CITY OF SAINT PAUL, MINNESOTA Presented By ' Referred To Committee: Date 1Y RESOLUTION MAKING CERTAIN DETERMINATIONS AND FINDINGS NECESSARY FOR ACQUISITION OF PROPERTIES UNDER THE EAST SIDE NEIGHBORHOOD DEVELOPMENT COMPANY, URBAN REVITALIZATION ACTION PROGRAM, PAYNE-PHALEN DISTRICT 5 WHEREAS, the State of Minnesota has established, and allocated funds for the Urban Revitalization Action Program (URAP) to promote physical and economic redevelopment in neighborhoods of Saint Paul and Minneapolis threatened with deterioration; and WHEREAS, on September 11, 1987, the Pianning Commission did by resolution recommend to the Mayor and City Council program guidelines entitled 'Saint Paul Urban Revitalization Action Program Guidelines" as the statement of policy and process to guide the development and implementation of the revitalization program for Saint Paul neighborhoods; and WHEREAS, the Council of the City of Saint Paul did approve on Septembe� 23, 1987, by Resolution 87-1395, Guidelines for Implementation of the City of Saint Paul Urban Revitalization Action Program (URAP); and WHEREAS, the Saint Paul Capital Improvement Budget Committee, the Saint Paul Planning Commission, affected neighborhood district councils, neighborhood non-profit organizations and City staff participated in a review process of URAP proposal submissions in accordance with approved URAP guidelines; and WHEREAS, the Council of the City of Saint Paul did approve on February 23, 1989, by Resolution No. 89-212 certain activities and financing under the East Side Neighborhood Development Company URAP proposal which includes acquisition, rehabilitation and clearance of blighting conditions in the area; and WHEREAS, the targeted neighborhood and the City have put forth an extensive effort to revitalize this area in the form of financial assistance in public undertakings and to private owners as a vital part of the economic stability and growth of the City just by virtue of its high visibility; and WHEREAS, the City of Saint Paul by the authority of the Urban Revitalization Action Program . adopted by the Legislature was granted the power to engage in development or redevelopment activities by Chapter 469 of the Minnesota Statutes, and the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota, is authorized to engage in activities relating to: ORIG1 ��4-=- ���-a�� 1. Housing proje.cts and development (especialiy for low and moderate income people); 2. Removal of or prevention of the spread of conditions of blight or deterioration; 3. Bringing substandard buildings and improvements into compliance with public standards; 4. Disposition of land for private development; and 5. Improving the tax base and financial stability of the community, and engages in the aforementioned activities when these needs cannot be met through reliance solely upon private initiative and which can also be undertaken in targeted neighborhoods; and WHEREAS, Minnesota Statutes Chapter 469 gives a specific range of powers including the power to acquire land by the exercise of the power of eminent domain, sell land, engage in planning, employ a variety of financing instruments, and establish land use controls and additionally it requires that redevelopment projects and activities be devised according to a plan or program of which the Targeted Neighborhood Revitalization and Financing Program is a part and which areas were designated by City Council Resolution No. 87-1395; and WHEREAS, on November 26, 1991, the City Council conducted a public hearing on the proposed acquisition, in order that the property owners may attend and indicate their opposition or support for this proposed acquisition. NOW THEREFORE, BE IT RESOLVED by the Council of the City of Saint Paul in view of the foregoing hereby adopted as findings that the pubtic acquisition by the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota (HRA) of the property identified as: 908 Payne Avenue, legally described as: The North 25 feet of the South 75 feet of Lots 16 and 17, Block 27, Joseph P. Weide's Subdivision of Block 27, Arlington Hills Addition in the East Side Neighborhood Development Company URAP Project Area, Payne-Phalen District 5 is hereby approved in accordance with the following: 1. That the East Side Neighborhood Development Company Project Area approved under the Urban Revitalization Action Program and the City Wide Redevelop Plan, together with Minnesota Statutes 469.012(6)(7) which includes acquisition, clearance, or rehabilitation of blighted conditions to allow for new construction of housing for low/moderate income families together with acquisition, demolition or rehabilitation providing commercial improvements to afford maximum opportunity consistent with the sound needs of the community as a whole for the provision of creating new jobs, businesses and expansions providing economic stability for the area. 2. That, in accordance with the Housing and Community Development Act of 1974 and Minnesota Statutes 117.52, the acquiring authority shall provide all relocation assistance senrices, payments and benefits required by the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 as amended. That acquisition of the properties herein described are hereby approved to be undertaken by the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota, by direct purchase or by the exercise of the power of eminent domain. 