessary to demolish and remove this structure and fill the
site and charge the costs incuned against the Subject Property pursuant to the
provisions of Section 45.08 of the Saint Paul Legislative Code.
3. In the event the building is to be demolished and removed by the City of Saint
Paul, all personal property or fixtures of any kind which shall unreasonably
interfere with the demolition and removal sha11 be removed from the building
by the responsible parties by the end of this time period. If the personal
property is not removed, the City of Saint Paul shall remove and dispose of
such property and fixtures as is provided by law.

last known address of the owners and interested parties in accordance with
Section 45.11, Subd.6 of the Saint Paul Legislative Code.

The City of Saint Paul, Division of Public Health has declared this building(s) to constitute a
"nuisance" as defined by Legislative Code, Chapter 45. The Division has issued an order to
the then known responsible parties to eliminate this nuisance condition by correcting the
deficiencies or by razing and removing this building(s).
Inasmuch as this Order to Abate (aka: Dangerous Structure Notice) has not been complied
with the nuisance condition remains unabated, the community continues to suffer the
blighting influence of this property. It is the recommendataon of the Division that the City
Council pass a resolution ordering the responsible parties to either repair, or demolish and
remove this building in a timely manner, and failing that, authorize the Division to proceed
to demolition and removal, and to assess all costs incurred against the real estate as a special
assessment to be collected in the same manner as taxes.

structure, which Chapter 45 of the Saint Paul Legislative Code defines as:
"any strueture which is potentially dangerous to persons or property including but not
limited to:
(a) a structure which is in danger of partial or complete collapse; or
(b) a structure which has any exterior parts such as chimneys, eaves, porches,
siding, railings, or trim which are loose or in danger of falling; or
(c) a structure which has any parts such as porches, stairs, ramps, rails, balconies,
or roofs which are accessible and which aze either collapsed, in danger of
collapsing, or unable to support a person."

The Ordinance further states that a dangerous structure is a nuisance and it may be ordered
to be demolished and removed by the City. If you do not want to have the City begin action
to have the building demolished and removed you are hereby notified that the attached list of
deficiencies must be repaired or you must have the building demolished and removed on or
before October 9, 199L
If you are unable to finance the conection or rehabilitation of the premises to comply with
- this order, there are state and local rehabilitation programs for which you may qualify.
Information about these programs is available from the Department of Planning and
Economic Development, Rehabilitation Section at (612) 228-3105. Ask to speak to a loan
officer.
If you sell, transfer or convey, in any manner, the ownership or responsibility for this
property, you must within seven ('n days of such action, provide the Division of Public
Health with the names and addre.sses of any new owners or r�sponsible parties.
You must also notify any new owners or responsible parties of th�s pe�rli.ug a�tio� by
the Divisivn of Public Health.
Any repair or demolition must be completed in accordance with all applicable laws.
If the work is not completed or if you have not had the building demoiisheci ar�d r.errzo�e� by
the above date, the Division of Public Health will refer this matter to the City Council to
receive authority to demolish and remove the building. All costs incurre� in t,`�e wrecldng the
building will be charged against the real estate as a special assessment to be collected in the
same manner as taxes. The City Council will scheflule public hearings to consider if the
building should be demolished and removed. If public hearings becomes necessary, you
will be notified of the times and dates of the hearings and you will be allowed to present
evidence to the City Council. A copy of this order will be kept on file in the City Clerk's
Office and a Resolution declaring this property to be a nuisance shall be on file in the
Ramsey County Recorder's Office. Compliance with the attached list of deficiencies will
remove your building from the list of dangerous structures, but it does not mean that the
building complies with all applicable housing and building codes.
The date for compliance with these orders shall not be extended unless you receive written
approval from the Division of Public Health.

If you wish to have the City demolish and remove your building, you may do so by
requesting a consent from be sent to you from our office to sign and return to the Division of
Public Health. However, please be aware that all owners and interested parties must sign a
Consent to Raze form before the City can demolish and remove the building without a Ciry
Council order. Also be aware that the cost of the demolition if performed by the City,
would become a special assessment against the property.

All repairs and new installations must be made in accordance with the appropriate codes.
Permits must be obtained where changes and/or additions to an electrical system require
upgrading of the service size to current National Electrical Code (N.E.C.) requirements.
Some plumbing repairs may necessitate updating of the fixtures and/or piping involved. A
permit is required for any repair or new installation. Pernuts may be obtained from the
Building Inspection and Design Division, Room 445, City Hall.
- RF.MF.nIAL ACTION
The below list of deficiencies is not necessarily all the deficiencies present in the above
referenced property. As fust remedial action, a Code Compliance Inspection must be
obtained from the Building Inspection and Design Division, Room 445, City Hall,
identifying all nece�ssary repairs.
The Inspector was un.�ble to access the interior of the building at ±hi� time.
Fxterior
1. The front porch is HAZARDOUS, the support beams are deteriorated, the roof is
pulling away from the house, the floor is rotting and sagging and the porch area is
improperly supported.
2. The foundation has missing mortar with large gaps around ground level.
3. The east side siding is falling away from the building.
4. The door frames are rotted, deteriorated and defective. The doors are boarded and
the east side porch is missing. .
5. The window frames are deteriorated and the storms are missing.
6. The eaves and trim is rotted and deteriorated with portions missing.
7. The front half of the roof has missing and deteriorated shingles.
8. The rain gutters have been removed.
9. The basement stairwell (south side), sidewalls are crumbling and missing parts of the
rock and mortar. The steps are rotting and deteriorated.

We are extending the compliance date which was on the Dangerous Structure Notices which
were issued to you and dated September 24, 1991. This letter is your official notice of the
extension. Please be aware that the repairs in the Dangerous Structure Notices must be
complied with. Only the deadline for compliance is being changed to October 23, 1991.
NOTE: If you have not completed the repairs to the structure or received approval from the
Heritage Preservation Commission to raze the structure by December 1, 1989, the Division
of Public Health will request a public hearing before the City Council to obtain permission to
raze the structure.

Legislative Code relating to Abatement of Nuisance Buildings.
RECOMMEND APPROVAL
4. Resolution - ordering the owner to remove or complete the repair of the
referenced building, located at 721 Seventh Street East. If the owner
fails to comply with this resolution, the City will be authorized to
remove the building. (Laid over from November 20, 1991.)
