91-2073 ' � Council File # �i�'v�0?.3 Green Sheet # RESOLUTION CITY OF SAINT PAUL, MINNE A �.�}�'!l�'s"'"""'�._.�....a.� /' Presented By Referred To Committee: Date Whereas, The City of Saint Paul was notified on October 22, 1991 by the Dakota County Administrator that Dakota County Board of Commissioners would consider the imposition of an additional $7.50 per cubic yard disposal fee for solid waste collected from outside of Dakota County, and which notice further stated that this additional surcharge would not be imposed on solid waste collected from properties located within Dakota County; and Whereas, The Dakota County Board of Commissioners will consider the adoption of this discriminatory surcharge at its meeting to be held on November 5, 1991 at 9:00 a.m., and comments were invited on this issue; and Whereas, There are many issues, including solid waste disposal, sewage disposal, airport siting and transit, which counties and local units of government within the metropolitan area must address; and Whereas, Resolution of these problems should not be based on policies which are discriminatory and are intended to solely benefit only certain segments of the metro area; and Whereas, It is the opinion of the City Council of the City of Saint Paul that the proposed discriminatory surcharge on non-residents of Dakota County will have the effect of exasperating these problems and be counter-productive in obtaining solutions acceptable to the communities affected; now therefore be it Resolved, That the Council of the City of Saint Paul does hereby e�ress its objections to the proposed $7.50 per cubic yard surcharge to be imposed on the disposal of mixed municipal solid waste at disposal facilities located within that County as this surcharge is discriminatory in its purpose and effect, and that if there is shown to be a need for additional financing of County activities to be supported by such a surcharge, that the County Board should impose fair and equitable charges upon all those parties receiving the benefits of the service; and be it � } � 3 ._ ������,r� ��� � Further Resolved, That the City Clerk is hereby directed to forward a copy of this resolution to the Dakota County Board of Commissioners to be received and considered at the Board's regular meeting to be held on November 5, 1991. Revenue from the fees must be used for landfill abatement, or costs of disposal facility dosure, postclosure care, and response actions or for mitigating and compensating for the local risks, costs, and other adverse effects of facilities. Dakota County currently unposes a fee of $3.33 per cubic yard or $11.08 per ton on solid waste deposited at Pine Bend Landfill. During the 1991 legislative session, the Waste Management Act was amended to allow counties to impose an additional surcharge not to exceed $7.50 per cubic yard or $24.98 per ton on waste deposited at landfills, if the waste is collected outside of the county. Speculation outside Dakota County is that if the MPCA Board does not approve construction of the DakoEa County incineration project, the County may impose part or all of the additional fee to recover part of the estimated $6,800,000 it has already spent on the projecE, to the extent such use of the funds is eligible under the Waste Management Act. Or the CounEy can spend the funds on other eligible activities. In September the Ramsey and Washington County Boards decided not to increase � the tipping fee of $66.79 per ton at the Newport Facility for 1992. The fee covers waste processing costs at the facility, project administrative costs and allows for a 2.4% reserve for any shortfall the counties may experience during 1992. Should Dakota County choose to impose the maximum allowable fee under State Law, Ramsey County staff estimate that the potential additional cost on waste delivered to Newport would be $3.61 per ton. The surcharge would not affect waste collected within the County. The fee will be an additional $7.50 per cubic yard to be paid at the disposal site in conjunction with other existing surcharges. If approved, the effective date of the new fee will be January 1, 1992. � The County Board will formally consider this action at its regular meeting on November 5, 1991 at 9:00 A.M. in the Board Room, Dakota County Administration Center, Hastings.
