easement recorded as document no. 1802200 on July l, 1971 over.

descr. ibed as follows: Beginning at a point on the West
line of Block 4 , Clark and Wilgus Addition distant 285
feet North of the Southwest corner of said Block 4;
thence North on the West line of said Block 4 to a point
180 feet South of the Northwest corner of said Block 4
thence East and par.allel with the North line of said
Block 4 to the East line of said Block 4; thence South
along the East line of said Block 4 ; thence
Southwesterly along the Northwesterly line of Brainerd

This c,etter was first heard et the August 20, 1970, Board ot Zoain� meecing�
at Whicfi time it Was noteJ that the rezoning proceeded fruW the discovery of a
Z�niag Code viola[ion. There was diacusaion sbout the posaibility of �the
structure b�ing a legal noa-conforming use and vhether a negetive easemeat could
limit this rezoning to a12ow anly the exiating 5-plex structure. The matter �:as
lai� over to obtsin an,opinion from the Corporation Ceunael as to: 1) �ich
�arty has the "burden of proof", end 2) if negative eaaements are effective in
Li�iting rezonings. •
At the September 17, 1970, �seeting it vas noted thst the Corpotation Counael
determia�d that the "burdea of proof" vas npon ttre Cizy in this csae, and tl�st a
negstive easement can limit the use under the rezoning to the preaent 5 uaiea and
