Council File �� - /7lI Green Sheet �� RESOLUTION CITY OF SAINT PAUL, II�IINNFSOTA Presented By Referred To Committee: Date WHEREAS, the state should not cut aid to local governments while restricting their ability to make cuts and function within a reduced budget; and NOW, THEREFORE, BE IT RESOLVED, the City of Saint Paul should support changes in Minnesota Statutes 134.34, Subd. 4 that would accomplish two things: (1) provide an exception to the maintenance of local effort requirement when a local unit as experienced a reduction in local government aid; and/or (2) provide special legislation to address particular difficulties that local governments experience. (3) provide special legislation to consider other funding, such as, capital improvement funds, private donations and other special funds during years of particular difficulties that local governments experience. FINANCIAL IMPACT Although you must tailor the information you provide here to the issue you are addressing, in general you must answer two questions: How much is it going to cost?Who is going to pay? ��i���7d � MELSA FUNDING BRIEFING PAPER Background - Each year the State Department of Education (Office of Library Development and Services) appropriates funds to the state' s regional library systems. The Saint Paul Public library is a member of the MELSA regional library system. To participate in MELSA, the City of Saint Paul must meet the requirements of "maintenance of effort" as defined in Minnesota Statute 134 . 4 , Subd. 4 . This requirement states that the library must receive at least the same General Fund Budget amount as the previous year. If this doesn't happen, the Library is ineligible to receive MELSA funding or even to participate in the MELSA system. There are two areas that would be affected if the City of Saint Paul fails to meet the current requirement of "maintenance of effort" : User impact. o Saint Paul residents would be denied borrowing privileges at the eight other MELSA library systems without an annual fee of $45. 00. Metro residents living outside of Saint Paul would be unable to access Saint Paul 's services as well. o Reciprocal reference services would be unavai�able. o Reciprocal agreements for application of library cards would discontinue. o MELSA, a model for sharing, cooperation and collaboration, will be eliminated at a time when elected officials are advocating an increase in such programs. Fundina lost. o In 1991, Saint Paul received $128, 459 from MELSA for services provided to residents of other MELSA library systems, for the purchase of library materials and for the sharing of materials with other library systems. The Library would be ineligible for these funds in 1992 . o Funding of almost $700, 000 for automation improvements would be lost. o The Saint Paul Public Library would be obligated to return assets of furniture, equipment and books purchased during the last three years with state and federal funds valued at approximately $700, 000. o The Saint Paul Public Library would not be able to apply � �9i�i��� for a number of Federal Grants. o $244 , 000 in funding for fiscal year 1992 from the State Office of Library Development and Services to continue facilitating interlibrary loan between all Minnesota public libraries would be lost. Issue Although the statute provides an exception to this "maintenance of local effort" requirement when the adjusted net tax capacity of a local jurisdiction decreases, it does not currently recognize decreases in Local Government Aid. This sends a mixed message to local governments who are told by the state that decreases in state aid are warranted because local spending is "out of control" while penalizing the local unit for making the spending cuts that are necessary as a result. In addition, the current statute in not consistent with the federal maintenance of effort requirement. Federal maintenance of effort requires that the second preceding year of general fund spending for library services be the prerequisite level for receipt of state funds. Representative Simoneau introduced a bill last session that would have accomplished this but it was not seriously pursued. There is a good chance that the Department of Education would not oppose this change, which adds greatly to the probability of success. The LGA change, however, promises to be much more controversial . This is a problem for Minneapolis and they will be seeking legislative changes as a top priority next session. Recommendation The City of Saint Paul should support changes in Minnesota Statutes 134 . 34 , Subd. 4., as follows: A regional library basic system support grant shall not be made to a regional public library system for a participating city or county which decreases the dollar amount provided for support for operating purposes of public library service below the amount provided by it for the second preceding year.
