Petitioner further prays for an order of this Court pursuant to Minn. Background Information � • . a. The District One Community Council, at its October 28, 1991 regular meeting, discussed a current proposal by the City of Maplewood, to drain surface water from a large drainage area east of McKnight Road, including several existing ponds, to what is termed "the French Property" a 9.6 acre site in the Highwood Neighborhood of the City of St. Paul. b. The District One Community Council also learn�d that the City of Maplewood is in the process of condemnation of the French Property to gain ownership, and that the City of Maplewood, over the long term, intends to use the French Property as a holding pond with no outlet, other than to let it fill up (27 feet of water depth above current grade) then overflow, unregulated, down Highwood Avenue, currently a street with no stqrm sewer or curb and gutter. � c. The District One Community Council also learned that this project has been discussed and is being proposed by the City of Maplewood without any notification of the property owners in St. Paul who would'be directly or indirectly affected by the project and by future runoff or assessments that could accrue for resultant street improvements and/or storm sewer improvements that would be needed along Highwood Avenue from McKnight Road to Point Douglas Road. ��aie� � _ . - (,ri�9' page 2 2 . Preliminary Concerns ' a. The proposed activity by the City of Maplewood (i.e. , Project 90-10) as proposed, is clearly inconsistent with the recently adopted Highwood Neighborhood Plan (currently being incorporated into the City of St. Paul Comprehensive Plan) which, among other recommendations, states: "The wooded areas in Highwood, especially along the fragile bluffline, should be preserved and protected. " "The existing mature stand of trees should be preserved, and the natural canopy of vegetative cover on vacant and occupied lots should be maintained. " "Lands classified as unsuitable for development by the Task Force (86 acres on vacant parcels) should be acquired by the City or County on a willing seller basis for open space and for use as holding pond areas. " "Acquire the McKnight/Highwood site (French Property) for use as open space and if appropriate, maintain as a natural pond. " b. City of St. Paul residents have not been notified, nor • have they had an opportunity to become informed or comment on this proposal that will clearly affect them. Converting this heavily wooded open space area, with steep slopes and diverse plant and animal life, to a stagnent holding pond with a fence around it, is not what the Highwood Neighborhood, nor the District One Council, had in mind for this parcel. Nor does the Neighborhood and the Council appreciate such action being taken without due notice to those affected. 3 . Recommendations a. The District One Community Council, by unanimous vote, at ' its October 28, 1991 meeting, directed that a letter be sent to the Mayor and City Council of St. Paul and the Mayor and City Council of Maplewood requesting that: 1. The City Councils of the City of Maplewood and the City of St. Paul hold a joint public hearing on this proposal to inform residents about the proposed activity and its potential or actual environmental and economic impacts and to discuss alternative solutions. . � � � 9�Y��a� ✓ r � page 3 2. The City of Maplewood immediatly stop any further action on project, including its current condemnation proceedings, until this issue can be brought before the citizens of both cities, options can be explored, and a solution acceptable to both Cities and the District One Council can be reached. b. The District One Community Council, by unanimous vote, at its October 28, 1991 meeting, further directed that a copy of this letter be sent to the parties listed below, as an expression of concern about this issue and to alert them of this request. We respectfully request a response from both City Councils indicating your respective responses to our request. The next meeting of the District One Community Council will be on November 25, 1991. Its hearing committee will meet on November 18. We would appreciate a response in time for consideration by our Hearing Committee and the full Community Council at their November meetings. Wilson : My husband and I are writing to you about the property at the corner of McKnight and Highwood Avenues, the area being considered for a holding pond by Maplewood. We are opposed to that plan . Our property is on the opposite side of Highwood, from Oak View Court down the slope to Highwood Avenue . As a member of the Planning Commission on the Land Use committee , I remember quite wel ] the meetings and dtscussions of the Highwood Plan Cwhich has just been passed by your body) on the issue of ponding and rainwater runoff by Maplewood development . The committee was told by staff at meetings and at the public hearing that St . Paul was not pursuing the idea of ponding since it was not needed. I hope that I can assume that the plan before you is not the ceason why we were told it was not needed. I would also hope that you use the Highwood Plan in your deliberations since it has been so recently adopted. Why does St . Paul want to allow another municipality to make decisions about St . Paul tand? Maybe we should pay our taxes to Maplewood instead of St . Paul? I am not opposed to agreements between municipalities for their mutual benefit , but such is not the case here . Residents and their property would be neg�.tively affected with no compensation; in fact , they would be expected to pay more in the form of an assessment for sewer construction . If they wish to empty Maplewood property of standing water and runoff and in- crease the potential for