WHEREAS, t e Counci o t e City o Saint Pau , y reso ution
C.F. 91-1730 , approved October 8 , 1991 , vacated public land in
the City of Saint Paul described as follows :
All that part of the alley adjoining lots 40 through 45
and adjoining lots 55 through 60 and also adjoining the
east one-half of lot 39 and 54; also all that part of
the east one-half of lot 39 , all in Block 9 , Smith' s
Subdivision of Stinson' s Division of the NW 1/4 of
Section 36 , Township 29 North , Range 23 West .
WHEREAS, based upon the utility easement Certificate of
Intended Non-Use filed voluntarily on behalf of Continental
Cablevision , and made a part hereof by this reference and
filed in the office of the City Cler. k of Saint Paul, the
City for itself and on behalf of this corporation , waives
the r. ight to the utility easement in the vacated area as
described in the Certificate of Intended-Use .
THEREFORE BE IT RESOLVED, pursuant to Section 130 .06 of the
Saint Paul Legislative Code and on behalf of the City of
Saint Paul and those persons for whom the City has reserved
easements, the Council of the City of Saint Paul does hereby
waive and release the retained utility easement in the
vacated public proper.ty as specified in the Certificate of
Intended Non-Use described as follows :
All that part of the alley adjoining lots 40 through 45
and adjoining lots 55 through 60 and also adjoining
the east one-half of lot 39 and 54; also all that par.t
of the east one-half of lot 39 , all in Block 9 , Smith' s

BE IT FURTHER RESOLVED, that upon passage of this
resolution, the City Clerk is hereby authorized and directed
to record a copy of this resolution in the office of the
County Recorder of Ramsey County, Minnesota, and also file a
copy of this resolution with the Registrar of Titles , Ramsey
County, P4innesota, and shall maintain a copy of all Certificates
of Intended Non-Use referenced in this resolution on file in the
office of the City Clerk.
AND BE IT ALSO RESOLVED, that in all other respects ,
resolution C. F. 91-1730 shall remain in full force and
effect .
