I would like to clarify my understanding of your purpose in sending the letter. Based upon our previous conversations, it is my understanding that your client is admitting the facts contained in the Notice of Violation letter dated April 1, 1998 and the matter is being scheduled in front of the Saint Paul City Council for their determination of the appropriate penalty for the violation. The Office of License, Inspections and Environmental protection will recommend a suspension of six days, based upon the penalty mahix contained in Saint Paul Legislative Code §409.26. However, that is o� a recommendation and it is ultimately for the Council to deternvne the appropriate penalty. There aze no promises made that the suspension will, in fact, be for s'vc days. While I am awaze that you already Imow this, I wish to make it cleaz for the recbrd that your client is not being made any promises that would induce him to give up his right to a hearing on the facts of this matter. Reilly), Squad 792 (Sgt. Wachal), and Squad 790 (Lt. Neuberger) assisted by LIEP Lic,ease Inspector Kris Schweinler conducted liquor comptiance checks. The b¢sinesses that were tested are addresses that either the Vice Unit or LIEP has had compiaints regazding the sate of alcohol to underage persons or were identified by WCCO TV in an investigative report on underage alcohol sales. Prior to going out to the businesses the underage decoys provided by LIEP were seazched for money and any other identifications. The decoys presented curreni photo identification from which their dates of birth and their identiries were verified. IY was deteanined that the deeoys were under the age of twenty-one. The decoys were photographed. Copies of the decoys' identification cards and the photographs that were taken are retained in ihe Vice Unit oflice.. At approximately 1710 hours both of the decoys entered East Side Liquor at 1361 E. Maryland S� Yaul, NIN 55106. Wittnrt a minute an undercover V'ice offic�so� ered the business to observe the transaction. The decoys purchased a twelve pack of lvfichelob bottled beer. The clerk who sold the liquor to the decoys was identified by the decoys and the undercovet Vice officer. Vice officers a�d the LIEP eneployee entered the business, ider�tified themsetves, and obtained a photo identification from the clerk. The clerk presented a photo identification by which he was identified as ARVII�T, Shawn Phittip (DOB 08-18-76, of 1010 Case St. Paul, MN 55106 (H}774-3695). The LIEP employee talked to the store owner. The Ivfichelob twelve pack that was purchased was tumed over to the property room for evidence. I would like to clarify my understanding of your purpose in sending the letter. Based upon our previous conversations, it is my understanding that your client is admitting the facts contained in the Notice of Violation letter dated April 1, 1998 and the matter is being scheduled in front of the Saint Paul City Council for their determination of the appropriate penalty for the violation. The Office of License, Inspections and Environmental protection will recommend a suspension of six days, based upon the penalty mahix contained in Saint Paul Legislative Code §409.26. However, that is o� a recommendation and it is ultimately for the Council to deternvne the appropriate penalty. There aze no promises made that the suspension will, in fact, be for s'vc days. Reilly), Squad 792 (Sgt. Wachal), and Squad 790 (Lt. Neuberger) assisted by LIEP Lic,ease Inspector Kris Schweinler conducted liquor comptiance checks. The b¢sinesses that were tested are addresses that either the Vice Unit or LIEP has had compiaints regazding the sate of alcohol to underage persons or were identified by WCCO TV in an investigative report on underage alcohol sales. Prior to going out to the businesses the underage decoys provided by LIEP were seazched for money and any other identifications. The decoys presented curreni photo identification from which their dates of birth and their identiries were verified. IY was deteanined that the deeoys were under the age of twenty-one. The decoys were photographed. Copies of the decoys' identification cards and the photographs that were taken are retained in ihe Vice Unit oflice.. At approximately 1710 hours both of the decoys entered East Side Liquor at 1361 E. Maryland S� Yaul, NIN 55106. Wittnrt a minute an undercover V'ice offic�so� ered the business to observe the transaction. The decoys purchased a twelve pack of lvfichelob bottled beer. The clerk who sold the liquor to the decoys was identified by the decoys and the undercovet Vice officer. Vice officers a�d the LIEP eneployee entered the business, ider�tified themsetves, and obtained a photo identification from the clerk. The clerk presented a photo identification by which he was identified as ARVII�T, Shawn Phittip (DOB 08-18-76, of 1010 Case St. Paul, MN 55106 (H}774-3695). The LIEP employee talked to the store owner. The Ivfichelob twelve pack that was purchased was tumed over to the property room for evidence. Based upon our previous conversations, it is my understanding that your client is admitting the facts contained in the Notice of Violation letter dated April 1, 1998 and the matter is being scheduled in front of the Saint Paul City Council for their determination of the appropriate penalty for the violation. The Office of License, Inspections and Environmental protection will recommend a suspension of six days, based upon the penalty mahix contained in Saint Paul Legislative Code §409.26. Reilly), Squad 792 (Sgt. Wachal), and Squad 790 (Lt. Neuberger) assisted by LIEP Lic,ease Inspector Kris Schweinler conducted liquor comptiance checks. The b¢sinesses that were tested are addresses that either the Vice Unit or LIEP has had compiaints regazding the sate of alcohol to underage persons or were identified by WCCO TV in an investigative report on underage alcohol sales. Prior to going out to the businesses the underage decoys provided by LIEP were seazched for money and any other identifications. The decoys presented curreni photo identification from which their dates of birth and their identiries were verified. IY was deteanined that the deeoys were under the age of twenty-one. The decoys were photographed. Copies of the decoys' identification cards and the photographs that were taken are retained in ihe Vice Unit oflice.. At approximately 1710 hours both of the decoys entered East Side Liquor at 1361 E. Maryland S� Yaul, NIN 55106. Wittnrt a minute an undercover V'ice offic�so� ered the business to observe the transaction. The decoys purchased a twelve pack of lvfichelob bottled beer. The clerk who sold the liquor to the decoys was identified by the decoys and the undercovet Vice officer. Vice officers a�d the LIEP eneployee entered the business, ider�tified themsetves, and obtained a photo identification from the clerk. The clerk presented a photo identification by which he was identified as ARVII�T, Shawn Phittip (DOB 08-18-76, of 1010 Case St. Paul, MN 55106 (H}774-3695). The LIEP employee talked to the store owner. The Ivfichelob twelve pack that was purchased was tumed over to the property room for evidence.
