WHEREAS, the Division of Public Health has requested the City Council to hold
public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a two story, wood frame, deteriorated, dilapidated, condemned, duplex
residential structure located on property hereinafter refened to as the "Subject Property" and
commonly known as 41 7essamine Avenue West This property is legally described as
follows, to wit:
Lot 25, Block 5, Sdnson's Rice Street Addition to the City of St. Paul .
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by the Division of Public Health on or before September 26, 1991, the
following are the now known interested or responsible parties for the Subject Property: Louis
Tschida, 41 7essamine Avenue West, St. Paul, MN 55117; Mary L. Klas, Esq., Attorney at
Law, 746 Fairmount Avenue, St. Paul, MN 55105; Yehia l. Ibrahim, 1903 Silver Bell
Road, Suite 220, Eagan, MN 55122; Yehia lbrahim , 804 Northwestern 12th Street, Moore,
OK 73160; First Bank Saint Paul, 332 Minnesota Street, St. Paul, MN 55101; Ramsey
County Property Talcation, c/o 7ames Parker, 109 Courthouse, St. Paul, MN 55102
WHEREAS, the Division of Public Health has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order
to Abate Nuisance Building(s)" (Abandoned Building Notice) dated September 19, 1991
which is attached and incorporat.ed as part of this Resolution; and
WHEREAS, the order informed the then known interested or responsible parkies that
the house located on the Subject Property is a nuisance building(s) pursuant to Sections
45.02, Subd. 8 and a nuisance pursuant to Chapter 45.03 Subd. 7; and
WHEREAS, this order informed the interested or responsible parties that they must
either repair or demolish the structure located on the Subject Property by October 19, 1991;
and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition, subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and the Division of Public
Health has requested that the City Clerk schedule public hearin�gs before the Neighborhood
Services Committee of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in
accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time,
date, place and purpose of theses public hearings; and

WHEREAS, a hearing was held before the Neighborhood Services Committee of the
Saint Paul City Council on Wednesday, November 20, 1991 to hear testimony and evidence,
and after receiving testimony and evidence, made the recommendation to approve the request
by the Division of Public Health to order the interested or responsible parties to make the
Subject Property safe and not detrimental to the public peace, health, safety and welfare and
remove its blighting influence on the community by rehabilitating this structure in accordance
with all applicable codes and ordinances, Q in the alternative by demolishing and removing
the structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition of the structure to be completed within fourteen (14) days of the date of the
publication of this resolution; and
WHEREAS, a hearing was held before the Saint Paul City Council on Tuesday,
November 26, 1991 and all testimony and evidence including the action taken by the
Neighborhood Services Committee was considered by the Council; and
NOW THEREFORE, BE IT RFSOLVED, that based upon all of the testimony and
evidence presented at the above referenced public hearings, the Saint Paul City Council
hereby adopts the following Findings and Order concerning the Subject Property at 41
7essamine Avenue West:
1. That the building(s) located on the Subject Property comprise a nuisance
condition as defined in Saint Paul Legislative Code, Chapter 45.02 Subd.8.
2. That the costs of demolition and removal of this building(s) is estimated to
exceed three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) (Abandoned Building Notice) was
sent to the then known responsible parties to correct the deficiencies or to
demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That the Division of Public Health has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Vacant/Nuisance
Buildings Code Enforcement Program.
8. That the City of Saint Paul has had to board accessible openings at the subject
property.
9. That the known interested parties and owners are as previously stated in this
resolution and that they have been properly served notice of the public
hearings.

RDER
The Saint Paul City Council hereby makes the following order:
� 1. The above referenced interested or responsible parties shall make the Subject
Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating
this structure and conecting all deficiencies as prescribed in the above
referenced Order to Abate Nuisance Building(s) (Abandoned Building Notice)
in accordance with all applicable codes and ordinances, Q in the alternative by
demolishing and removing the structure in.accordance with all applicable codes
and ordinances. The rehabilitation or demolition and removal of the structure
must be completed within fourteen (14) days of the date of the publication of
this resolution.
2. If the above conective action is not completed within this period of time the
City of Saint Paul, Division of Public Health is hereby authorized to take
wliatever steps are necessary to demolish and remove this structure and fill the
site and charge the costs incuned against the Subject Property pursuant to the
provisions of Section 45.08 of the Saint Paul Legislative Code.
3. In Che event the building is to be demolished and removed by the City of Saint
Paul, all personal property or fixtures of any kind which shall unreasonably
interfere with the demolition and removal shall be removed from the building
by the responsible parties by the end of this time period. If the personal
property is not removed, the City of Saint Paul shall remove and dispose of
such property and fixtures as is provided by law.
4. IT IS FURTHER ORDERED, that a copy of this resolution be mailed to the
last known address of the owners and interested parties in accordance with
Section 45.11, Subd.6 of the Saint Paul Legislative Code.

