91-2046��������� ' Council File � �-��rl� � (� ; � a ''�----�'`� Green Sheet � /�0��� RESOLUTION Y OF SAINT P MINNESOTA presented � �Referred To �/ ,� � � r K} �u�-_ Committee: Date /; � ��" �� l/ WHEREAS, Section 502 of the Saint Paul City Charter and Section 3.04 of the Administrative Code authorize the City Council upon request of the City Attorney to appoint special counsel and provide compensation therefor in cases of special and unusual circumstances; and WHEREAS, the Department of Public Works and the Real Estate Division of the Finance Department are engaged in negotiations for the acquisition of property for the relocation of Shepard Road involving Northern States Power Company, Chicago and Northwestern Transportation Company and the Soo Line Railroad Company; and WHEREAS, the nature of the legal work needed to complete said negotiations is of a highly specialized nature such that said departments together with the City Attorney agree that there is need for the hiring of outside counsel and have requested same; now therefore, be it RESOLVED that by virtue of the aforesaid special and unusual circumstances the law firm of Oppenheimer, Wolff and Donnelly be retained for the purpose of negotiating contracts with the aforesaid property owners; and be it FURTHER RESOLVED that the total billing rate per hour to be charged by said firm not exceed $150.00 per hour; and be it FURTHER RESOLVED that the compensation be paid to said firm be charged to Activity No. C91-25022-0789-21003. Boulevards will be regraded and sodded and a lantern style street lighting system will be installed: Parts of Hartfard, Scheffer, Eleanor, Pinehurst, Wheeler, Davern and Macalester Street.