saleable property so Maplewood can gain additional taxes, then they, not St. Paul and it's residents should be willing to address the problem; and bear all its costs in the only safe and correctly engineered manner: an under- ground sewer system (which already exists, but needs only have it's diameter in- creased) to carry water away, rather than create a hazard for all and drown our valuable treed St. Paul property with their mistakes. Minnesota November 11 , 1991 � To the St. Paul City Council : We are Dave and Judy Pluff and reside at 2203 Highwood Avenue in St. Paul , � Minnesota. We are opposed to Maplewood securing the property at the southwest corner of McKnight and Highwood (the French property) for the purpose of emptying their holding ponds. Maplewood has not considered the long—term damage and repercussions such an undertaking will create. � The Ft�ench property is filled with cul�ured trees including Butternut trees which are all but extinct in Minnesota. All these trees will die leaving only dead stumps in their place. The wildlife consisting of wild turkeys, falcons, deer, raccoons� birds too numerous to mention and many other creatures will no longer inhabit the area. The water will be about 34—feet deep and when heavy rains fall or snow melts the water will cover Highwood causing surrounding property damage, including damage to St. Paul streets. The adjoining lot to the west of the French property has been used for approximately 15 years as a landfill by Minnesota Mining Company. We have been told there is only concrete and building materials there, however. no EPA - studies have been done to "just make sure" the ground is not contaminated. What if it is? All the property south of Highwood have wells,� what are the chances of these becoming contaminated? We have been told that Mr. French has already had problems with his septic system from Maplewood water, how much damage will there be to the adjoining property's septic systems? Also, what of all the hydrocarbons? We have been told that the St. Paul Public Works Department has constructed a plan to avoid "filling up" the French property and we commend them for this. however, we were also told this could result in some assessments for the - Highwood residents. This is a double outrage! Why should any St. Paul resident have to pay any amount of assessment to cure a problem caused by Maplewood and its developers. Maplewaod wants to give 17 of its holding ponds to St. Paul , so Maplewood can develop more lots, collect more taxes and cause more run—off water for St. Paul . We support St. Paul 's plan for this water run off and strongly support the payment of this plan by Maplewood and its developers. (Especially the developers—they can certainly afford it.) When we purchased our home four years ago, we did not look anywhere but in St. Paul because St. Paul is our home, we have lived here for over 50 years and are angered by Maplewood's actions. They want to hold down assessments for their citizens and give them to St. Paul citizens. Any consideration given this letter, will be very greatly appreciated. Our backyard is the French property being condemned by the City of Maplewood for use as a storm water holding pond. If this absurd action is not stopped we will leave St. Paul. McKnight Road. I 'm sorry I could not attend this meeting in person, but I feel strongly about the subject matter of `Ponding and Storm Sewer" . I have been raised in this area. I can remember how developing this area began in the late 1950`s . On the St . Paul side of McKnight there was a minimum house size that could be built on large wooded lots . Maplewood had a 5 acre minimum lot size for each residence . The low lying areas seem to handle what little run off there was . Then the city of Maplewood became greedy and wanted to increase the property tax base in this area by allowing developers to clear cut the land to see how many houses they could cram into �his narrow one mile wide finger of land between Century and McKnight Rd. Observing what was going on next door in Maplewood, and being pressured by the city of St. Paul who wanted to run city sewer and water through our area, the Highwood Task Force was formed about 2 years ago. Three main committees were formed to establish guidelines that addressed the needs of the residences in the areas o�: water, land and streets . The main trust of this task force was to preserve the beauty of the area. Ironically, during this same time period Maplewood was setting in motion a plan which would decimate a large parcel of land right in the middle of that which we were trying to preserve . August of 1990 I attended a Maplewood city council meeting where their residences were being sold on a short sited ponding scheme, which was labeled as a one time tax assessment to pay for draining some thirteen ponds . This scheme had a complete disregard for the obvious problem of what to do when their swamp over flows and runs down Highwood avenue . Maplewood should be held responsible for their water. If they choose not to keep it in Maplewood then they should present a workable plan which can be agreed to by the effected residences of St . Paul . If the permanent solution for handling the water, comes down to a storm sewer then I feel the residences of Maplewood should-pay for the majority of it . As a resider.t ef St. Paul I 've already been paying for a �ome fictitious storm sewer far the last 4 years through additional tax assessments . This water run off problem has �one on too long, its time we settle it once and for all . I hope an agreed to solution can be generated without further legal battles . It seems obvious to me that our local elected government officials could act as mediators in developing this permanent solution.