Dear Sir or Madam:
The Division of Public Iiealth has determined that the above noted building is an abandoned
building, which Chapter 45 of the Saint Paul Legislative Code defines as:
"any building or portion of a building which has stood with an incomplete exterior
shell for longer than three (3) years or any building or portion thereof which has
stood unoccupied for longer than one (1) year and which meets one or more of the
following criteria;
(a) unsecured, or
(b) boarded, or .
(c) having multiple exterior Housing Code or Building Code violations, or
(d) placarded as "Unfit for Human Habitation" pursuant to Chapter 34 of the Saint
Paul Legislative Code."
The ordinance further states that an abandoned building is a nuisance and it may be ordered
to be demolished and removed by the City.
NOTICE: If you do not want to have the City begin action to have the building
demolished and removed, then the attached list of deficiencies must be repaired or you
must demolish and remove the building on or before October 19, 1991.

If you are unable to finance the conection or rehabilitation of the premises to comply with
this order, there are state and local rehabilitation programs for which you may qualify.
Information about these programs is available from the Department of Planning and
Economic Development, Rehabilitation Section at (612) 228-3105. Ask to speak to a loan
officer.
If you sell, transfer or convey, in any manner, the ownership or responsibility for this
property, you must within seven ('n days of such action, provide the Division of Public
Health with the names and addresses of any new owners or responsible parties.
You must also notify any new owners or responsible parties of this pendiag action by
the Division of Public Health.
Any repair or demolition must be completed in accordance will all applicable laws.
If the rehabilitation work is not completed or if you have not demolished and removed the
building by the above date, the Division of Public Health will refer this matter to the City
Council to receive authority to have the building demolished and removed. All costs
incuned in wrecking and removing the building will be charged against the real estate as a
special assessment to be collected in the same manner as taxes. The City Council will
schedule public hearings to consider.the necessity and advisability of ordering the building
repaired or demolished and removed. If public hearings become necessary, you will be
notified of the times and dates of the hearings and you will be allowed to present evidence to
the City Council.
A copy of this order will be kept on file in the City Clerk's Office and a Resolution
declaring this property to be a nuisance shall be on file in the Ramsey County Recorder's
Office. Compliance with the attached list of deficiencies will remove your building from the
list of abandoned buildings but it does not mean that the building complies will all applicable
Housing and Building Codes.
The date for compliance with these orders shall not be extended unless you receive written
approval from the Division of Public Health.
If you wish to have the City demolish and remove your building, you may do so by
requesting a consent form be sent to you from our office, to sign and return to the Division
of Public Health. However, please be awaze that all owners and interested parties must sign
a Consent to Raze form before the City can demolish and remove the building without a City
Council order. Also be aware that the cost of the demolition, if performed by the City,
would become a special assessment against the property.

All repairs and new installations must be made in accordance with the appropriate codes.
Permits must be obtained where changes and/or additions to an electrical system require
upgrading of the service size to cunent National Electrical Code (N.E.C.) requirements.
So�e plumbing repairs may necessitate updating of the fixtures and/or piping involved. A
permit is required for any repair or new installation. Permits may be obtained from the
Building Inspection and Design Division, Room 445, City Hall.
REMEDIAL ACTION
The below list of deficiencies is not necessarily all the deficiencies present in the above
referenced property. As first remedial action, a Code Compliance Inspection must be
obtained from the Building Inspection and Design Division, Room 445, City Hall,
identifying all necessary repairs.
Exterior
1. The front concrete steps from the public sidewalk and the concrete steps to the front
porch aze broken, deteriorated and missing handrails.
2. The rear steps are missing handrails.
3. The foundation has cracks in the walls, loose and missing mortar.
4. The siding has missing pieces, corner molding pieces aze missing, siding lacks paint.
5. The doors are boarded.
6. The second floor windows are open, missing storms windows.
7. The south side and east side porehes lack handrails, the floors are sagging and not
properly supported.
8. The wood frames around the openings on the south side porch area are deteriorated
with most of the screens missing.
9. The eaves and trim are unfinished and unpainted.
10. The chimney on the north side nceds tuckpointing. The flu pipe is not visible.
11. The one story addition on the northside of the house has a defective and deteriorated
roof. Parts of the walls have rotted and deteriorated wood. The foundation walls
have some cracldng and loose concrete.

