WI�REAS, the Division of Public Health has requested the City Council to hold
public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a two story, wood frame, fire damaged, hazardous, condemned, deteriorated
residential structure located on property hereinafter referred to as the "Subject Property" and
commonly known as 851 Aurora Avenue This property is legally described as follows, to
wit:
Lot 18, Chute Brothers Division No. 16 Addition to St. Paul .
WHEREAS, bas�d upon the records in the Ramsey County Recorder's Office and
information obtained by the Division of Public Health on or before September 12, 1991, the
following are the now known interested or responsible parties for the Subject Property:
Jannie E. 7ohnson, Deceased; Minnesota Housing Finance Agency, 400 Sibley Street #300,
St. Paul, MN 55101; Peter Eckholm, C�O Estate of 7annie E. 7ohnson, 366 Jackson Street
#300, St. Paul, MN 55101-1925; Ramsey County Property Taxation, 15 Kellogg Blvd, St.
Paul, MN 55102.
WI�REAS, the Division of Public Health has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order
to Abate Nuisance Building(s)" (Dangerous Structure Notice) dated September 24, 1991
which is attached and incorporated as part of this Resolution; and
WHEREAS, the order informed the th�n known interested or responsible parties that
the house located on the Subject Property is a nuisance building(s) pursuant to Sections
45.02, Subd. 8 and a nuisance pursuant to Chapter 45.03 Subd. 7; and
WHEREAS, this order informed the interested or responsible parties that they must
either repair or demolish the structure located on the Subject Property by October 9, 1991;
and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition, subject to demolition; and
WHEREAS, this nuisance condition has not been conected and the Division of Public
Health has requested that the City Clerk schedule public hearings before the Neighborhood
Services Committee of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in
accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the dme,
date, place and purpose of theses public hearings; and

WHEREAS, a hearing was held before the Neighborhood Services Committee of the
Saint Paul City Council on Wednesday, November 20, 1991 to hear testimony and evidence,
and after receiving testimony and evidence, made the recommendation to approve the request
by the Division of Public Health to order the interested or responsible parties to make the
Subject Property safe and not detrimental to the public peace, health, safety and welfaze and
remove its blighting influence on the community by rehabilitating this structure in accordance
with all applicable codes and ordinances, Q in the alternative by demolishing and removing
the structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition of the structure to be completed within seven ('n days of the date of the
publication of this resolution; and
WHEREAS, a hearing was held before the Saint Paul City Council on Tuesday,
November 26, 1991 and all testimony and evidence including the action taken by the
Neighborhood Services Committee was considered by the Council; and
NOW THEREFORE, BE IT RESOLVED, that based upon all of the testimony and
evidence presented at the above referenced public hearings, the Saint Paul City Council
hereby adopts the following Findings and Order concerning the Subject Property at 851
Aurora Avenue:
1. That the building(s) located on the Subject Property comprise a nuisance
condition as defined in Saint Paul Legislative Code, Chapter 45.02 Subd.S.
2. That the costs of demolition and removal of this building(s) is estimated to
exceed three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) (Dangerous Structure Notice)
was sent to the then known responsible parties to conect the deficiencies or to
demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That the Division of Public Health has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacandNuisance
Buildings Code Enforcement Program.
8. 1'hat the City of Saint Paul has had to board accessible openings at the subject
property.
9. That the known interested parties and owners are as previously stated in this
resolution and that they have been properly served notice of the public
hearings.

RDER
The Saint Paul City Council hereby makes the following order:
� 1. The above referenced interested or responsible parties shall make the Subject
Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating
this structure and correcting all deficiencies as prescribed in the above �
referenced Order to Abate Nuisance Building(s) (Dangerous Structure Notice)
in accordance with all applicable codes and ordinances, �r in the alternative by
demolishing and removing the structure in accordance with all applicable codes
and ordinances. The rehabilitation or demolition and removal of the structure
must be completed within seven ('n days of the date of the publication of this
resolution. .
2. If the above conective action is not completed within this period of time the
City of Saint Paul, Division of Public Health is hereby authorized to take
whatever steps are necessary to demolish and remove this structure and fill the
site and charge the costs incuned against the Subject Property pursuant to the
provisions of Section 45.08 of the Saint Paul Legislative Code.
3. In the event the building is to be demolished and removed by the City of Saint
Paul, all personal property or fixtures of any kind which shall unreasonably
interfere with the demolition and removal shall be removed from the building
by the responsible parties by the end of this time period. If the personal
property is not removed, the City of Saint Paul shall remove and dispose of
such property and fixtures as is provided by law.
4. IT IS FURTHER ORDERED, that a copy of this resolution be mailed to the
last known address of the owners and interested parties in accordance with
Section 45.11, Subd.6 of the Saint Paul Legislative Code.

