Amendment of the legislative ordinance granting to District
Heating Development Company a non-exclusive franchise to use
public streets and property to construct and operate a district
heating system. Ordinance No. 16947, Council File No. 278880, as
amended, by extending the authority to offer incentive rates to
new customers to September 30, 1995.
The Council of the City of Saint Paul Does Ordain:
SECTION 1
Amend Section 6 (a) (1) to read:
" (1) The Incentive Rate Program dated June 19, 1987, as
further amended by a filinq made on September 6. 1991, on
file with the City Clerk shall be implemented throuah
September 30, 1995, and incentive rates charged to DHDC
Customers will not be in violation of or be deemed
inconsistent with the terms and provisions of this Section
or any other Section of this Franchise;"
SECTION 2
This Ordinance shall take effect and be in force thirty (30)
days following its passage, approval and publication.

In 1987 the Council approved the District Energy incentive rate plan. District Energy
was authorized to offer incentive rates through September 30, 1991. Approval of
the attached ordinance will enable District Energy to offer incentive rates through

Energy's formal acceptance of an amendment to the franchise,

Dear Members of the City Council:
The December 17th agenda has scheduled a public hearing at the
third reading of an ordinance which grants District Energy Saint
Paul, Inc. a modification of their franchise, allowing a four year
extension of their incentive rate program.
It is necessary to have evidence on the record and some debate to
support your conclusion on this matter, as it creates a distinction
between customers. The franchise requires that rates not be
unreasonably prejudicial or discriminatory. The incentive rate
program does create a preference, allowing new customers a
discounted rate for a period of time as an incentive for signing on
with the utility. You must make a finding that this preference is
not unreasonable or discriminatory, and base those findings on
evidence contained in the record. This office is concerned that
the meeting of the Public Works Committee on December 4 did not
involve a debate of these issues, and that the record is not as
complete as would be desirable with facts supporting the conclusion
to approve the ordinance.
These concerns can be remedied by allowing introduction of evidence
at the public hearing before the Council, and by debate and
deliberation on the record at that hearing.
We are also concerned about the inference that could be found in
Mr. Brynolfson's letter of December 6. It has been the consistent
advice of this office that the Council has broad regulatory
authority which allows inquiry into the operations of the utility.

offered by Mr. Brynolfson.