The legal description of this property is:

VV:FIEREAS, the Division of Public Health has requested the City Council to hold
public hearings to consider the advisability and necessity of ordering the repair or wrecldng
and removal of a two story, wood frame, deteriorated, dilapidated, condemned, duplex
residential structure located on property hereinafter referred to as the "Subject Property" and
commonly lrnown as 41 7essamine Avenue West This property is legally described as
follows, to wit:
Lot 25, Block 5, Sdnson's Rice Street Addition to the City of St. Paul . .
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by the Division of Public Iiealth on or before September 26, 1991, the
following are the now known interested or responsible parties for the Subject Property: Louis
Tschida, 41 Jessamine Avenue West, St. Paul, MN 55117; Mary L. Klas, Esq., Attorney at
Law, 746 Fairmount Avenue, St. Paul, MN 55105; Yehia l. Ibrahim, 1903 Silver Bell
Road, Suite 220, Eagan, MN 55122; Yehia lbrahim , 804 Northwestern 12th Street, Moore,
OK 73160; First Bank Saint Paul, 332 Minnesota Street, St. Paul, MN 55101; Ramsey
County Property Taxation, c/o James Parker, 109 Courthouse, St. Paul, NIN 55102
WI�REAS, the Division of Public Health has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order idendfied as an "Order
to Abate Nuisance Building(s)" (Abandoned Building Notice) dateti September 19, 1991
which is attached and incorporated as part of this Resolution; and
VVHEREAS, the order informed the then known interested or responsible parties that
the house located on the Subject Property is a nuisance building(s) pursuant to Sections
45.02, Subd. 8 and a nuisance pursuant to Chapter 45.03 Subd. 7; and
WHEREAS, this order informed the interested or responsible parties that they must
either repair or demolish the structure located on the Subject Property by October 19, 1991;
and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition, subject to demolition; and
WF�REAS, this nuisance condition has not been corrected and the Division of Public
Health has requested that the City Clerk schedule public heariirgs before the Neighborhood
Services Committee of the City Council and the Saint Paul City Council; and
WI�REAS, the interested and responsible parties have been served notice in
accordance with the provisions of Chapter 45 of the Saint Paul I,egislative Code, of the time,
date, place and purpose of theses public hearings; and

V'VHEREAS, a hearing was held before the Neighborhood Services Committee of the
Saint Paul City Council on Wednesday, November 20, 1991 to hear testimony and evidence,
and after receiving testimony and evidence, made the recommendation to approve the request
by the Division of Public Health to order the interested or responsible parties to make the
Subject Property safe and not detrimental to the public peace, health, safety and welfare and
remove its blighting influence on the community by rehabilitating this structure in accordance
with all applicable codes and ordinances, �r in the alternative by demolishing and removing
the structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition of the structure to be completed within fourteen (14) days of the date of the
publication of this resolution; and
VVHEREAS, a hearing was held before the Saint Paul City Council on Tuesday,
November 26, 1991 and all testimony and evidence including the action taken by the
Neighborhood Services Committee was considered by the Council; and
NOW T�REFORE, BE IT RESOLVED, that based upon all of the testimony and
evidence presented at the above referenced public hearings, the Saint Paul City Council
hereby adopts the following Findings and Order concerning the Subject Property at 41
Jessamine Avenue West:
1. That the building(s) located on the Subject Property comprise a nuisance
condition as defined in Saint Paul Legislative Code, Chapter 45.02 Subd.B.
2. That the costs of demolition and removal of this building(s) is estimated to
exceed three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
� 4. That an Order to Abate Nuisance Building(s) (Abandoned Building Notice) was
sent to the then known responsible parties to correct the deficiencies or to
demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That the Division of Public Fiealth has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacantJNuisance
Buildings Code Enforcement Program.
8. lfiat the City of Saint Paul has had to boazd accessible openings at the subject
property.
9. That the lrnown interested parties and owners aze as previously stated in this
resolution and that they have been properly served notice of the public
hearings.

ORDER
The Saint Paul City Council hereby makes the following order:
� 1. The above referenced interested or responsible parties shall make the Subject
Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating
this structure and correcting all deficiencies as prescribed in the above
referenced Order to Abate Nuisance Building(s) (Abandoned Building Notice)
in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in_accordance with all applicable codes
and ordinances. The rehabilitation or demolition and removal of the structure
must be completed within fourteen (14) days of the date of the publication of
this resolution.
2. If the above corrective action is not completed within this period of time the
City of Saint Paul, Division of Public Health is hereby authorized to take
wtiatever steps are necessary to demolish and remove this structure and fill the
site and charge the costs incurred against the Subject Property pursuant to the
provisions of Section 45.08 of the Saint Paul Legislative Code.
3. In Che event the building is to be demolished and removed by the City of Saint
Paul, all personal property or fixtures of any icind which shall unreasonably
interfere with the demolition and removal shall be removed from the building
by the responsible pazties by the end of this time period. If the personal
property is not removed, the City of Saint Paul shall remove and dispose of
such property and fixtures as is provided by law.
4. IT IS FURTHER ORDERED, that a copy of this resolution be mailed to the
last known address of the owners and interested parties in accordance with
Section 45.11, Subd.6 of the Saint Paul Legislative Code.