Dear Sir or Madam;
The Division of Public Health has determined that the above noted building is a dangerous
structure, which Chapter 45 of the Saint Paul Legislative Code �efines as:
"any structure which is potentially dangerous to persons or property including but not
limited to:
(a) a structure which is in danger of partial or complete collapse; or
(b) a structure which has any exterior parts such as chimneys, eaves, porches,
siding, railings, or trim which are loose or in danger of falling; or
(�) a structure which has any parts such as porches, stairs, ramps, rails, balconies,
or roofs which are accessible and which are either collapsed, in danger of
collapsing, or unable to support a person."
The Ordinance further states that a dangerous structure is a nuisance and it may be ordered
to be demolished and removed by the City. If you do not want to have the City begin action
to have the building demolished and removed you are hereby notified that the attached list of
deficiencies must be repaired or you must have the building demolished and removed on or
before October 9, 1991.

If you aze unable to finance the conection or rehabilitation of the premises to comply with
this order, there are state and local rehabilitation programs for which you may qualify.
Information about these programs is available from the Department of Planning and
Economic Development, Rehabilitation Section at (612) 228-3105. Ask to speak to a loan
officer.
If you sell, transfer or convey, in any manner, the ownership or responsibility for this
property, you must within seven ('n days of such action, provide the Division of Public
Health with the n.ames and addres.ses of any new owners or responsible parties.
You must also notify any new owners or responsible parties of this pending action by
the Division of Public Health.
Any repair or demolition must be completed in accordance with all applicable laws.
If the work is not cc�mpleted or if you have not had the building.demolished and removed by
the above date, the Division of Public Health will refer this matter to the City Council to
receive authori.ty to demolish and remove the building. All costs incuncd in the wrecking the
building will be charged against the real estate as a special assessment to be collected in the
sam.e manner as taxes. The City Cauncil will schedule public hearings to cansider if the
building should be demolished and removed. If public hearings becomes necessary, you
will be notified of the times and dates of the hearings and you will be allowed to present
evidence to the City Council. A copy of this order will be kept on file in the City Clerk's
Office and a Resolution declaring this property to be a nuisance shall be on file in the
, Ramsey County Recorder's Office. Compliance with the attached list of deficiencies will,.
remove your building from the list of dangerous struetures, but it does not mean that the'
building complies with all applicable housing and building codes.
The date for compliance with these orders shall not be extended unless you receive written
approval from the Division of Public Health.
If you wish to have the City demolish and remove your building, you may do so by
requesting a consent from be sent to you from our offiee to sign and return to the Division of
Public Health. However, please be aware that all owners and interested parties must sign a
Consent to Ra7,e form before the City can demolish and remove the building without a City
Council order. Also be awaze that the cost of the demolition if performed by the City,
would become a special assessment against the property.

All repairs and new installations must be made in accordance with the appropriate codes.
Permits must be obtained where changes and/or additions to an electrical system require
upgrading of the service size to current National Flectrical Code (N.E.C.) requirements.
Some plumbing repairs may necessitate updating of the fixtures and/or piping involved. A
permit is required for any repair or new installation. Permits may be obtained from the
Building Inspection and Design Division, Room 445, City Hall.
RF�nIAL ACTION
The below list of deficiencies is not necessarily all the deficiencies present in the above
referenced property. As fust remedial action, a Code Compli.ance Inspection must be
obtained from the Building Inspection and Design Division, Room 445, City Hall,
identifying all necessary repairs.
Basement
1. The basement is filthy and full of rubbish and junk. There is a rat a.nd mice
infestati.on. The floors are cracked and broken. The foundation walls are
deteriorated, spalling and contain rodent holes. The basement has mold, mildew and a
musty odor. The doors are broken and defective.
Electrical Service
2. Because of the fire damage, the electrical system will have to be thoroughly checked
by an electrician.
Plumbing/Heating System
3. The floor drains and covers are missing with open sewer connections. The drain,
waste, water piping and vent piping is destroyed by freezing and needs total
replacement. The water heater needs replacement, it appears burst and leaking. The
plumbing fixtures aze inoperable and defective. Complete new plumbing systems
needed. The hot water boiler is missing, the pipes cut and destroyed.
Kitchen
4. The kitchen has been burned and destroyed by fire. Needs total and complete
replacement.

5. This part of the house has been burned and destroyed by fire. Needs total and
complete replacement.
Bathroom
6. The bathroom is fire, water and smoke damaged and needs replacement.

7. The walls and ceiling have been destroyed by fire. The room is filled with fire debris
and fire flotsam.
Attic
8. The attic is full of junk and discarded household items.
Exterior
9. The stairways are deteriorated and dilapidated. The foundation needs h�ckpointing
and contains rodent entry holes and the drainage is poor. The basement windows are
defective, rotted out and nceds replacement. The exterior walls and sxdings are
defective and deteriorated. The doors and windows are broken, boarded, defective
and need replacement. The storm doors and windows aze missing. The eaves and
trim show signs of rot. The roof covering is very deteriorated, worn out and needs
replacement
General
10. This is a very dilapidated single family house in a stable �eighborhood of decent one
and two family houses.
11. Lack of basic facilities.