4. That pursuant to Chapter 548, Laws of Minnesota 1984, it is hereby certified that said properties meet the conditions of Minnesota Statutes Section 272.02, Subd. 1(7) and 469.040, Subd. 1 and are exempt from property taxes until sold for private redevelopment. NOW, THEREFORE BE IT RESOLVED by the Housing and Redevelopment Authority of the City of Saint Paul, in view of the foregoing hereby adopted as findings that the public acquisition of the property identified as: 908 Payne Avenue: The North 25' of the South 75' of Lots 16 and 17, Block 27, Joseph P. BACKGROUND • � In the second URAP cycie, the East Side Neighborhood Development Company (ESNDC) submitted a URAP application which the City Council approved on February 23, 1989. Their proposal contained a commercial component which identified a Redevelopment/Parking Assistance Program whereby URAP funds would be used to create new parking facilities in the Payne Arcade URAP area. ESNDC and the community council has subsequently identified 908 and 910 Payne as two�parcels to be acquired for the development of a commercial parking lot. In 1990, ESNDC acquired 910 Payne but has run into problems in their attempt to acquire the abutting parcel at 908 Payne. CURRENT STA7US Parcel 908 Payne is a 3-story commercial building located on the east side of Payne Avenue between York and Sims. The building, originally constructed in 1883, contains a first floor store with rear apartment, two apartments on the second floor and one third floor unit. The � building area is approximately 3,100 square feet and sits on a site of approximately 1,762 square feet. In February, 1991, ESNDC entered into a purchase�agreement to acquire 908 Payne for$45,000. ESNDC, however, was not able to close on the purchase when the seller indicated to them she could not provide marketable title. Title to the property is clouded by multiple property interests and an outstanding bankruptcy proceeding by one of the possible owners. In August, 1991, ESNDC requested HRA's assistance in acquiring the property. (See attached letter.) After researching the title problems, staff believes the cleanest method ✓ -� . . for clearing the title and putting the property into ESNDC's possession is through eminent domain. ESNDC supports this recommendation. . RECOMMENDATION Staff is requesting authorization to schedule a public hearing before City Council concerning the acquisition of 908 Payne Avenue. That subject to City Council approval, staff will be authorized to commence condemnation and 90 day quick take action on this property. The funding to undertake this activity is through the URAP with matching city CDBG funds in the approved amount of$2.1 million. A resolution is attached for your consideration. " i L .__� zj� _ "�y i� ir �c I �l�f«� �.� �2� �� �a � �� . r r ` . ... * .a.- �.r c,ua nna�x ww.00Orriumrt m� . . .� !'\� _1_�/�... � � ' RESOLUTION NO. 91-11/12- RESOLUTION TO SCHEDULE A PUBLIC HEARING BEFORE CITY COUNCIL AND SUBSEQUENTLY PROCEED WITH ACQUISITION OF 908 PAYNE AVENUE, EAST SIDE NEIGHBORHOOD DEVELOPMENT COMPANY, URBAN REVITALIZATION ACTION PROGRAM, PAYNE PHALEN DISTRICT 5 WHEREAS, the Minnesota State Legislature in 1987 adopted the Urban Revitalization Action Program (URAP) to assist Saint Paul revitalize its neighborhoods, funded through a 1987 state initiative and matched by City resources (CDBG), the program aims to ensure a strong and improving future for those neighborhoods that are most distressed by physical deterioration and lack of economic opportunity; and WHEREAS, in the second cycle of URAP funding, the East Side Neighborhood Development Company (ESNDC) submitted an application allowing for the acquisition and demolition of substandard properties to provide for new parking facilities; and � WHEREAS,the City Council did approve on February 23, 1989 by Resolution No. 89-212 certain activities and financing under the Concentrated East Side Renewal URAP project; and WHEREAS, in order to have a more visible impact, the residential and commercial revitalization activities of this URAP concentrated acquisition in an area bounded by Case Avenue, York Street, Edgerton and Payne Avenue; and WHEREAS,ESNDC and the Community Council have identified various properties for acquisition as part of its Redevelopment/Parking Assistance Program; and WHEREAS, the property at 908 Payne is a substandard commercial building which ESNDC wishes to acquire, demolish and develop into a surface parking lot; and WHEREAS, ESNDC entered into a purchase agreement for 908 Payne but did not close because the seller could not provide