Dear Sir or Madam:
The Division of Public Health has determined that the above noted building is an abandoned
building, which Chapter 45 of the Saint Paul Legislative Code defines as:
"any building or portion of a building which has stood with an incomplete exterior
shell for longer than three (3) years or any building or portion thereof wluch has
stood unoccupied for longer than one (1) year and wtrich meets one or more of the
following criteria;
(a) unsecured, or
(b) boarded, or .
(c) having multiple exterior Housing Code or Building Code violations, or
(d) placarded as "Unfit for Human Aabitation" pursuant to Chapter 34 of the Saint
Paul Legislative Code."
The ordinance further states that an abandoned building is a nuisance and it may be ordered
to be demolished and removed by the City.
NOTICE: If you do not want to Lave the City begin actioa to have the building
demolished and removed, thea the attached list of deficiencies must be repaired or you
must demolish and remove the building on or before October 19. 1991.

If you aze unable to finance the conection or rehabilitation of the premises to comply with
this order, there are state and local rehabilitation programs for which you may qualify.
Information about these programs is available from the Department of Planning and
Economic Development, Rehabilitation Section at (612) 228-3105. Ask to speak to a loan
officer.
If you sell, transfer or convey, in any manner, the ownership or respons�'ility for this
property, you must within seven (� days of such action, provide the Division of Public
Health with the aames and addres.ses of any new owners or responsble parties.
You must also notify any new owners or responsible parties of this pending action by
the Division of Public Health.
Any repair or demolition must be completed in accordance will all applicable laws.
If the rehabilitation work is not completed or if you have not demolished and removed the
building by the above date, the Division of Public Health will refer this matter to the City
Council to receive authority to have the building demolished and removed. All costs
incurred in wrecking and removing the building will be charged against the real estate as a
special assessment to be collected in the same manner as taxes. The City Council will
schedule public hearings to consider the necessity and advisability of ordering the building
repaired or demolished and removed. If public heazings become necessary, you will be
notified of the times and dates of the hearings and you will be allowed to present evidence to
the City Council.
A copy of this order will be kept on file in the City Clerk's Office and a Resolution
declaring this property to be a nuisance shall be on file in the Ramsey County Recorder's
Office. Compliance with the attached list of deficiencies will remove your building from the
list of abandoned buildings but it does not mean that the building complies will all applicable
Housing and Building Codes.
The date for compliance with these orders shall not be extended unless you receive written
approval from the Division of Public Health.
If you wish to have the City demolish and remove your building, you may do so by
requesting a consent form be sent to you from our office, to sign and return to the Division
of Public Health. �iowever, please be aware that all owners and interested parties must sign
a Consent to Raze form before the City can demolish and remove the building without a City
Council order. Also be aware that the cost of the demolition, if performed by the City,
would become a special assessment against the property.

All repairs and new installations must be made in accordance with the appropriate codes.
Pennits must be obtained where changes and/or additions to an electrical system require
upgrading of the service size to current National Electrical Code (N.E.C.) requirements.
Some plumbing rcpairs may necessitate updating of the fixtures andlor piping involved. A
pennit is required for any repair or new installation. P�rrmits may be obtained from the
Building Inspection and Design Division, Room 445, City Aall.
RIIV�DIAL ACTION
The below list of def'lciencies is not neccssarily all the deficieacies present in the above
referenced property. As fust remedial action, a Code Compliance Inspection must be
obtained from the Building Inspection and Desigu Division, Room 445, City Hall,
identifying all necessary repairs.
Fxterior
1. The front concrete steps from the public sidewalk and the concrete steps to the front
porch are broken, deteriorated and missiag handrails.
2. The rear steps are missing hazidrails.
3. The foundation has cracks in the walls, loose and missing mortar.
4. The siding has missing pie�es, corner moldiag pieces are missing, siding lacks paint.
5. The doors are boarded.
6. The second floor windows are opeai, missing storms windows.
7. The south side and east side porches lack handrails, the floors are sagging and not
P�P�Iy supported.
8. The wood frames around the openings on the south side porch area are deteriorated
with most of the screeas missing.
9. The eaves and trim are unfinished and unpainted.
10. The chimney on the north side needs tuckpointing. The flu pipe is not visible.
11. The one story addition on the northside of the house has a defective and deteriorated
roof. Parts of the walls have rotted and deteriorated wood. The foundation walls
have some cracking and loose concrete.