Dear Property Owners:
The Division of Public Health, Section of Housing Code Enforcement
of the City of Saint Paul , Minnesota, has found that the dwelling
and premises at 851 Aurora Avenue is "Unfit for Human Habitation"
due to the want of repairs, and/or defects in the drainage,
plumbing, lighting or construction of said dwelling and premises,
and/or for other causes affecting public health.
If you are unable to finance the correction or reriabil�t3tion of
the premises to comply with this order, there are Stat� and Local
rehabilitation programs for which you may qualify. As stated, for
appeals information call 292-7775.

3 . This house is lacking a properly installed smoke detector.

�4 . Upper kitchen - there is an open waste line under the sink.
Properly install or properly seal waste line.
5 . Upper kitchen - the flex gas supply line lacks a lever handle
shut off valve. Install per code.
6 . Upper bathroom - Repair wall around tub.
7 . The front entrance door is in disrepair. Repair or replace
door.
8 . Remove the two lawn mowers and stored gas�line from front
porch.
9 . There is a large accumulation of trash a:d spoiled iood s�uffs
throughout house. Remove this accumulation and maintain house
in a heal.th.y condition.
Basement
10 . Remove all accumulated junk, debris, rags, cardboard, etc. and
dry out the basement to eliminate mold and mildew.
11. Remove and dispose of flaking, loose, peeled and damaged
asbestos pipe wrapping in accordance will all Federal , State
and O. S .H.A. regulations and statutes covering the removal and
proper disposal of asbestos as a toxic and hazardous waste
material.
12 . Reinstall the hot water heater flue vent to comply with
Uniform Plumbing Code and properly seal at the chimney.
13 . There is unprotected non-metallic electrical wiring. Remove
and reinstall .to code.
14 . Exterminate and eliminate all rodents.

The legal description of this property is:
Lot 18, Chute Brothers Division No. 16 Addition to St. Paul
The City of Saint Paul, Division of Public Health has declared this building(s) to constitute a
"nuisance" as defined by Legislative Code, Chapter 45. The Division has issued an order to
the then known responsible parties to eliminate this nuisance condition by correcting the
deficiencies or by razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Division that the City Council pass a resolution ordering the
responsible parties to either repair, or demolish and remove this building in a timely manner,
and failing that, authorize the Division to proceed to demolition and removal, and to assess
all costs incurred against the real estate as a special assessment to be collected in the same
manner as taxes.

Dear Property Owners:
The Division of Public Health, Section of Housing Code Enforcement
of the City of Saint Paul, Minnesota, has found that the dwelling
and premises at 851 Aurora Avenue is "Unfit for Human Habitation"
due to the want of repairs, and/or defects in the drainage,
plumbing, lighting or construction of said dwelling and premises,
and/or for other causes affecting public health.
If you are unable to finance the correction or rehabilit3tion of
the premises to comply with this order, there are State and Local
rehabilitation programs for which you may qualify. A� stated, for
appeals information call 292-7775.
All repairs and new installations must be made in accordai�ce with
the appropriate codes. Permits must be obtained where changes
and/or additions to an electrical system require upgrading of the
service size to present National Electrical Code requirement. Some
plumbing repairs may necessitate updating of the fixtures and/or
piping involved. A permit is required for any repair or new
installation. Permits may be obtained from the Building Inspection
and Design Division, Room 445, City Hall.
The following repairs and/or improvement are required before this
dwelling may be reoccupied:

heater.
2 . Lower bathroom - repair wall around the tub.
3 . This house is lacking a properly installed smoke detector.

�4 . Upper kitchen - there is an open waste line under the sink.
Properly install or properly seal waste line.
5. Upper kitchen - the flex gas supply line lacks a lever handle
shut off valve. Install per code.
6 . Upper bathroom - Repair wall around tub.
7 . The front entrance door is in disrepair. Repair or replace
door.
8 . Remove the two lawn mowers and storzd gasoline from front
porch.
9 . There is a large accumulation of trash and spoiled food stuffs
throughout house. Remove this accumulation and maintain house
in a heal.thy condition.
Basement
I0. Remove all accumulated junk, debris, rags, cardboard, etc. and
dry out the basement to eliminate mold and mildew.
11. Remove and dispose of flaking, loose, peeled and damaged
asbestos pipe wrapping in accordance will all Federal, State
and O.S.H.A. regulations and statutes covering the removal and
proper disposal of asbestos as a toxic and hazardous waste
material.
12 . Reinstall the hot water heater flue vent to comply with
Uniform Plumbing Code and properly seal at the chimney.
13 . There is unprotected non-metallic electrical wiring. Remove
and reinstall to code.
14 . Exterminate and eliminate all rodents.