marketable title; and WHEREAS, the acquisition and development of this property is considered by the community to be critical to the overall success of the Concentrated East Side Renewal URAP project and ESNDC has requested the HRA's assistance to acquire 908 Payne; and 11uHEREAS, in order to proceed with the acquisition of this vacant property, certain action must be taken by scheduling a Public Hearing before City Council to establish the findings for the acquisition of 908 Payne Avenue. NOW, THEREFORE BE IT RESOLVED by the Housing and Redevelopment Authority of the City of Saint Paul, in view of the foregoing hereby adopted as findings that the public acquisition of - the property identified as: 908 Payne Avenue: The North 25' of the South 75' of Lots 16 and 17, Block 27, Joseph P. Weide's Subdivision of Block 27, Arlington Hills Addition. ; ��i,�i � _ .� in the Concentrated East Side Renewal URAP Project Area, Payne Phalen District 5 is hereby approved in accordance with the foilowing: 1. That the Concentrated East Side Renewal Project Area under the URAP Program which includes acquisition and clearance of blighting conditions to allow for new construction of housing for low/moderate income families,together with rehabilitation and commercial improvements wiil afford maximum opportunity, consistent with the sound needs of the community as a whole, for the provision of creating new jobs, businesses and providing economic stability for the area. 2. That in accordance with the Housing and Community Development Act of 1974 and Minnesota Statute 117.52 all acquisitions undertaken by an acquiring Authority, which Authority shall provide all relocation assistance, services, payments and benefits for the URAP Program areas, if required, in accordance with the Uniform Relocation Assistance and Real Property Acquisition Act of 1970, as amended. 3. That, acquisition of the property herein described is hereby approved by direct purchase or exercise the power to eminent domain, subject to a Public Hearings before the City Council. � 4. That, pursuant to Chapter 548, Laws of Minnesota 1984, it is hereby certified that said property meets the condition of Minnesota Statutes Section 272.02, Subdivision 1,clause � (7) and 469.040, Subdivision 1, until sold for private redevelopment is exempt from property taxes. � 5. That acquisition of the property herein identified is necessary in order to remove conditions of blight which exist in the Concentrated East Side Renewal Project Area. 6. That a Public Hearing will be scheduled before the Saint Paul City Council to consider findings and make a determination necessary to acquire this property. 7. That subject to the Public Hearing and approval by the City Council, the HRA is hereby authorized to commence condemnation and a Ninety-Day-Quit Take on this property. 8. BACKGROUND in the second URAP cycle, the East Side Neighborhood Development Company (ESNDC) submitted a URAP appiication which the City Councii approved on February 23, 1989. Their proposal contained a commercial component which identified a Redevelopment/Parking Assistance Program whereby URAP funds would be used to create new parking facilities in . the Payne Arcade URAP area. ESNDC and the community council has subsequently ident�ed 908 and 910 Payne as finro�parcels to be acquired for the development of a commercial parking lot. In 1990, ESNDC acquired 910 Payne but has run into probiems in their attempt to acquire the abutting parcel at 908 Payne. CURRENT STA7US Parcel 908 Payne is a 3-story commercial building located on the east side of Payne Avenue between York and Sims. The building, originally constructed in 1883, contains a first floor store with rear apartment, two apartments on the second floor and one third floor unit. The building area is approximately 3,100 square feet and sits on a site of approximately 1,762 square feet. In February, 1991, ESNDC entered into a purchase agreement to acquire 908 Payne for$45,000. ESNDC, however, was not able to close on the purchase when the seller indicated to them she could not provide marketable title. Title to the property is clouded by multiple property interests and an outstanding bankruptcy proceeding by one of the possible owners. In August, 1991, ESNDC requested HRA's assistance in acquiring the property. (See attached letter.) After researching the title problems, staff believes the cleanest method for clearing the title and putting the property into ESNDC's possession is through eminent domain. ESNDC supports this recommendation. RECOMMENDATION Staff is requesting authorization to schedule a public hearing before City Council concerning the acquisition of 908 Payne Avenue. That subject to City Council approvai, staff will be authorized to commence condemnation and 90 day quick take action on this property. The funding to undertake this activity is through the URAP with matching city CDBG funds in the approved amount of$2.1 million. A resolution is attached for your consideration.
