Whereas, Section 62.102 (d) of the Saint Paul Zoning Code permits the
continuance of an existing structure which does not comply with Zoning Code provisions
relating to required area, lot coverage, height, yards and other characteristics of the
structure or land (non-conforming structure with a use that conforms to the Zoning
Code); and
Whereas, Section 62.102 (d) places restrictions on the expansion or alteration of a
non-conforming structure, reconstruction when the structure is damaged to an extent in
excess of 60% of its replacement cost and moving of the structure to a different location;
and
Whereas, Section 62.102 (d) does not presently contain any provisions which
would require that the structure be brought into compliance with the Code provisions in
the event the use of the existing structure should be abandoned for a specified period of
time; and
Whereas, The City Council is interested in obtaining the advice and
recommendation of the Planning Commission as to whether the provisions of the Zoning
Code should be amended so as to add some conditions or restrictions that would address
the issue of non-conformity of the structure; now therefore be it
Resolved, That the Council does hereby refer the above subject of a possible
amendment to the Saint Paul Zoning Code to the Planning Commission and does hereby
request that the Commission, with the assistance of staff of the Planning Division,
consider this matter and submit to the Council its findings, conclusions and
recommendations whether Zoning Code amendments should be enacted placing further

Dear Councilmember Dimond:
I have prepared and submit herewith the resolution requesting
the Planning Commission to review the provisions of section 62. 102
(d) of the Zoning Code for the purpose of considering an amendment
which would add restrictions on non-conforming structures in the
event the structure should become abandoned for a specified period
of time. The City Council may propose Zoning Code amendments, and
the review and recommendation of the Planning Commission is a
requirement of State law (Minnesota Statutes, section 462 .357) .
