Presented By � /��0� Referred To Coaraittee: Date RESOLVED, that upon he petition of Southview Bank, per Finance Department File No. 11-1991, that part of Blair Avenue bounded by Elfelt Street and Como Avenue , hereinafter described , is hereby vacated and discontinued as public property. The vacated property is described as follows: All that part of Blair Avenue lying easterly of Elfelt Avenue and westerly of the intersection of the northeasterly line of Flandraus Subdivision of South 1/2 of Block 12 , Lafond ' s Addition to St. Paul, extended southeasterly, with the wester2y right-of- way line of Galtier Street extended northerly across Blair Avenue. This vacation shall be subject to the following conditions : . 1. That this vacation shall be subject to the terms and cond itions of Chapter 130 , codif ied March 1, 1981, of the Saint Paul Legislative Code, as amended. 2 . That the petitioner , its successors, and assigns shall pay $4 ,706 as compensation for this vacation which is due and payable within 60 days of the publication date of this resolution. 3 . That a permanent sewer easement be retained within the vacated area on behalf of the City aE Saint Paul, Department of Public Works, subject to the following conditions: a. No buildings, structures , or trees are � permitted within the easement area nor any temporary structure , material storage, fixture, or other objects that will prohibit normal access to sewer facilities for maintenance purposes. b. No change from the existing grade is permitted without written permission from the Director of the Department of Public Works . c. That the petitioner , its successors , and assigns shall indemnify, defend, and save harmless the City of Saint Paul , its oFficers , agents , employees , and servants from all suits , actions , or claims which shall arise from any injuries or damages received or sustained by any break in any service pipe of connection in said reserved easement arising out of or resulting from any action or negligence of the petitioners , their employees , agents , or business invitees . 4 . '^hat the petitioner , its successors , and assigns , shall submit and receive approval of a site plan which includes the vacated area as part of its proposed building redevelopment and parking project within 120 days of the publication date of this resolution. 5 . That the petitioner. , its successors , and assigns , shall pay all costs and expenses for the r.econstruction of the street inter.sections affected by this vacation and also the removal and or relocation of any utility equipment , including but not limited to: all costs for construction of new curbing , sidewalks , boulevards , signs , drainage structures , street lighting , private driveways and removal of paving within the vacated area , subject to the approval of the Director of Public Works . 6 . That a permanent easement be retained within the vacated area to protect the interests of Northern States Power Company. 7 . That a permanent easement be retained within the vacated area to protect the interests of Continental Cablevision . 8 .
