WHEREAS, the Division of Public Health has requested the City Council to hold
public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a two story, wood frame, fire damaged, deteriorated, residential structure
with.a dilapidated, nuisance detached garage located ori property hereinafter refened to as
the "Subject Property" and commonly known as 1093 Reaney Avenue This property is
legally described as follows, to wit:
Lot 20, Block 9, Terry's Addition to the City of St. Paul .
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by the Division of Public Health on or before September 26, 1991, the
following are the now known interested or responsible parties for the Subject Property:
I,axman S. Sundae, 6433 20th Avenue, Richfield, MN 55423; Ramsey County Property
Taxation, c/o 7ames Parker, 109 Courthouse, St. Paul, MN 55102;
WHEREAS, the Division of Public Health has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order
to Abate Nuisance Building(s)" (Abandoned Building Notice with a Nuisance Accessory
Structure) dated September 18, 1991 which is attached and incorporated as part of this
Resolution; and
WHEREAS, the order informed the then known interested or responsible parkies that
the buildings located on the Subject Property is a nuisance building(s) pursuant to Sections
45.02, Subd. 8 and a nuisance pursuant to Chapter 45.03 Subd. 7; and
WHEREAS, this order informed the interested or responsible parties that they must
either repair or demolish the structure located on the Subject Property by October 18, 1991;
and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition, subject to demolition; and
WHEREAS, this nuisance condition has not been conected and the Division of Public
Health has requested that the City Clerk schedule public hearings before the Neighborhood
Services Committee of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in
accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time,
date, place and purpose of theses public hearings; and

WHEREAS, a hearing was held before the Neighborhood Services Committee of the
Saint Paul City Council on Wednesday, November 20, 1991 to hear testimony and evidence,
and after receiving testimony and evidence, made the recommendation to approve the request
by the Division of Public Health to order the interested or responsible parties to make the
Subject Property safe and not detrimental to the public peace, health, safety and welfare and
remove its blighting influence on the community by rehabilitating this structure in accordance
with all applicable codes and ordinances, Q in the alternative by demolishing and removing
the structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition of the structure to be completed within seven ('� days of the date of the
publication of this resolution; and
WHEREAS, a hearing was held before the Saint Paul City Council on Tuesday,
November 26, 1991 and all testimony and evidence including the action taken by the
Neighborhood Services Committee was considered by the Council; and
NOW THEREFORE, BE IT RESOLVED, that based upon all of the testimony and
evidence presented at the above referenced public hearings, the Saint Paul City Council
hereby adopts the following Findings and Order concerning the Subject Property at 1093
Reaney Avenue:
1. That the building(s) located on the Subject Property comprise a nuisance
condition as defined in Saint Paul Legislative Code, Chapter 45.02 Subd.8.
2. That the costs of demolition and removal of this building(s) is estimated to
exceed three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) (Abandoned Building Notice with
a Nuisance Accessory Structure) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been conectetl.
6. That the Division of Public Health has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Vacant/Nuisance
Buildings Code Enforcement Program.
8. That the City of Saint Paul has had to board accessible openings at the subject
property.
9. That the known interested parties and owners are as previously stated in this
resolution and that they have been properly served notice of the public
hearings.

ORDER
The Saint Paul City Council hereby makes the following order:
� 1. The above referenced interested or responsible parties shall make the Subject
Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating
this structure and correcting all deficiencies as prescribed in the above
referenced Order to Abate Nuisance Building(s) (Abandoned Building Notice
with a Nuisance Accessory Structure) in accordance with all applicable codes
and.ordinances, or in th alternative by deinolishing and removing the structure
in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within seven ('�
days of the date of the publication of this resolution.
2. If the above corrective action is not completed within this period of time the
City of Saint Paul, Division of Public Health is hereby authorized to take
whatever steps aze necessary to demolish and remove this structure and fill the
site and chazge the costs incurred against the Subject Property pursuant to the
provisions of Section 45.08 of the Saint Paul Legislative Code.
3. In fhe event the building is to be demolished and removed by the City of Saint
Paul, all personal property or fixtures of any kind which shall unreasonably
interfere with the demolition and removal sha11 be removed from the building
by the responsible parties by the end of this time period. If the personal
property is not removed, the City of Saint Paul shall remove and dispose of
. such property and fixtures as is provided by law.
4. IT IS FUR1'HER ORDERED, that a copy of this resolurion be mailed to the
last known address of the owners and interested parties in accordance with
Section 45.11, Subd.6 of the Saint Paul Legislative Code.

dilapidated, nuisance detached garage.
Terry's Addition to the City of St. Paul, County of Ramsey, State of Minn. Lot 20
Blk 9.
Dear Sir or Madam:
The Division•of Public Health has determined that the above noted building is an abandoned
building, which Chapter 45 of the Saint Paul Legislative Code defines as:
"any building or portion of a building which has stood with an incomplete exterior
shell for longer than three (3) years or any building or portion thereof which has
stood unoccupied for longer than one (1) year and which meets one or more of the
following criteria;
(a) Unsecured, or
(b) boarded, or
(c) having multiple exterior Housing Code or Building Code violations, or
(d) placarded as "Unfit for Human Habitation" pursuant to Chapter 34 of the Saint
Paul I,egislative Code."
The ordinance further states that an abandoned building is a nuisance and may be ordered
demolished and removed by the City.
The Division of Public Health has also determined that there is an additional nuisance on this
property in the form of a deteriorated, dilapidated detached garage accessory to the above
noted building. Chapter 45 of the Saint Paul I,egislative Code defined a nuisance as:

"any substance, matter, emission, or thing which creates a dangerous or
unhealthy condition or which threatens the public peace, heaith, safety, or
sanitary condition of the city or which is offensive or has a blighting influence
on the community and which is found upon, in, being discharged or flowing
from any street, alley, highway, r�ilroad right of way, vehicle, railroad car,
water, excavation, building, erection, lot, grounds, or other property located
within the City of Saint Paul."
NOTICE: If you do not want to have the City begin action to have the buildings torn
down, then the attached list of deficiencies must be repaired or you must demolish and
remove the buildings on or before October 18, 1991.
The date for compliance with these orders shall not be extended unless you receive written
approval from the Division of Public Health.
If the rehabilitation work is not completed or if you have not demolished and removed the
house and the nuisance detached garage by the above date, the Division of Public Health will
refer this matter to the City Council to receive authority to have the house and the nuisance
detached garage demolishe� and removed. All costs incurred in wrecking and removing the
buildings will be charged against the real estate as a special assessment to be collected in the
same manner as taxes. The City Council will schedule public hearings to consider the
necessity and advisability of ordering the buildings repaire� or demolished and removed. If
public hearings become necessary, you will be notified of the times and dates of the hearings
and you will be allowed to present evidence to the City Council.
Any repair or demolition must be completsd in accordance will all applicable laws.
If you are unable to finance the con�ection or rehabilitation of the premises to comply with
this order, there are stat� and local rehabilitation programs for which you may qualify.
Information about these programs is available from the Department of Planning and
Economic Development, Rehabilitation Section at (612) 228-3105. Ask to speak to a loan
officer.
If you wish to have the City demolish and remove your house and the nuisance detached
garage, you may do so by requesting a consent form be sent to you from our office to sign,
notarize and return to the Division of Public Health. However, please be awaze that all

owners and interested parties must sign a Consent to Raze form before the City can demolish
and remove the buildings without a City Council order. Also be awaze that all costs of the
demolition, if performed by the City, would become a special assessment against the

ff you sell, transfer or convey, in any manner, the ownership or responsibility for this
property, you must within seven ('n days of such action, provide the Division of Public
Health with the names and addresses of any new owners or responsible parties.
You must also notify any new owners or responsible parties of this pending action by
the Division of Public Health.
A copy of this order will be kept on file in the City Clerk's Office and a resolution declaring
this.property to be a nuisance shall be on file in the Ramsey Counry Recorder's Office.
Compliance with the attached list of deficiencies will remove your building from the list of
abandoned buildings but it does not mean that the buildings comply with all applicable
housing and building codes.

All repairs and new installations must be made in accordance with the appropriate codes.
Permits must be obtained where changes and/or additions to an electrical system require
upgrading of the service size to current Nationai Electrical Code (N.E.C.) requirements.
Some plumbing repairs may necessitate updating of the fixtures and/or piping involved. A
permit is required for any repair or new installation. Permits may be obtained from the
Building Inspection and Design Division, Room 445, City Hall.
REMEDIAL ACTION
The below list of deficiencies is not nec�sarily all the deficiencies present in the above
referenced property. As first remedial action, a Code Compliance Inspection must be
obtained from the Building Inspection and Design Division, Room 445, City Hall,
identifying all necessaiy repairs.
Exterior
1. The roof boards and rafters on the north west side are missing due to fire damage.
2. There are no handrails for the front porch steps and sidewalk step area leading to the
public walkway. The steps are cracked and uneven.
3. The rear stairway to the upper level has rotted and deteriorated wood.
4. The concrete foundation facing has loose concrete, is cracked and falling away.
5. The basement windows are boarded.
6. The grade around the house slopes into the north side foundation area.
7. The exterior wall areas have missing siding.
8. The exterior doors are boarded, deteriorated and rotting.
9. The windows are broken, boazded with missing frames, deteriorated and mtted wood.
10. The front porch floor is deteriorated and sagging, the side boards aze deteriorated.
11. There are holes in the soffits and eaves.
12. The roof covering has extensive fire damage.

13. The gutters and downspouts aze missing.
14. The flu pipe in the chimney is not visible, there are gaps in the brick and the chimney
needs tuck pointing.
15. The second floor north end and attic has extensive fire damage to the roof, rafters,
joists, interior walls and ceilings.
16. The second floor rear porch landing azea is sagging and uneven.
17. The poure� concrete azound the north and west side of the house is cracked and
buckling with bushes and trees growing up along side of the house.

19. The siding is cracked and missing.

The City of Saint Paul, Division of Public Health has declared this building(s) to constitute a
"nuisance" as defined by Legislative Code, Chapter 45. The Division has issued an order to
the then lrnown responsible parties to eliminate this nuisance condition by correcting the
deficiencies or by razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the "
recommendation of the Division that the City Council pass a resolution ordering the
responsible parties to either repair, or demolish and remove this building in a timely manner,
and failing that, authorize the Division to proceed to demolition and removal, and to assess
all costs incurred against the real estate as a special assessment to be collected in the same
manner as taxes.
